SUBDIVISION IMPROVEMENTS AGREEMENT
KNOW ALL MEN BY THESE PRESENT that:
WHEREAS, Westbank Mesa Limited Partnership (hereinafter Owner), entered into a
Subdivision Improvements Agreement with the Board of County Commissioners of Garfield
County, Colorado (hereinafter "Board") dated May 11, 1994, recorded in Book 902, at Page 274
as Reception No. 463061 of the Garfield County records, and amended by agreement on October
16, 1995, recorded in Book 955, at Page 953 as Reception No. 484312 for the improvements of
Westbank Ranch Planned Unit Development, Filing No. 4; and
WHEREAS, the obligations of the Owner have been satisfied, as verified in a statement
from David K. Gallagher, dated June 4, 1997, for performance for work remaining to be
completed consistent with improvements described in the amended Subdivision Improvements
Agreement.
NOW THEREFORE, at the request of the Owner and in consideration of the premises and
prior agreements, the Board hereby acknowledges the satisfaction of the Subdivision
Improvements Agreement entered into by the Owner and the Board for the Westbank Ranch
PUD, and releases security in the amount of $10,000.00.

I scouted and inspected the above site on Monday, June 2, 1997. I followed the same
procedure as stated in my September 21, 1995 inspection. Existing grass stands have
increased at least 10%. That's good! No problem broadleaf weeds or invasive grasses are
present. An occasional Yellow Blossom Sweet Clover Plant is present, which actually
reduces slope erosion; therefore, it does not present a problem.
The bottom bowl area is practically weed free. Only a few Curled Dock plants exist. A real
improvement over 1995!
The only problem area is at the very entrance and continuing approximately 50 yards on
both sides. Russian Knapweed, adjacent to the irrigation ditch, and Musk and Canada
Thistle on both sides are present. I would suggest that when County Road 109 is sprayed
next week, the above small area be treated by the County, with reimbursement to Garfield
County from the subdivision. Mr. Huebinger has agreed to this proposal.
In summary, the subject site is no longer in need of revegetation, and all previous landscape
requirements have been met.
