RESOLUTION NO. 81- 333
RESOLUTION CONCERNED WITH THE APPROVAL OF AN AMENDED PRELIMINARY PLAN
FOR WESTBANK RANCH PLANNED UNIT DEVELOPMENT SUBDIVISION.
WHEREAS, Westbank Ranch #1, Ltd., has filed an application with
the Board of County Commissioners of Garfield County, Colorado, for
the approval of a preliminary plan for the herein described property
in the unincorporated area of Garfield County; and
WHEREAS, a public hearing was held by the Garfield County
Planning Commission on the llth day of May, 1981; and
WHEREAS, based on the evidence, testimony, exhibits, study of
the general plan for the unincorporated area of the County, recommenda-
tion of the Garfield County Planning Commission, comments of the Garfield
County Planning Department, comments of public officials and agencies,
and comments from all interested parties, this Board finds as follows:
1. That proper publication and public notice was provided as
required by law for the hearing before the Planning Commission.
2. That the hearing before the Planning Commission was extensive
and complete, that all pertinent facts, matters and issues were submitted,
and that all interested parties were heard at that hearing
3. That the proposed subdivision of land is in compliance with
the recommendations set forth in -the general plan for the unincorporated
area of the County.
4. That all data, surveys, analyses, studies, plans, and designs
as are required by the State of Colorado and Garfield County have been
submitted, reviewed, and found to meet all sound planning and engineering
requirements of the Garfield County Subdivision Regulations, provided
that certain conditions are complied with.
5. That the proposed subdivision of land conforms to the Garfield
County Zoning Resolution, provided that certain conditions are complied
with.
6. That for the above -stated and other reasons, the proposed
subdivision is in the best interest of the health, safety, morals,
convenience, order, prosperity, and welfare of the citizens of Garfield
County.
NOW, THEREFORE, BE IT RESOLVED that the record and recommendation
of the Garfield County Planning Commission be adopted and that the
Preliminary Plat of Westbank Ranch Planned Unit Development Subdivision,
approved on January 7, 1980 and amended as of this date, for the following
described unincorporated area of Garfield County be approved:
A parcel of l.ind situated in Lot 15 of Section 35, Township 6 South, Range 89 1Jcst
of the Sixth Principal Meridian, Lots 13,14,15,24 and 25 of Section 1, and Lots
5.8,9,10,11,12,13,1'x,15,16,1";,19,20,21 and 22 of Section 2, Township 7 South,
Range 89 West of the Sixth I'rincip,al Meridian, all in Garfield County, Colorado,
lying Sou.thcrly of Westbank Ranch Pl:inn d Development Subdivision Filing No. 1
and Westbank Ranch Subdivision Filing No. 2 and '1o. 3, as amended, all as filed
in the Garfield County, Colordo records, and Westerly of a line in said Section 1
partly described by Book 416 of Page 336 as filed in the Garfield County, Colorado
records, said parcel of land is more fully described as follows:

BE IT FURTHER RESOLVED that the following conditions shall
be placed upon this approval:
1. A final drainage study establishing that no damage
will occur to other properties as a result of the proposed cut and
fill associated with the proposed subdivision.
2. No slopes resulting from cut or fill associated with
the proposed subdivision shall be steeper than 2:1 ratio, horizontal
to vertical measurements.
3. A guardrail plan acceptable to the Garfield County
Road Supervisor and the Board of County Commissioners shall be
provided and included as part of required subdivision improvements.

4. A revegetation plan acceptable to the Board of County
Commissioners, but including large trees, shall be provided and
included as part of the required subdivision improvements.
5. The impact of the proposed subdivision upon the Hard-
wick Bridge shall be mitigated by the provision of $500.00 per lot
for each lot within the subdivision, which amount shall be paid to
the Board of County Commissioners at the time of final plat approval,
for application toward the improvement of the Hardwick Bridge.
