and the County Surveyor has signed the Final Plat in Mylar form, it will be scheduled at
the next BOCC meeting to be placed on the consent agenda with a request to
authorize the Chairman of the BOCC to sign the plat.
Once the Final Plat is signed, it is then recorded by the County Clerk in the Clerk and
Recorder's Office for a fee of $11 for the first sheet and $10 for each additional sheet
thereafter. This fee shall be paid by the applicant. This act of recording the signed Final
Plat represents the completion of the Garfield County Subdivision Process.
Please refer to the specific language in the Final Plat portion (Section 5:00) of the
Subdivision Regulations for specific timelines and additional responsibilities required of
the applicant to complete the Final Plat process.

WHEREAS on the () . T day of May, 2005, William R. Patterson, Rodney C. Power,
Ronald E. Tipping and Marie E. Tipping, whose address is P. O. Box 1329, Grand Junction,
Colorado 81502 (Individually and collectively as "Lessor) entered into a Surface Lease
Agreement with EnCana Oil & Gas (USA) Inc., whose address is 370 777h Street, Suite 1700,
Denver, CO 80202 ("Lessee"), covering the below described lands in Garfield County, Colorado.
A parcel of land located in the SEY4SWY4 of Section 27, Township 7 South, Range 96 West of
the 6th Principal Meridian, Garfield County, Colorado. The said parcel of land being more
particularly described as follows and shown on Exhibit "A" attached hereto:
TOWNSHIP 7 SOUTH, RANGE 96 WEST. 677-' RM.
Section 27: Beginning at a point in the SE%SWY4 of said Section 27, which bears North
77°40'08" West, a distance of 922.46 feet from the South 1/4 Comer of said Section 27,
(being a 1982 aluminum cap);
Thence South 88°40'01" West, a distance of 400.00 feet;
Thence North 0V19'27" West, a distance of 653:41 feet
Thence North 88°40'01" East, a distance of 400.00 feet
Thence South Q1°19'27" East, a distance of 653.41 feet to the Point of Beginning.
Basis of bearings is the South line of the SW/ of said Section 27 which is taken from
global positioning satellite observations to bear North 89"28'22" East, a measured
distance of 2,595.40 feet, (the Southwest Comer of said Section 27, being a 1982
aluminum cap). Containing 6.00 acres, more or less.
WHEREAS said agreement provides for, among other things, the right to enter upon and use
the Lessor's property for the construction and placement of one or more compressors with
related storage tanks, valves, metering house and related equipment necessary for the
operation of the compressors and compression of natural gas for the operations of Lessee. Said
agreement sets forth payment of specific amounts to cover damages resulting from the
construction, use and maintenance of the compressor site location(s). Said agreement, with all
of its terms, conditions, covenants and other provisions, is referred to and incorporated into this
Memorandum for all purposes.
NQW THEREFORE this Memorandum is placed of record for the purpose of giving notice of the
Surface Lease Agreement.

We represent George P. Strong. On July 19, 2007, Well Permit No. 66018-F was issued to
the Strong Well for commercial use for an office and a warehouse, including the irrigation of 15,000
square feet of landscaping. (Well Permit No. 66018-F cancelled Well Permit No. 201120, the
original exempt well permit for Mr. Strong's well.) Condition No. 6 of Well Permit No. 66018-F
indicates that the average annual amount of ground water to be appropriated from this well shall not
exceed 1.0 acre-feet.
Mr. Strong, through Strong Lumber and Specialty Log Products, obtained a West Divide
Water Conservancy District Water Allotment Contract [Contract No. 070322SL(a)] for 1.0 acre-feet,
a copy of which is enclosed. Please note that the water usage summary chart, prepared by
Zancanella and Associates, indicates that the total diversion requirements from the Strong Well is
1.452 acre-feet.
We spoke with your office with regard to amending Well Permit No. 66018-F to allow for
1.452 acre-feet to be withdrawn from the Strong Well (instead of 1.0 acre-feet). However, as your
office indicated that our original well permit application only requested 1.0 acre-feet as the annual
amount to be withdrawn, they could not amend Well Permit No. 66018-F, rather we had to apply
for a new well permit.

