Koss, Deputy when the following proceedings, among others were had and done, to -wit: , Commissioner Chairman , Commissioner , Commissioner , County Attorney , Clerk of the Board RESOLUTION NO. 81— 146 RESOLUTION CONCERNED WITH THE APPROVAL OF A ZONE DISTRICT AMENDMENT TO THE GARFIELD COUNTY ZONING RESOLUTION AND PLANNED UNIT DEVELOPMENT PLAN OF WESTBANK RANCH FILING IV REQUESTED BY WESTBAND RANCH #1 LTD. WHEREAS, Westbank Ranch No. 1 Ltd. filed a petition with the Board of County Commissioners of Garfield County to rezone the herein described property in Garfield County from Agricultural/Residential/Rural Density Zone District to Planned Unit Development Zone District and to approve a Planned Unit Development Plan for Westbank Ranch Planned Unit Development, a Planned Unit Development; and .WHEREAS, a public hearing was held by this Board on December 27, 1978; and WHEREAS, this Board has not taken formal action on such petition; and WHEREAS, based on the evidence, testimony, exhibits, study of the General Plan for the unincorporated area of the County, comments of the Garfield County Planning Department, comments of public officials and agencies, and comments from all interested parties, this Board finds as follows: 1. That proper publication and public notice was provided as required by law for the hearing before the Board; 2. That the hearing before the Board was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing; 3. That the Garfield County Planning Commission recom- mended to this Board that the requested rezoning be granted and Planned Unit Development plan be approved, provided that certain conditions be complied with; 4. That the proposed zoning is in compliance with the recommendations set forth in the General Plan for the unincor- porated area of the County; 5. That the proposed land use will be compatible with existing and permitted land uses resulting from the natural and planned expansion in the area of the proposal; 6. That changing conditions clearly require amendment to the Zoning Resolutions; 7. That, other than in the foregoing particulars, the requested zone change amendment and plan approval are in general conformity with the General Plan for Garfield County, Colorado, and meet all requirements of the Zoning Resolution of Garfield County, and further that the requested Planned Unit Development is suitable and appropriate for the subject property considering the location, condition and circumstances of said property, and that the proposed amendment implements the purposes and meets the standards and requirements of the Planned. Unit Development provisions of the Garfield County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado: Section 1. That the petition of Westbank Ranch No. 1 Ltd. for a zone change from Agricultural/Residential/Rural Density Zone District to Planned Unit Development Zone District for the following described unincorporated area of Garfield County be approved, subject however, to the conditions contained herein. Section 2. That the application for approval of the plan of Westbank Ranch Planned Unit Development, be and hereby is approved, upon the following condition: a) That prior to approval of any plat of Westbank Ranch Planned Unit Development, the applicant shall - take such measures as maybe required by the Court to mitigate impact on County Roads 109 and 154 reasonably associated with the development. Section 3. That the Planned Unit Development shall consist of three Zoning Districts, the boundaries of which shall be indicated upon the final plat or plats of Westbank Ranch Planned Unit Development, which district shall be desig- nated as follows: Residential/Single Family District, also designated R/SF Residential/Cluster Housing District, also designated R/CH Open Space District, also designated OS Section 4. ZONING REGULATIONS Section I. A. To carry out the purposes and provisions of the Garfield County Zoning Resolution, Garfield County, Colorado and, particularly, Section 14.00 of that title, as amended, the Westbank Ranch Planned Unit Development Zoning District is further divided into the following Zone District classifications: R/S.F. - Residential/Single Family Distract R/C.H. - Residential/Cluster Housing District O.S. - Open Space District B. The boundaries of these Districts shall be located as shown on the Westbank Ranch' P.U.D. Plat. Section II. R/S.F. - Residential/Single Family District A. Uses, by right. Single -Family dwelling and customary accessory uses including buildings for shelter or enclosure of small animals or property accessory to use of the -lot for single-family residential purposes and fences, hedges, gardens, walls a.id similar land- scape features. Park and Greenbelt. B. Uses, conditional. None C. Uses, special. None D. Minimum Lot Area 16,000 square feet E. Maximum Lot Coverage 20 percent -3- • • F. Minimum Setback Front yard -- 25 feet Side yard -- 10 feet Rear yard -- 30 feet G. Maximum Building Height 25 feet H. Off -Street