PLAT NOTES
1. The Basis of Bearing for this survey is N 89°57'15" E between a 21/2 inch G.L.O. brass cap found in
place at the northwest corner of Section 16, Township 6 South, Range 88 West, of the 6th Principal
Meridian and a 2-1/2 inch G.L.O. brass cap found in place at the North Quarter Corner of said Section
16.
2. All portions of this survey are based on a title insurance policy prepared by Stewart Title of Glenwood
Springs, Inc., Order No. 20060297-C9 with an effective date of May 28, 2010. This survey is also based
on an ALTA/ACSM Land Title Survey prepared by Jerome Gamba & Associates, Inc. dated July 20, 1998.
3. The unit of measure for this survey is the U.S. Survey Foot.
4. The centerline of Garfield County Road 115 shown hereon is based on a "best fit" of tangents and curves
to the physical locetion of the road centerline as surveyed in the field in August, September, and October
of 1996 by Jerome Gamba 8, Associates, Inc. The legal description of the centerline of Garfield County
Rood 115 as recorded in book 554, page 204 in the office of the Garfield County Clerk and Recorder
contains numerous errors and/or omissions, and as a result it is irnpossible to relate the legal description
to the physical location of the road. Therefore, the legal description of the centerline of Garfield County
Road 115 as recorded in book 554 page 204 is not depicted on this survey.
5. Building setback, height and floor space area restrictions vary throughout the property and are defined in
the amended Spring Valley Ranch Planned Unit Development approved on December 7, 2007 by the
Garfield County Boord of Commissioners by Resolution No. 2008-55, recorded as recorded in Reception
No. 747015 of the real estate records of Garfield County, Colorado, as corrected by Resolution No.
2010-38, recorded as Reception No. 786992 of the real estate records of Garfield County, Colorado,
and by Resolution No. 2008-16, recorded as Reception No. 747016 of the real estate records of Garfield
County, Colorado.
6. A portion of property is depicted on FIRM Panel Number 080205 1470b, dated January 3, 1986 within
Zone D, which is defined as "areas of undetermined, but possible, flood hazards." according to this
published FIRM panel. The adjoining panel is 080205 1460. According to our research, panel 1460 has
not been published. Therefore, the remainder of the properly does not fall within a mapped floodplain.
However it should be understood that significant stormwater runoff and/or snow melt con create flooding
conditions in areas with no flood plain designation.
7. The property may be subject to the encumbrances as provided in book 367 page 185 and book 367
page 188 of the real estate records of Garfield County, Colorado.
8. The property is subject to a pipeline easement described in book 502 page 387, book 502 page 467
and book 504 page 751 of the real estate records of Garfield County, Colorado, not depicted hereon.
9. Open space parcels are designated as utility, drainage, irrigation and access easements which are
dedicated to the Declarant, the Master Association, the Club Property Owner and the Landis Creek
Metropolitan District No. 1, as described in Section 9.5 of the Master Declaration of Covenants,
Conditions and Restrictions for Spring Valley Ranch P.U.D., for the purpose of the installation and
maintenance of utility, irrigation and drainage facilities, including but not limited to, water lines, sewer
lines, drainage culverts, drainage detention structures and related facilities, together with the right to trim
interfering trees and brush; with perpetual right of ingress and egress for installation and maintenance of
such lines and facilities. Such easements and rights shall be utilized in a reasonable and prudent
manner. Landis Creek Metropolitan District No. 1 may also grant easements within the open space areas
to other utility and service providers. However, in order to preserve the quality of the open space, any
easements provided to other utility or service providers must be granted in writing and must provide
specific legal descriptions and contain reosonable and customary limitations as to the permitted use of
said easements.
