My understanding is that you have updated the list accordingly as included in the supplemental materials. Mineral rights owners of only the PUD parcel itself need to receive the notice. 1 The legal description attached to the public notice should be for the overall PUD property including the unplatted portion, and including the right-of-way. I noted that the metes and bounds description is quite lengthy for the overall parcel. We can check with Carey Gagnon on other options such as a shorter reference to. the legal description as previously recorded (i.e. past resolutions or agreements). Three of the additional copies can be on compact disk, one should be a printed copy. The disks should be formatted in the same manner (sections, supplemental submittal, etc.) as the hard copies that we currently have. Thanks for the opportunity to clarify the above items. My hope is to meet with you again fairly soon to review the documentation, processing for the Board's signatures and begin preparing for the Director's Decision. We were pleased with the Director's Determination and input from the County Attorney's Office that will provide for an administrative review process. The Director's Decision has been scheduled for June 1~. Subsequent to the decision we anticipate scheduling the plat and related documents on the Board of County Commissioner's consent agenda for execution and then recording. Given the complexity of the documentation, we anticipate working to complete and finalize the amended documents prior to the Director's Decision if possible and well in advance of scheduling with the Board. Please note that some additional copies of the Application are required and will need to include all supplemental information provided as part of the completeness review. We also hope to initiate the County Surveyor's review of the plat as soon as possible. Public notice for the Director's Decision is required and needs to be completed by May 16'h. This required additional review by the County Attqrney's Office We have concluded our review with Carey Gagnon, Assistant County Attorney and have made the following determinations. Fred Jarman, Director of the Building and Planning Department has determined that the PUD Amendment Request is a non-substantial modification, therefore both Applications will be processed as administrative reviews in accordance with Section 5-306 (Amended Final Plats) and Section 6-201 (F)(2)(a) (PUD Amendment). In regard to noticing requirements both will be processed pursuant to Section 4-104. This letter is also to inform you that as of this date, May 2, 2012, your Applications have been deemed Technically Complete. Please understand that a determination of technical completeness shall not be viewed as a recommendation of approval, finding of an adequate application, or a find ing of general compliance with any goal or objective of the Unified Land Use Resolution of 2008, as amended orthe Garfield County Comprehensive Plan 2030. In total I have attached three MS Word documents. The first document titled Development Agreement FINAL PLAT 20100B06.doc is the Development Agreement approved with the Phase 1 Final Plat on September 7,2010 and recorded as Reception No. 793248. The second document titled Development Agreement AMENDED FINAL PLAT 20111026.doc is the current Development Agreement proposed for the Amended Final Plat application. The third document titled Comparison of Phase 1 Final Plat Development Agreement to Amended Final Plat Development Agreement. doc is a comparison of the first two documents. All new additions to the Amended Final Plat document are highlighted in blue text and are underlined, and all deletions from the original Final Plat document are highlighted in blue text and are crossed out. As we discussed this morning, the majority of the revisions are related to updating the record of approved and recorded documents related to the development. The revisions in the following paragraphs reflect these types of modifications: D, E, F, H, I, 2.d, and EXHIBIT 2. The original paragraph G was deleted because it was no longer pertinent since it references the deadline for the submittal of a Final Plat application, and a Final Plat application has already been submitted and approved. There are several revisions that I hadn't remembered during our meeting which I would characterize as factual corrections to the original Development Agreement. The first of these factual revisions is included in paragraphs G and 2.b where the number of development phases is correctly stated as 21 separate phases. The original agreement stated that there are only 11 separate phases. In actuality, there are 10 phases situated on the middle bench portion of the project, and there are an additional 11 phases located on the mountain portion of the project for a total of 21 separate phases. With respect to this issue, we and the applicant both recognize that although there are 21 separate phases, the vesting rights for the entire development are only for 15 years, which will necessitate that many of the phases will be grouped together and occur simultaneously, but in any case, we believe that the development agreement should reflect the correct total number of development phases. The second factual revision is in EXHIBIT 1, which is the legal description for the remaining undeveloped portion of the property. When we prepared the current Amended Final Plat application we realized that there had been an omission in the legal description in the original Development Agreement, which this revision corrects. You should also be aware that in our preparation today of the comparison document described above, we noticed that there is yet another error in the legal description, which remains uncorrected in the documents attached to this email. The final line of the legal description should read as follows: '7he combined area of the above described three parcels and excluding the ane 1 except!o.n porcel is 5,200.13 ocres more or less." We anticipate that as the County Attorney reviews this document there will probably be additional revisions at which time this additional correction to the legal description can be incorporated into the document. The revisions in paragraphs J, K, L, N, and 2.e, either provide appropriate references to the current Amended Final Plat application or are related directly to the issues associated with the Amended Final Plat application, such as the satisfaction of the phase 1 SIA and the release of the cash deposit provided to secure the SIA. While the narrative description indicates only changes associated with the right-of-way, the phasing schedule contained in the Amended PUD Application includes revisions to a variety of development elements (Le. changes in the number of cabin lots, estate lots, and ranch lots in each phase). 4. The list of adjacent property owners and owners within 200 ft. needs to be updated to reflect owners within 200 ft. of the overall tract that is part of the plat amendment request (Le. the parcel that the right-of-way is being merged with).
