Dear Ray:
This letter will respond to your March 20, 1979, letter requesting
comments on the preliminary plat of Los Amigos Ranch Filing #1. Our
comments will address the entire 1,400 acre development since it would
be difficult to analyze impacts from the several filings.
This large development can be expected to have adverse impacts on
certain wildlife populations. It lies within an area identified as
critical deer and elk winter range. As this subdivision is developed,
resident wintering herds will be displaced to adjacent public and
private lands thereby increasing competition for a limited quantity of
forage. Los Amigos Ranch also contains possibly the only remaining
sage grouse strutting ground located between Glenwood Springs, Carbondale,
and Cottonwood Pass. Development on this strutting ground could eliminate
the sage grouse in this area.
We recommend that Garfield County work closely with the Colorado Division
of Wildlife so that Los Amigos can be designed to have a minimum impact
on resident wildlife populations. To this end, we recommend that strict
dog control measures be incorporated into county requirements.
Additionally, we recommend that adequate provisions be made for wildfire
safety. This would include adequate on site water supplies and necessary
fire breaks depending on the terrain and fuel conditions.

The Mount Sopris Soil Conservation District Board has reviewed the Los Amigos
Ranch Subdivision. This area is located near the Colorado Mountain College
campus. The soils on the edge of the area are extremely steep and unstable.
These areas should be exempt from any construction. Most of the soils above
the steep slopes have moderate to severe limitation for construction.
The soils mapped 70BC have a moderate shrink/swell potential and low strength.
Soil X2OF has severe problems and any construction on this soils would require
an on site investigation by an engineer. Attached are copies of the soil
characteristics. The soil surveys of the area can be examined at the Soil
Conservation Service Office. This area is located on soils maps 2047 and 1807.
According to the plan, a central sewer system is planned. With the amount of
construction planned in the area, a central system is an excellent idea.
Final design should make sure that the surrounding area is not damaged from
water runoff caused by the increase in asphalt and roofs.
The developed area will have adverse effect on the wildlife. This is an
important deer winter range.
The CMC road will receive an increase in traffic. Therefore, plans to increase
the carrying capacity of the road should be considered.

to review the entire PUD Plan of Los Amigos Ranch.
Due to the potential size of this development along with
other potential developments in that same area, it would
appear at the present time that the Roaring Fork School
District RE1 Board of Education may request any possible
school site from the Los Amigos developers.
I have placed Mr. Moffatt on the agenda for the board meet-
ing April 9, 1979, to make a presentation to the Board of
the development and location of possible school sites.

At your request, we herewith make this comment on
behalf of the Basalt Water Conservancy District on the above
referenced development proposal. As usual, our comment
relates only to the proposed legal water supply for the
development and certain restrictions we feel should be
placed upon the development as a whole to enhance the solution
to certain water supply problems throughout the Basalt Water
Conservancy District.
First, it appears the information pertaining to
the legal availability of water to this development is the
Wright Water Engineers Inc. report of October 5, 1978, and
the Musick, Williamson, Schwartz, Leavenworth & Cope P.C.
letter of October 6, 1978. We wish to call your attention
to the sections of the Wright report which clearly and
accurately documents the fact that the water of the Spring
Valley Aquafer is hydrologically connected to the Roaring
Fork and Colorado Rivers. The Wright report goes further to
concede, however, that if extensive development occurs of
existing senior conditional water rights on the Colorado
River, "there could be a call on 1963 and 1978 Los Amigos
water rights". The effect of such a call would be to completely
curtail water supplies for any purposes, including in-house
domestic use, within the development assuming that water
supplies are administered as the law requires.
The ultimate solution to this problem is apparently
seen by the developer as one of obtaining water supplies
from Ruedi Reservoir, Green Mountain Reservoir, or other
sources. At present, no request has been received by this
District, or the Colorado River Water Conservation District.
The local and regional marketing entities is respectively in
charge of marketing water supply for Ruedi Reservoir. More-
over, there is substantial doubt that the Bureau of Reclamation
would allow a contract in any form to be made for Green

Mountain Reservoir. This is due to a number of physical
problems with that facility, including the fact that it
probably lacks adequate capacity to meet the demands presently
placed upon it, let alone future demands such as those
contemplated by this development.
In short, allowing the development to proceed upon
the water supply as proposed may well entail substantial
risks for lot purchasers in the future. Concededly, there
is little likelihood in the very near future of these wells
being shut down because of an administrative call upon the
Colorado River System. Nonetheless, as the Wright report
clearly documents, there is a substantial possibility/
probability that such will occur in the foreseeable future.
In sum, the County in our view faces a policy
decision which relates to the wisdom of allowing development
to be approved by the County, all the while knowing that the
development is probably susceptible to being called out of
priority when senior water rights are developed and begin
diverting on the Colorado River. The solutions the County
may choose to require at this juncture, would be either to
require Court approval of a plan of auymentation which would
amply protect the lot purchasers against the eventuality of
curtailment of water supplies, or to likewise require the
developer to obtain water service from the Basalt Water
Conservancy District/Basalt Project pursuant to CRS 1973 37-
45-125.

Dear Mr. Baldwin,
None of the material concerning this development sent to this office included any
reference to the 1041 concern, wildfire hazards. Although there are some road
specifications in this filing that need improvement from a public safety standpoint,
the far greater concern is the layout for the rest of the planned development.
The enclosed booklet, Wildfire Hazards, should be used as a guideline by county
planning departments and developers to properly address wildfire hazard concerns.
Of particular concern from a wildfire standpoint is the design of the development
to provide two or more dedicated access roads for separate, multiple ingress -egress.
Loop drives with one entrance point do not satisfy this need. Road specifications
and cul-de-sacs length and location are two other important areas that are covered
in the enclosed booklet.
All of these guidelines have been developed to insure residents in forested sub-
division areas can evacuate their area,and have emergency equipment arrive at the
same time. Multiple, separate ingress -egress routes are most important in any wild-
fire hazard area.
Road minimums in this first filing fall short of the guidelines with regard to paved
width, radii of curvature, and grade. While these problems are somewhat mitigated by
the lack of wildfire hazardous vegetation in the area, I would still encourage the
developers to adhere more closely to the Guidelines for the rest of the development.