1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit
does not ensure that no injury will occur to another vested water right or preclude another owner of a vested water right from
seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval
of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation
Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37-90-137(2) for the use of an existing well constructed under Permit No. 201120,
appropriating ground water tributary to the Colorado River, on the condition that the well shall be operated only when the
West Divide Water Conservancy District's substitute water supply plan, approved by the State Engineer, is in effect, and
when a water allotment contract between the well owner and the West Divide Water Conservancy District for the release of
replacement water from Ruedi Reservoir is in effect, or under an approved plan for augmentation. WDWCD contract

4) The use of ground water from this well is limited to commercial use for an office and a warehouse, including the irrigation
of not more than 15,000 square feet of landscaping.
5) The pumping rate of this well shall not exceed 15 GPM.
6) The average annual amount of ground water to be appropriated shall not exceed 1.0 acre-feet.
7) The issuance of this permit hereby cancels permit no. 201120.
8) A totalizing flow meter must be installed on this well and maintained in good working order. Permanent records of all
diversions must be maintained by the well owner (recorded at least annually) and submitted to the Division Engineer upon
request.
9) The owner shall mark the well in a conspicuous place with well permit number(s), name of the aquifer, and court case
number(s) as appropriate. The owner shall take necessary means and precautions to preserve these markings.
10) This well shall be located not more than 200 feet from the location specified on this permit.
11) This well shall be located at least 600 feet from any existing well, completed in the same aquifer, that is not owned by the

On January 9, 2007, you returned Mr. Strong's commercial well permit application with a
request for additional information. A copy of your letter is enclosed. At your request, we have
completed the Commercial Drinking and Sanitary Well Worksheet and have provided a sworn
Affidavit by Mr. Strong to attest that there is no other source of water available for the property, that
this is the only well on his property, there will not be any outside use of the water pumped from this
well, the annual appropriation will not exceed 1/3 acre-foot (108,600 gallons) per year and a totalizing
flow meter will be installed on the well.
We are returning the original well permit application to you as well. If you need any further

General Site and Situation Information
George Strong purchased 17.57 acre property in this application for the
installation of facilities to be used for storage of oil and gas drilling supplies,
equipment and related materials for the various natural resource exploration
companies doing processing activity in the immediate area. As an accessory and
needed use, he obtained a Contractor's Yard permit for 5.176 acres of the property
and now wishes to subdivide the site into four additional lots with the same uses.
Mr. Strong anticipates he will build on each lot one storage building with an
administrative office and one bathroom so that within the building there will be
sanitation facilities for the drivers and a small office for administrative matters.
Access and Egress
The site is west of Parachute and adjacent to County Road 300, which
provides access and egress. It is flat site sloping very slightly couth and is bordered
by the compressor stations of Encana on the south and east and by the frontage
road along and south of federal highway I-70. There are industrial uses all around
the property. The subdivision will have a common 40' wide gravel access road
running along the southern border of the property for 656 feet, then turning north
for 408 feet and thence east 300 feet into a common cul de sac for four lots with a
75 foot radius. A driveway access permit to the property was previously issued and
it is contemplated that an Access Permit will be needed from the state and the
applicant will supplement the traffic impact study previously provided to include
this contingency. Dust control and mitigation will be implemented as part of the
prior conditions of approval.
Water well access
There is an augmented water well existing on the property, which permits
the use sought, and which would serve all five lots as planned. A water allotment
contract has been obtained and is attached as well. A septic system will be installed
on each lot. Each lot will access by easement to the well facilities via easements as
shown on the Sketch Plan.
Site Location

The site is adjacent to the Orchard Unit Compressor station of Encana,
which site was recently granted an upgrade to its Special Use permit to add
additional compressor units and other activities consistent with uses surrounding
this site. There are no known hazards impeding the development of this site as
planned. The subdivision will access off CR 300, the same road as Encana uses to
access their site. The site is fenced on all sides. NP
Land Use Breakdown
The property presently is zoned ARRD. There are no proposed zoning
changes.
Future uses on any subdivided lot will require a special use permit process.
None of the lots are seeking that permission in this application simultaneously with
this application for subdivision.