Parking/Residential Four (4) off-street parking spaces on the same lot for each dwelling unit or one (1) space per .600 hundred square feet of floor area, which ever is greater. Section III. R/C.H. - Residential/Cluster Housing District A. Uses, by right Single-Familv dwelling, Duplex dwelling and custo- mary accesory uses including buildings for shelter or enclosure of small animals or property accessory to use of the lot for residential purposes and fences, hedges, gardens, walls, and similar land- scape features. Park and Greenbelt. B. Uses, conditional. None C. Uses, special None D. Minimum Cluster Housing lot area 1. Two dwelling unit lot -- 20,000 square feet. 2. Four dwelling unit lot -- 35,000 sqaure feet 3. Lots within a Cluster Housing lot shall have no minimum lot area. E. Maximum Coverage of a Cluster Housing lot 1. 40 percent 2. Lots within a Cluster Housing lot will have no maximum lot coverage. -4- ,'s • • F. Minimum Cluster Housing Lot Setback 1. Front yard -- 25 feet Side yard -- 15 feet Rear yard -- 25 feet Internal lot setbacks for the purpose of ac- commodating duplexes or cluster housing shall be determined at the time of subdivision of a Cluster Housing lot. These may include single- family dwelling units that share common walls (duplex) and combined service facilities, whether or not providing for separate ownership of land and buildings and other architectural innovations such as clustered detached single-family dwellings with private patio yards as the buffer between units. G. Maximum Building Height 25 feet H. Off -Street parking/residential Three (3), off-street parking spaces for each dwel- ling unit, or one (1) space per S00 square of floor area, whichever is greater. Section IV. O.S. -- Open Space District A. Uses, by right Recreational including park, greenbelt, recrea- tional vehicle storage, pasture, water impound- ments and customary accessory uses including buildings for shelter or enclosure of animals or property employed in any of the above uses. B. Uses, Conditional None C. Uses, Special None D. Minimum Lot Area None -5- r. 1 E. Maximum Lot Coverage None F. Minimum Setback from District Boundary 40 feet G. Maximum Building Height 25 feet Section V. Except as hereinabove provided, and except for the following sections of the Garfield County Zoning Re- solution, all provisions of the Garfield .County _Zoning Resolution shall be applicable to the T•:estbank Ranch P.U.D. Zoning Districts. The Sections of the said Zoning Resolution which shall have no applicability are as follows: Section 3.00 through 3.11.04 Section 4.01.02 paragraph ;`1 WESTBANK RANCH SUBDIVISION REGULATIONS Except for the following section of the Garfield County Subdivision Regulations,- all provisions of the Garfield County Subdivision Regulations shall be applicable to. the Westbank Rach P.U.D. The Section of the said Subdvision Regulation which shall have no applicability is as follows: Section 5.09 • 1 SCHOOL/PARKS DEDICATION In accordance with Section 5.11 of the Subdivision Regulations of Garfield County, Colorado, as amended, the Westbank Ranch P.U.D. owners will cooperate with the Board of County Commis- wioners to appropriately compensate the County for the reason- ably necessary public facilities (schools/parks) required by the future residents of the P.U.D. PHASING The Westbank Ranch P.U.D. is presently anticipated to develop in two phases generally described as follows: Phase I. Initial development will include the lower cul-de-sac road and associated utilities as necessary to service the adjoining single family lots. The park space adjacent to Westbank Road will be dedicated to the Westbank Metro -District at this time, if the Metro - District has been formed. If the District is not formed, the park space shall be dedicated as directed by the Board of County Commissioners. Phase II. The final phase will include the upper access road and all associated lots. All remaining open space will be dedicated to the Metro -District if the Metro - District has been formed. If the District is not formed, the park space shall be dedicated as directed by the Board of County Commissi:Jners. s • Section 5. That, upon the Board's determination that the foregoing conditions have been satisfied or agreed to by the applicant, the Chairman be and hereby is authorized to execute an amended Zone District Map to the Garfield County Zoning Resolution, reflecting the amendment herein granted for the following described unincorporated area of Garfield County: A parcel of land situated in Lots 14, 15, 24 and 25 of Section 1, and Lots 10, 11, 12, 13, 14, 15, 18, 19, 20, 21 and 22 of Section 2, all in Township 7 South, Range 89 West of the Sixth Principal Meridian, Garfield County, Colorado, lying Westerly of County Road No. 109, Southerly of Westbank Ranch Subdivision Filing No. 2 and No. 3 as filed in the Garfield County, Colorado, records, Northerly of Mesa Ridge, and Easterly of the North-South Center- line of said Section 2.