Dear Ray,
Enclosed please find 15 copies of supplemental information on
Filing No. 1 requested by you at our meeting of March 16, 1979,
for inclusion to the Preliminary Plan Submittal of Los Amigos
Ranch P.U.D. Subdivision Filing No. 1.
I'd like to take this opportunity to recap a few items dis-
cussed last Friday:
1. Vehicular Circulation Within Lot 1.
As indicated on the Plat, Lot 1 has entrance from
County Road 114. We view vehicular circulation to
the various parking areas to be via an internal
driveway - not a road open to the general public.
The driveway will be designed to handle the loads
generated by the apartment complex. At present
we are considering a 24 -foot pavement width.
Maintenance of drives and parking areas internal
to Lot 1 will be the responsibility of either the
owners and management of the apartment complex or
the overall Los Amigos P.U.D. management.
2. Potential Future Condominiumization.
As agreed last Friday, such a potential should at
least be considered at this time. Within the frame-
work of the Los Amigos P.U.D. we have considered the
possibility of future condominiumization on a build-
ing by building basis. Total division of Lot 1 into
5 or 6 parcels does not seem as manageable and at-
tractive, nor serve the purposes of C.M.C.-related
rental housing, as does the indivisible ownership

of a building along with common ownership of the
remaining site and improvements. Such a condo-
minium plat would identify a footprint land par-
cel associated with each building floating within
Lot 1, which would be commonly owned. There would
then be the usual agreements covering operation
and maintenance of land and improvements of both
individually and jointly owned elements.
3. Sewage Service and Timing.
The enclosed supplemental information will give
you a better understanding of the engineering to
date and the nature of our negotiations with C.M.C.
In order for the apartments of Filing No. 1 to be
on line as soon as possible, it is essential that
an agreement with C.M.C. for service be reached by
submission of Final Plat material. If no agree-
ment is reach, Filing No. 1 will be integrated into
Filing No. 2, which will consist basically of Phase
One Development as defined in the P.U.D. Application.

Dear Ray,
As part of the Preliminary Plan submittal, it is specified
that Street Profiles shall be submitted at the horizontal
scale of 1" = 100'.
It is requested that this requirement be waived in favor of
a horizontal scale of 1" = 200' and an appropriate exagger-
ated vertical scale. First, our topographic mapping is accu-
rate vertically to one half the contour interval, or accurate
to 2.5 feet plus or minus. Second, due to the hillside na-
ture of the terrain, roads are to be "field located" in con-
formance with the approved Preliminary Plan in order to mini-
mize environmental disruption, to avoid removing certain
trees and to minimize costs.
Therefore, Preliminary Plan Street Profiles will be unusable
Final Plat or construction documents. Construction documents
are to be prepared at the prescribed 1" = 100' horizontal
scale.
It is my belief that street gradient limitations necessary
for Preliminary Plan approval can be adequately identified
at the horizontal scale of 1" = 200'. We would appreciate
your approval of this request.

Dear Ray,
Design of onsite private drives and onsite utilitiy systems
will not be initiated and completed prior to the completion
of Phase I rough grading. Due to the uncertain nature of the
earth composition on the site, vertical location of buildings
and vertical and horizontal location of parking areas cannot
be precisely tied down. Size and frequency of basalt rock
boulders, yardage of clearing and grubbing material insepara-
bly mixed with surface boulders, shrinkage factors and the
presence and location of fine graded compactible materials
limit our ability to determine exact vertical grades of build-
ings, sewer and water. In order to minimize earthwork, respond
to field conditons and operate in a cost- and time -efficient
manner, we will be proceeding on a field -oriented design basis.
Site configurations remain consistent with Preliminary Plan
submittals except certain buildings and parking locations will
be reversed.
A preliminary cost estimate of onsite improvements is as

Dear Leonard,
After further analysis of the proposed private drive that will
provide vehicular access to County Road 114 (College Road), we
request that the following grade and alignment changes be ap-
proved.
The centerline intersection with County Road 114 shall be moved
northeasterly approximately 60 feet. The initial vertical grade
extending northwesterly from the edge of existing pavement shall
be plus 2% for a distance of one hundred feet. A vertical grade
of plus 8% shall then continue in a westerly direction for the
distance necessary to intersect with natural ground. The plus
2% section shall transition to the plus 8% section by a 100 foot
vertical curve. Vertical grades less than 8% shall continue
throughout the remainder of the site.
In order to conform as reasonably as is possible to existing topo-
graphy, a horizontal curve to the left with a centerline radius of
150 feet is proposed near the entrance. The center of said curve
shall lie on the southwesterly tangential extension of the north-
westerly right-of-way line of County Road 114. The horizontal
curve shall connect with a straight tangent section that will gen-
erally conform with the existing jeep trail alignment.

The Water Quality Control Division has no objection to this proposal as long
as the Colorado Mountain College sewage treatment facilities are upgraded,
as needed, to handle the additional load.
Please note that, in accordance with Senate Bill 35, any development serving
more than 20 people must receive site plan approval from the Water Quality
Control Commission before construction will be allowed to commence on the
sewer facilities/extensions. In addition, any construction undertaken
should strictly adhere to an approved erosion and sediment control plan
incorporating measures designed to minimize possible contamination of area
waters.
