D. 19.d!4....... , there were present: 4.rr..Y' V.0,4. 9.u.0 , Commissioner Chairman J'1,' VQ11 Jr CU --L .c' , Commissioner EV.Ig rlc' 11,11n " Dr;1,1"llckl91?. ? , Commissioner E4rjr...Rt}QdP,$ ,County Attorney ...... t'LLgl.C.t',d..: 1.$d.S2.c n , Clerk of the Board when the "following proceedings, among others were had and done, to -wit: held at the Court House in Glenwood Springs on RESOLUTION NO. 84- 123 RESOLUTION CONCERNED WITH THE APPROVAL OF A FINAL PLAT FOR THE LOS AMIGOS RANCH, SUBDIVISION 2, FILING ONE WHEREAS, the Los Amigos Ranch Partnership has filed an application for approval of a final plat for the property described hereinafter and known as Los Amigos Ranch, Subdivision No. 2, Filing 1; and WHEREAS, the Garfield County Board of County Commissioners has previously approved the preliminary plan for Subdivision 2, Filing 1, Los Amigos Ranch PUD in Resolution No. 82-182, and pro- perly granted an extension of time to the applicant to file this final plat; and WHEREAS, the conditions of Resolution No. 82-182 pertaining to this final plat for Filing 1 have been met satisfactorily by Los Amigos Ranch Partnership, and the applicant has otherwise complied in full with the requirements of Section 5 of the Garfield County Subdivision Regulations, adopted April 23 1984, Colorado Revised Statutes at Section 38-51-102, supplemental docu- mentation and the plat is consistent with the Los Amigos Ranch PUD; and WHEREAS, based on the application, evidence, exhibits, testi mony and the recommendations of the Garfield County Planning Department, the Board of County Commissioners finds as follows: 1. That proper public notice was provided, as required by these Regulations for the hearing before the Board on this date. 2. The platted subdivision is in compliance with the comprehensive plan of Garfield County and Garfield County Zoning and Subdivision Resolutions and Regulations. 3. The final plat and previously approved preliminary plan meet all sound planning and engineering requirements of Garfield County. 4. That the Los Amigos Ranch Partnership has executed a full and complete Subdivision Improvements Agreement, filed with the County, a Consent to Vacate this plat, as required therein, and provided for a future dedication of a school site with provi- sions for water and sewer lines to said site for an elementary school. Said Agreement also provides for access to said school site and provides for tap fees for said elementary school at the time of issuance of the school's building permit. Booz 652 IAGE677 5 The final plat, .and :the plat note&, reflected thereon, are'. in ,the 'best interests . of the health, safety, convenience and wei-fare' of 'the citizens of 'Garfield County and approval thereof has 'been recommended by the Garfield County'Planning Department, pursuant to the .Garfield County Subdivision Regulations. 6.. The total Los Amigos Ranch PUD committment for road improvementfunds for County Roads, and particularly County Road 114, in the amount of $32,700.00, shall be paid at the time of final: plat approval for Filing 3 i Subdivision 2 of the Los Amigos Ranch YUD, in such form as requested by the Board of County Commissioners of Garfield County. NOW, THEREFORE, BE IT RESOLVED that the records and recom- mendations of the Garfield County Planning Commission_, Garfield County Planning Department and this Board are hereby adopted, and the final plat of Subdivision 2, Filing 1 of the Los Amigos Ranch PUD is hereby approved for the area described on Exhibit "A" hereto. Upon motion duly made and seconded, the foregoing Resolution was adopted by the following vote: Larry Velasquez , Aye Flaven J. Cerise , Aye ►-Aye Commissioners.