Total Proposed Density: One building per 3.51 acres
Water Supply
Water for the storage facilities is proposed to be provided by one augmented well
previously drilled and on site. Well permit No. 66018-F for George Strong is
attached. The well has a West Divide Conservancy District water allotment
contract, No. 070322SL. Copies of these documents are attached. A water
diversion of 1.452 acre feet per year is applicable and the consumptive use is 0.963
acre feet per year. A totalizing flow meter will be installed on the well once use is
begun for verification of annual appropriation. Storage will be conducted indoors
so materials stored will not result in pollution of surface run-off.
Conditions of Use
In October 2007, the Garfield County Commissioners approved a Special
Use permit for the area designated as Parcel 1 on the attached Sketch Plan. On
October 17, 2007 the Planning Office forwarded a letter to the applicant
containing 13 conditions of approval, which letter is attached. Those conditions
will apply to the lots in this subdivision as well as others that may be approved.
Sewage Treatment and Disposal
Sewage treatment and disposal will be accomplished by individual sewage
disposal systems (ISDS) for each subdivision lot, which will be designed by a
professional engineer and comply with the conditions of approval. The existing
soil conditions are conducive for such systems and all systems will comply with
applicable state and county regulations.
Soil Conditions
The applicant submitted a Huddleston -Berry lab report describing the soil
conditions in some detail and specifying certain criteria for building on the soil
conditions on site. These conditions were noted for prefabricated metal buildings
which are the type of construction the applicant will use. The recommendations of
this attached study will be followed and do allow construction as planned.
Utilities
Electrical service is currently planned to come from the Public Service
Company which has an easement in the northeast comer of the property. To the
extent possible, the subdivider wants to arrange for a source for natural gas service
to the site although there is no natural gas service to this location at this time.
Covenants will encourage use of renewable energy sources such as active or
passive solar systems, however, it is contemplated that propane will be utilized.
Telephone lines are on adjacent properties and it is expected that telephone service
will be extended to the subdivided lots.

Specifications
1. A driveway approach is understood to be that portion of the county road right -of way between the pavement edge
and the property line that is designed and used for the interchange of traffic between the roadway and abutting
property.
2 At any intersection, a driveway shall be restricted for a sufficient distance from the intersection to preserve the
normal and safe movement of traffic. (It is recommended for rural residence entrances that a minimum
intersection clearance of 50 feet be provided and for rural commercial entrances a minimum of 100 feet be
provided.)
3. All entrances and exits shall be so located and constructed that vehicles approaching or using them will be able to
obtain adequate sight distance in both directions along the county road in order to maneuver safely and without
interfering with county road traffic.
4. The Applicant shall not be permitted to erect any sign or display material, either fixed or movable, on or
extending over any portion of the county road right-of-way.
5. Generally, no more than one approach shall be allowed any parcel or property the frontage of which is less than
one hundred (100) feet. Additional entrances or exits for parcels having a frontage in excess of one hundred 100)

be made according to the type of traffic to be served and other physical conditions.
9. The construction of parking or servicing areas on the county road right-of-way is specifically prohibited.
Commercial establishments for customer vehicles should provide off -the -road parking facilities.
10. The grade of entrance and exit shall slope downward and away from the road surface at the same rate as the
normal shoulder slope and for a distance equal to the width of the shoulder but in no case less than twenty (20)
feet from the pavement edge. Approach grades are restricted to not more than ten percent (1 0%).
11. All driveways and approaches shall be so constructed that they shall not interfere with the drainage system of the
street or county road. The Applicant will be required to provide, at his own expense, drainage structures at
entrances and exits, which will become anintegral part of the existing drainage system. The Board of County
Commissioners or their representative, prior to installation, must approve the dimensions and types of all drainage

