I am writing this letter as a private landowner of a Multi -family lot (Lot One Filing One of
the Los Amigos Subdivision, legal description attached) that is required to be serviced by
Red Canyon Water District for all my potable water needs.
I have included a letter I received from Glen Ault that he received from the "Elk Springs
Homeowners Association" dated April 1 s` 2005 in reference to costs associated with water
service/EQR-Tap fees for my 48 Unit site.
After a preliminary investigation to determine current water tap fees that have recently been
assessed to other parties requiring service from Red Canyon Water District, I found that the
current published rate or price for water service is one (1) EQR cost $5,200.
I understand that you have oversized some elements of the water system to accommodate
the future needs of your ongoing Phased -Development, and also to accommodate the re-
quired needs of any current or future Multi -family and Commercial zones as stipulated and
required by Garfield County.
Currently I am at a loss, and need clarification and a detailed breakdown of costs, along with
past, present and future water service fees, and over sizing costs that have been or will be
paid by current or anticipated (projected) future users.
I am also requesting a specific and detailed description used in your determination of alloca-
tions, and basis for cost recovery in all water service fee charges for the subdivision
(including any future development phasing having water requirements) that may change or
have some financial impact to the values of my service fees, so that we have a clear under-
standing of how you have, or will, determine the water service fees (fees as stated in the letter
referenced above) for my building site.
I am currently reviewing my future EQR needs, and request to have a thorough and precise un-
derstanding of this component from all the governing bodies as I begin a preliminary investiga-
tion of the costs associated with my future water service requirements.
After a review of the Garfield County RESOLUTION NO. 96-34 (copy enclosed) I have deter-
mined that Los Amigos Ranch was required to transfer ownership of the Water Distribution
System to the Los Amigos Homeowners Association and did so on December 31, 1997, which
is currently operating under the name of Elk Springs Homeowners Association, a Colorado
non-profit Corp.
Additionally after reviewing CONDITIONS OF APPROVAL (see) paragraphs 6. & 7. under
the heading WATER SUPPLY I found the basis to be used for determining fees (cost recovery
of construction and installation of the Water Distribution System) that are governed and regu-
lated by Garfield County.
I have tried to contact your office by telephone and have left a message to speak with someone
about the above mentioned. I have waited patiently in hopes of a return phone call from the
Homeowners Association and have received no response as of today.
Please contact me by telephone or mail to give me an approximate date that I can anticipate
you providing us with the above requested documentation for review.
