HomeMy WebLinkAbout4.0 Resolution 82-182• STATE OF COLORADO County of Garfield Ata regular meeting of the Board of County Commissioners for Garfield County, Colorado, held at the Court House in Glenwood Springs on Monday , the 2 6 t day of July A. D. 19 8 2 , there were present: Flaven Cerise , Commissioner Chairman Eugene Drinkhouse , Commissioner Larry Velasquez , Commissioner Earl Rhodes , County Attorney Leanne Cleland, Deputy , Clerk of the Board when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 82-182 RESOLUTION CONCERNED WITH THE APPROVAL OF A PRELIMINARY PLAN FOR THE LOS AMIGOS RANCH SUBDIVISION. WHEREAS, the Los Amigos Ranch partnership has filed an application with the Board of County Commissioners of Garfield County, Colorado, for the approval of a preliminary plan for the herein described property in the unincorporated area of Garfield County; and WHEREAS, a public hearing was held by the Garfield County Planning Commission on the 26th day of April, 1982; and WHEREAS, based on the evidence, testimony, exhibits, study of the Comprehensive Plan for the unincorporated area of the County, recommendation of the Garfield County Planning Commission, comments of the Garfield County Planning Department, comments of public officials and agencies, and comments from all interested parties, this Board finds as follows: 1. That proper Publication and public notice was provided as required by law for the hearing before the Planning Commission. 2. That the hearing before the Planning Commission was extensive and complete, that all pertinent facts, matters and issues were suumitted and that all interested parties were heard at that hearing. 3. That the proposed subdivision of land is in compliance with the recommendations set forth in the comprehensive plan for the unincorporated area of the county. 4. That all data, surveys, analyses, studies, plans, and designs as are required by the State of Colorado and Garfield County have been submitted, reviewed, and found to meet all sound planning and engineering requirements of the Garfield County Subdivision Regulations, provided that certain conditions are complied with. 5. That the proposed subdivision of land conforms to the Garfield County Zoning Resolutions, provided that certain conditions are complied with. 6. That for the above -stated and other reasons, the proposed subdivision is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. NOW, THEREFORE, BE IT RESOLVED) that the record and recommendation of the Garfield County Planning Commission be adopted and that the preliminary plat of the Los Amigos Ranch Subdivision for the following described unincorporated area of Garfield County be approved: Please See Attached "Exhibit A" BE IT FURTHER RESOLVED that the following conditions shall be placed upon the approval: 1) That prior to final plat approval of filing #3, Subdivision #2,the applicant shall obtain approval for a plan for water augmentation from the district water court and the state division of water resources; 2) That prior to final plat approval of filing #1, Subdivision #2, the applicant shall exchange deeds with the Murr family to settle the boundary dispute, so that the Murr boundary line is along the present fence line; 3) That prior to final plat approval of each filing, Subdivision #2, the applicant show a building envelope on each lot and suitable motor vehicle access to the building site; 4) That prior to final plat approval of each filing, Subdivision #2, the applicant show a plat note that engineered sewage disposal systems may be necessary on all lots located outside the boundaries of the sanitation district; 5) That prior to final plat approval of filing #1, Subdivision #2, the applicant make provision for a homeowners' association which will monitor and maintain the individual sewage disposal systems; 6) That prior to final plat approval of filing #1, Subdivision #2, the applicant shall perform a thirty(30) day study in accordance with acceptable engineering standards of the capacity of the sewer system of the Spring Valley Sanitation District, which study shall occur in the fall of 1982, and provide an engineering report to the satisfaction of the Board as to the present capacityof the system; 7) That prior to final plat approval of filing #1, Subdivision #2, the applicant shall enter into a subdivision improvements agreement which shall provide, among other things, that the applicant shall provide or pay for an expansion of the district's sewer capacity, which expansion shall be determined by the difference between the actual, as built capacity of the system, as determined by the fall, 1982 engineering report, and that capacity necessary to add an additional 48 units, and 30 units to be served by the district in this pieliminary plan; 8) That prior to final plat approval of filing #1, Subdivision #2, the applicant and the Board shall make provision for the identification and dedication of a school site within the area of the Los Ami3os Ranch Planned Unit Development; 9) That prior to final plat approval of filing #1, Subdivision #2,the applicant, shall enter into a subdivision improvements agreement which shall provide, among other things, that the applicant at its expense, shall provide that the water and sewer lines to the school district property lines will be sized appropriately to accommodate an elementary school, and the applicant will pay for or provide any tap fees necessary to hook up the school to the sanitation district, at the time the building permit is issued for the elementary school; 10) That prior to final plat approval of filing #3, Subdivision #2, the applicant will pay the sum of $32,700.00 in lieu of construction improvements on County Road 114.