yield to supply the project. A new well permit and West Divide Water Conservancy
District contract for the allowed and potential uses of the 5 Tots must be obtained.
The map indicates that ditches traverse the lot. The development plan should indicate if
water rights are to be conveyed to the individual lots.
WASTEWATER
The project proposes ISDS systems on 2+ acre lots. The preliminary plan submittal
should demonstrate that ISDS is feasible on the site.
SOILS/GEOLOGY
A detailed soils, geology, and hazards evaluation is required for preliminary plan.
DRAINAGE
There are no significant drainage issues for this site. A complete drainage study and
plan is required for preliminary plan. A detention pond easement is provided in the
southeast comer. The size of the pond as determined by an engineer may alter the size
of the easement.
TRAFFIC/ROADS
The access road and easement must meet GARCO road standards. For 5 Tots, the

Noxious Weeds
• The applicant needs to inventory and map the property for county listed noxious weeds. A weed
management inventory and plan for an adjacent property is not sufficient.
• Diffuse knapweed is prevalent in this area and the potential for spread is high. We encourage the
applicant to be on the lookout for this noxious weed when conducting the inventory.
• All reported noxious weeds found on site shall be treated prior to construction activities, this
includes salt cedar (tamarisk) and Russian olive located on site.
Revegetation Plan
The Revegetation Guidelines from the Garfield County Weed Management Plan calls for the
following:
A. Plant material list.
B. Planting schedule.
C. A map of the areas impacted by soil disturbances (outside of the building envelopes).
D. A revegetation bond or security at Preliminary Plan and prior to Final Plat.
Please provide the plant material list and planting schedule. Please provide a map or information,
prior to final plat, that quantifies the area, in terms of acres, to be disturbed and subsequently
reseeded on road cut and utility disturbances. This information will help determine the
amount of security that will held for revegetation. We require a security if the surface
disturbance is greater than one half acre.
The security shall be held by Garfield County until vegetation has been successfully reestablished
according to the Reclamation Standards section in the Garfield County Weed Management Plan.

We have reviewed the above -referenced proposal to subdivide a parcel of approximately
17.57 acres to contain a total of five commercial/industrial lots, one of which will contain an
existing office and warehouse. Each of the other four proposed lots will contain a storage
building, and each of those will include a bathroom. The domestic water supply is to be provided
through an existing well (Permit No. 66544-F), which is operated pursuant to West Divide Water
Conservancy District (WDWCD) Contract No. 070322SL(a). Sewage disposal is to be provided
throughindividual systems. No water use estimates were provided.
Permit No. 66544-F is valid pursuant to CRS 37-90-137(3)(a)(I)(A), and limits the use of
water from the well to commercial use for an office and a warehouse, including the irrigation of not
more than 15,000 sq. ft. of landscaping. The applicant must apply to this office for a new well
permit to expand the use of the existing well, and the WDWCD contract may also need to be
amended to cover the additional depletions from the proposed structures.
The June 6, 2005 Pump Installation and Test Report filed for this well indicates that it
produced an average of 10 gallons per minute over a two-hour period on date. With sufficient
storage capacity this well should provide an adequate supply for the proposed use.
Based on the above, it is our opinion, pursuant to CRS 30-28-136(1)(h)(I), that the
proposed water supply is physically adequate, however material injury will occur to decreed water
rights unless the applicant obtains and maintains valid well permits for the proposed wells
pursuant to a court approved plan for augmentation or pursuant to the District's temporary