10. All areas within platted lots that lie outside of the designated building envelopes are designated as
utility, irrigation and drainage ectsements which are dedicated to the Declarant, the Master Association,

the Master Declaration of Covenants, Conditions and Restrictions for Spring Valley Ranch P.U.D., for the

12. Blanket Ernergency Services Easement: There is hereby created, granted and reserved, as described in
Section 9.16 of the Master Declaration of Covenants, Conditions and Restrictions for Spring Valley Ranch
P.U.D., for the use and benefit of all police, sheriff, fire protection, ambulance and other similar
emergency agencies or persons, now or hereafter serving the Common Interest Community and its
Owners and Occupants, a perpetual, non-exclusive blanket Emergency Services Easement over, upon,
along and across all streets, roads, Shared Driveways, properties and areas within the Common Interest
Community, for use in the lawful performance of their duties.
13. Any private improvements constructed within any platted easement are constructed at the sole risk of
the individual lot owner. The public or private entity to which any easement is granted shall not be
responsible for the repair or replacement of any private improvements within any easement that are
damaged as a result of any action consistent with the intended use of said easement.
14. Conservation Easement: There is hereby created, granted and reserved, as described in Section 9.11
of the Master Declaration of Covenants, Conditions and Restrictions for Spring Valley Ranch P.U.D., for
the use and benefit of the Spring Valley Ranch Master Association (The Association) a perpetual,
non-exclusive "Conservation Easement' upon all portions of the Lots in all residential zone districts that lie
outside of the platted Building Envelopes, for purposes of preserving and enhancing the wildlife habitat in
the Conservation Easement area and the open space character of the Conservation Easement area. No
disturbance shall be allowed in the Conservation Easement area, including without limitation excavation,
grading or clearing activities, Improvements, and landscaping; provided, however, that the following
activities are expressly allowed within the areas subject to the Conservation Easement:
a. vegetation manipulation where required by the Wildfire Mitigation Plan or as undertaken by the
Wildlife and Wildfire Trust;
b. disturbance required in connection with the construction and maintenance of and access to all
easements herein reserved or in existence, underground utilities, irrigation and drainage systems,
and access driveways and driveway features approved by the Design Review Committee, including
retaining walls, guard rails, driveway lighting, landscaping, and gate/entry features;
c. disturbance required in connection with the construction and maintenance of and access to retaining
walls, debris flow and rock -fail barriers or other engineered structures necessary for the development
and protection of structures and common elements;
d. removal of deadfall and selective thinning of vegetation, including but not limited to opening view
corridors from the residence with the prior written approval of the Design Review Committee; and
e. construction, operation and maintenance of and access to individual sewage treatment systems.
The Association shall hove the obligation and authority to enforce these restridions, and shall be
responsible for managing, administering and maintaining the Conservation Easement areas in
accordance with the purposes described above and in compliance with the Wildlife Mitigation Plan and
the Wildfire Mitigation Plan, all as more fully set forth and described in the Master Declaration of
Covenants, Conditions and Restrictions for Spring Valley Ranch P.U.D., as the some may be amended or
supplemented.
15.Restrictions on Owners in Easement Areas: As described in Section 9.18 of the Master Declaration of
Covenants, Conditions and Restrictions for Spring Valley Ranch P.U.D., Owners of Lots and Cabin
Interests that are subject to any easements created by this recorded Plat, Master Declaration of
Covenants, Conditions and Restrictions for Spring Valley Ranch P.U.D., or a Supplemental Declaration all
as the same may be amended, and shall acquire no right, title or interest in any cables, conduits, mains,
lines, or other equipment or facilities or improvements that may be installed upon, over or under the
easement areas by a beneficiary of said easement rights. Moreover, Owners and Occupants of Lots and
Cabin Interests that are subject to any such easements are hereby prohibited from constructing any
improvements upon the easement areas, altering or obstruding the flow of any water or drainage
thereon, or landscaping the same, in arty manner thot might interfere with the full and proper exercise of
said easement rights by any beneficiary thereof. Finally, said Owners and Occuponts are hereby
prohibited from violating any of the restrictions relating to the use of the easement areas as may be set
forth in the Master Declaration of Covenants, Conditions and Restrictions for Spring Valley Ranch P.U.D.,
any Supplemental Declaration, or in the Wildlife Mitigation Plan or Wildfire Mitigation Plan, as the same
may be amended. Any Owner or Occupant violating any of these restridions shall be obligated to
remove the offending improvement or landscaping and to restore the surface of the area to its original
condition at the Owner's cost and expense, or otherwise to remedy the violation, within 30 days following
a written request therefor from any easement beneficiary. If said Owner or Occupant fails to comply with
the request in a timely manner, the Master Association shall have the right to enter upon the Owner's Lot
to perform the necessary work and may assess the costs thereof against the Owner and the Owner's Lot
in the form of a Reimbursement Assessment.
