At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held in
the Commissioners' Meeting Room, Garfield County Courthouse, in Glenwood Springs on Monday, the
8th of April, A.D. 2002, there were present:

when the following proceedings, among others were had and done, to -wit:
RESOLUTION NO. 2 0 0 2- 3 3
A RESOLUTION CONCERNED WITH THE APPROVAL OF AN AMENDED FINAL PLAT OF LOT
22, WESTBANK RANCH PLANNED DEVELOPMENT SUBDIVISION, FILING NO. 1
WHEREAS, the Westbank Ranch Homeowners Association. and Marlin (Colorado), Ltd.
filed an application with the Board of County Commissioners of Garfield County for approval of an Amended
Final Plat of Lot 22, Westbank Ranch Planned Development Subdivision, Filing No. 1;
WHEREAS, based on the material submitted by the applicant, the of the Garfield County Planning
Department, this Board finds as follows:
1. That proper publication, public notice and posting was provided as required by law for the
hearings before the Planning Commission and Board of County Commissioners.
2. That the hearing before the Board of County Commissioners was extensive and complete, that
all pertinent facts, matters and issues were submitted and that all interested parties were heard
at that hearings.
3. That the proposed amended plat of the subdivision of land is in compliance with the
requirements of Section 6:10 of the Garfield County Subdivision Regulations of 1984, as
amended.
4. That all data, surveys, analyses, studies, plans and designs as required by the State of
Colorado and Garfield County have been submitted, reviewed, and found to meet all sound
planning and engineering requirements of the Garfield County Subdivision Regulations.

5. That the proposed subdivision of land conforms to the Garfield County Zoning Resolution.
6. That for the above -stated and other reasons, the proposed subdivision is in the best interest of
the health, safety, morals, convenience, order, prosperity and welfare of the citizens of
Garfield County.
NOW, THEREFORE, BE IT RESOLVED that the Amended Final Plat of Lot 22, Westbank
Ranch Planned Development Subdivision, Filing No. 1 for the following described unincorporated area of
Garfield County be approved with the following conditions:
1. That all representations of the applicant, either within the application or stated at the meeting
before the Planning Commission or in the hearing before the Board of County
Commissioners, shall be considered conditions of approval unless specified otherwise by the
Board.
2. The southern gate will be limited to a maximum of 27 vehicle trips per day, averaged on a bi-
monthly basis, and a violation of this limit could result in closure of the access due to a
breach of an agreement between Marlin (Colorado) Ltd., Lynne S. Cantrell, Westbank Ranch
Homeowners Association, Inc. and the Prehm Ranch Homeowners Association, Inc.
Within any 60 day period, the gate will automatically shut down if 1620 trips are exceeded.
3. The proposed common open space area to be conveyed to the Westbank Ranch
Homeowners Association will be at least 20,000 sq. ft. for conveyance as common open
space and designated as such on the plat.
4. Prior to the signing of an amended plat, the applicants apply for a zone district
amendment for the proposed common open space area to be rezoned from
Agricultural/Residential/Rural Density (A/R/RD) to Residential/Limited/Suburban Density
(R/L/SD) and designated as common open space on the plat.