Thank you for the opportunity to review and comment on the sketch plan to subdivide 17.57 acres into 5 lots in the ARRD
Zone District. The property is bordered by EnCana on the south and east, and by the I-70 frontage road to the northwest. The
intended use of the Strong Subdivision is for storage of oil and gas drilling supplies, equipment and related materials for
natural resource exploration. The neighboring properties are currently used for industrial purposes. Division of Wildlife
(DOW) would like to offer the following recommendations to minimize negative impact on wildlife that may inhabit the
area.
The location for the proposed facility and associated roads lie within "winter range", "severe winter range" and "winter
concentration area" for mule deer, and "winter range" for elk. Heavy traffic, particularly during winter months, can increase
the number of roadkilled deer, elk and other wildlife species. During spring, summer and fall months, dust levels from
increased traffic can affect air quality for wildlife in the area. The DOW recommends strict enforcement of speed limits to
minimize roadkills, and magnesium chloride applications to minimize fugitive dust, both of which will reduce negative
impacts to wildlife.
If the newly subdivided lots are to be fenced, the DOW can offer recommendations to lessen impacts on migrating deer and
elk. The DOW cautions that barbed wire fencing can be hazardous to wildlife, and recommends galvanized chain link
fencing to keep wildlife out.
The proposed property lies within black bear habitat range, and potential for conflicts with black bears exists during the
summer and early fall, particularly during years of drought. The DOW recommends bear -proof trash containers and/or
dumpsters for each lot. The DOW also reconunends that employees and anyone else on the property maintain a "bear aware"
policy regarding food, trash, BBQ grills, and birdfeeders. The Division of Wildlife would gladly offer specific on-site
recommendations to minimize human -bear conflict.
The DOW finds no other significant impacts to wildlife regarding the Strong Subdivision, and appreciates the opportunity to

After reviewing the Sketch Plan for George Strong I have only one issue. I want to make
sure the access road is compliant with IFC 2003 and to be able to hold the weight of Fire
Apparatus. Also on the plans it appears that there is a right turn before the cul-de-sac, is this
going to have a curved turn built into the turn or remain a right angle type turn? We need to be
able to allow the fire apparatus to pass at this tum if need be. I believe this needs to have a radial
turn in it. Also is it anticipated that there will be parking on the road or not? If these issues have
already been addressed I'd like to see the resolutions for these issues. If you have any further

General Comments: Garfield County Road & Bridge Department has no objections to
this application with the following comments.
A driveway access permit has been issued for this property and all conditions have been
met for the driveway including a stop sign at the entrance to Cr. 300 and a paved apron.
Cr. 300 has been built to haul road standards and the added traffic volume is not going to
present a problem to the overall traffic volume.

Comments on the proposed Strong Subdivision are provided below:
The potable water source is proposed as a single well. If the well ever serves more than 15 connections or 25 or more people for 60 days or
more per year it will become a public water system and will need to go through CDPHE-WQCD design review and approval process.
Wastewater is proposed as being handled by ISDSs on each lot. These ISDSs can only accept domestic waste. No shop floor drains or other
industrial waste can be accepted by the ISDS without additional permitting.

Just a few comments on the referenced sketch plan.
1. I'm pretty familiar with the area and that there is not much topographic relief. However, I didn't see a
detailed topographic map.
2. I didn't see any information regarding flood plain delineation. Floodplains play into the consideration for
ISDS.
3. The well permit states that the well is approved for one office and warehouse and 15,000 ft of irrigation.
The sketch plan states that the 5 lots will share the existing well. It appears that from the water usage
summary, that the West Divide Water Conservancy District's contract is based on the same information as
the well permit. I tried to make contact with DWR to determine if the well permit and associated water
rights need to be adjusted but I could not make contact. I recommend that the County require
documentation from both DWR and WDWCD indicating that the well is approved for the new subdivision.
4. There is no indication of how many people this water system will serve on a daily basis but the Water
Usage Summary indicates 12 people for the Strong facility. If this well serves 25 or greater people per day
for at least 60 days per year it becomes a Public Water System regulated by CDPHE. The applicant
should begin work with the CDPHE to assure that the system is properly constructed in accordance with
CDPHE regulations by the time it meets the State's Public Water System definition.
5. As each proposed lot will be almost 3 acres, it is likely that each construction site will be required to have a
stormwater management permit from CDPHE. Also, if the owner develops roads and or does other site
grading that disturbs one acre or more of the land under, he also will be required to have a CDPHE
Stormwater management permit.
6. As all lots will utilize ISDS for sewage treatment, the applicant should also be conducting some preliminary
soil testing and site planning to assure that adequate area is being reserved for the ISDS.
