MILDRED ALS JRF, RECORDER ° GARFIELD COUNTY, COLORADO 1.4 3 CONSENT TO VACATE FINAL PLAT FOR LOS AMIGOS SUBDIVISION NO. 2, FILING 1 Approved March 5, 1980 and recorded said date as Reception No. 302115, Clerk and Recorder's Office, Garfield County, Colorado. WHEREAS, a final plat of the Los Amigos Ranch PUD, for Subdivision 2, Filing 1, was approved and recorded on March 5, 1980; and WHEREAS, Los Amigos Ranch Partnership was the owner of said property on March 5, 1980, and is still the owner of said lands; and WHEREAS, the Los Amigos Ranch PUD was amended on December 1, 1981, by Resolution No. 81-358 of the Garfield County Board of County Commissioners and the Los Amigos Ranch Partnership now desires to vacate said final plat recorded as Reception No. 302115, Clerk and Recorder's Office of Garfield County, Colorado, save and except that portion of the property covered by Resolution No. 83-165; and WHEREAS, the Board of County Commissioners of the County of Garfield have consented to said vacation and that the same shall be deemed effective for assessment purposes as of January 1, 1982, NOW, THEREFORE: 1. Los Amigos Ranch Partnership hereby consents to the vacation of Subdivision 2, Filing 1, of the Los Amigos Ranch PUD recorded March 5, 1980, as Reception No. 302115, Clerk and Recorder's Office, Garfield County, Colorado, subject to and except for that portion of the property in Subdivision 2, Filing 1, which is covered by Resolution No. 83-165 of the Board of County Commissioners of the County of Garfield, State of Colorado. • 2. The undersigned, being the General and Managing Partner of the Los Amigos Ranch Partnership, with full authority to represent said Partnership; and in consideration of the Board of County Commissioners of Garfield County, Colorado, granting a revised PUD plan in Resolution No. 81-358 of said Board, further hereby revokes the final plat of Subdivision No. 2, Filing 1, of the Los Amigos Ranch PUD, filed March 5, 1980, and recorded as Reception No. 302115 in Garfield County, Clerk and Recorder's 41 • • r. 651 PACE 7.1 Office, Colorado, and henceforth considers such plat a nullity save and except for that portion of the property covered by Resolution No. 83-165 of said Board, and that said plat is hereby vacated and that Master Declarations, Covenants and Restrictions recorded with said plat on March 5, 1980, as Reception No. 302114, Book 544, pages 733 through 763, Garfield County Clerk and Recorder's office, Colorado, are also hereby vacated, and that said vacation is done hereby with the express understanding that Los Amigos Ranch Partnership shall hereafter have no rights thereunder. 3. That it is the intention of the Los Amigos Ranch Partnership that this action, consent and waiver shall be recorded in places deemed appropriate by the Board of County Commissioners of Garfield County, Colorado, in the real property records of that County in order to provide notice of the matters stated herein, and authorization for said Board of County Commissioners to take such action or actions as shall be necessary in the premises to carry out the intentions hereof is hereby granted.