16. The easements created, granted and reserved herein are in addition to, and shall be construed as
consistent with, those easements reserved in the Master Declaration of Covenants, Conditions and
Restrictions for Spring Valley Ranch P.U.D. The property subject to this plot is subject to the eosernents
created, granted and reserved by the Master Declaration of Covenants, Conditions and Restrictions for
Spring Valley Ranch P.U.D., as the same may be amended or supplemented, specifically but without
limitation the following:
a. Easements for Incidental Encroachments;
b. Declarant and Master Association Easements Over Streets, Roads, Shared Driveways, and
Association Property;
c. Open Space and Wildlife Movement Corridor Easements;
d. Defensible Space, Fuels Reduction Easements and Fuelbreak Easements;
e. Recorded and Prescriptive Easements and Licenses; and
f. Wildlife Mitigation Plan.
17. Directly connected impervious areas shall be minimized in the development of individual lots.

18. All exterior lighting will be the minimum amount necessary and all exterior lighting will be directed
inward and downward, towards the interior of the subdivision, except that provisions may be made to
allow for safety lighting that goes beyond the property boundaries.
19. Colorodo is a Right -to -Farm State pursuant to C.R.S. 35-3-101, et. seq. Landowners, residents and
visitors must be prepared to accept the activities, sights, sounds and smells of Garfield County's
agricultural operations as a normal and necessary aspect of living in a County with a strong rural
character and a healthy ranching sector. All must be prepared to encounter noises, odor, lights, mud,
dust, smoke, chemicals, machinery on public roads, livestock on public roads, storage and disposal of
manure, and the application by spraying or otherwise of chemical fertilizers, soil amendments,
herbicides, and pesticides, any one or more of which may naturally occur as a part of a legal and
non -negligent agriculturol operations.
20. All owners of land, whether ranch or residence, have obligations under State law and County
regulations with regard to the maintenance of fences and irrigation ditches, controlling weeds, keeping
livestock and pets under control, using property in accordance with zoning, and other aspects of using
and maintaining property. Residents and landowners ore encouraged to learn about these rights and
responsibilities and ect as good neighbors and citizens of the County. A good introductory source for
such information is A Guide to Rural Living 8r Smolt Salle Agriculture put out by the Colorado State
University Extension Office in Garfield County.
21. No open hearth, solid -fuel firepiaces are allowed anywhere within the subdivision. One (1) new
solid -fuel burning stove, as defined by C.R.S. 25-7-401, et seq., and the regulations promulgated
thereunder, shall be allowed in any dwelling unit. All dwelling units shall be allowed an unrestricted
number of natural gas burning stoves and appliances.
22. 11 has been determined that certain building locations within the Spring Valley Ranch PUD may lie
within, and be subject to, certain natural geologic hazards, involving landslides, potentially unstable
slopes, debris flows and/or mudflows, rock fall and ground subsidence/faults. Prior to issuance of a
building permit for structures within all lots, Garfield County shall require the submittal of a site specific
soils test and engineering report addressing soils and geologic conditions, foundation design and
drainage prepared by a registered professional engineer. All site development, including building
construction, shall be conducted in accordance with the engineer's stipulations.
23. Accessory Dwelling Units (ADU's) as defined in Article XVI of the GARFIELD COUNTY UNIFIED LAND
USE RESOLUTION OF 2008, AS AMENDED, are not permitted within any zone district of the Spring
Valley Ranch PUD.
