Water Division 5, Water District 38 Dear Mr. Bean: We have reviewed the subject preliminary plan, which proposes to create a total of 178 single-family dwellings on 751.87 acres located in filings 5A through 11. The proposed water supply is to be provided through a central system operated by the Red Canyon Water Company (Company). A letter of commitment from the Company, dated February 9, 1996, was included in the submittal material. A letter from Mr. Loyal E. Leavenworth, dated November 24, 1997, indicated that to date final plat approvals within the Los Amigos Ranch PUD totals 47 single family lots and 96 multi- family units. This proposal results in a total of 321 units. At full buildout, the PUD is projected to include a total of 327 single-family homes and 96 apartments. Total annual water demand at buildout will be 194 acre-feet, and consumptive use will be approximately 68 acre-feet. The 68 acre-feet of clepietions are to be augmented pursuant to a plan for augntentation, wltich was approved by the Division 5 Water Court in case no. 87CW155. The PUD is currently supplied by two wells, known as the Rancho Los Amigos Well No. 6 (permit no. 40906-F) and the Los Amigos Ranch Well No. 5 (permit no. 18147). Well No. 6 is decreed in Division 5 Water Court case nos. W-3873, W-3893, and 94CW36 for 300 gallons per minute for municipal use. Well No. 5 is decreed in case no. W-2156 for 300 gallons per minute for municipal, commercial, domestic and industrial uses. The water rights used to supply this PUD are owned by the Los Amigos Ranch Partnership, are leased to the Company for a period of 50 years with a 4}-year renewal option. A report dated November 17, 1997, prepared by Schmueser Gordon Meyer, lnc., indicated that Well No. 5 had been test pumped at '1 10 gallons per minute, and Well No. 6 had been test pumped at 400 gallons per minute. The combined yield of the two wells exceeds the estimated required peak day pumping rate at buildout of 335 gallons per minute. D. The large planned development occupies a large portion of the valley bluff and plateau above Highway 82, west of the Colorado Mountain College Road. Earlier filings are currently being developed. A site inspection was attempted on December 17, 1997 and again on January 7, 1998 but locked gates and obscuring snow cover prevented a thorough inspection. This review is based primarily on the submitted materials and recent mapping done by this office. This offrce has reviewed the Preliminary Geologic Hazards Investigation by Lincoln DeVore dated February 5, 1982, a preliminary Geotechnical Study by H-P Geotech dated February 14, 1997. anda Geologic Hazards Consultation and Radiation Survey letters from CTL Thompson, Inc. dated November 21, 1997. The CGS generally agrees with the content of the reports and concurs that, provided careful and appropriate site specific engineering is done, the development can proceed as intended. There are specific hazards at this site where particular attention should be given. The recommendations of the consultants must be adhered to for the small landslide noted, the location of the faults on the southwest boundary of the plateau, the collapse potential of the thicker accumulations of fine colluvial soils noted, and the requirement of a rockfall analysis to site structures at the lower rural residential areas. ISDS design must also be completed on a srte specific basis. '[he soils are variable anci the basalt substrate highly fractured so engineered, non-conventional, systems may be warranted for many lots. It may be preferable to connect the entire development to a central wastewater treatment facility with the exception ofthe rural lots. We understand the review would include groundwater, water supply, wastewater, drainage, and soils/geologic hazards. We understand the review must be completed in the next few weeks for a January public hearing. WWE does not believe we have any potential conflicts of interest with this assignment. WWE performed water rights/water resources work for the proposed Spring Valley Ranch project. We have also done wetland work for Dr. Berkeley (Rivendell Sod Farm) and miscellaneous assignments for Colorado Mountain College (CMC). WrighrMclaughlin prepared the Service Plan for formation of the Spring Valley Sanitation District (CMC and Los Amigos Ranch) in 1979 and for the Landis SanitationDistrict (Lake Springs Ranch and Spring Valley Ranch) in 1983. WWE has not served as District Engineer for either District. (PUD) Sketch Plan, I offer thefollowing statements for your scheduled March 13, 1-996 public meeting. The southern edge of Lhe 2206 acre Lract is adjacent to public l-ands administeredby this office. A vast portion of the adjacent BLM parcel has evolved over the past 20 years into an intensive Off Highway Vehicle use area with numerous trails and roadstraversinS it. With proposed housing slated to be built directly adjacent to BLM (80 single family units over 60 acres), there is an obvious need toconsider more closely the future management of the BLM parcel. The proposedsubdivision is expected to increase dispersed recreation on the adjacentpublic 1and. Increased OHV use and related impacts could 1ikeIy occur. Theproposed network of streets within the high density single family homesincludes a road that is directly adjacent to BLM with no evident buffer oflots or open space between the PUD and publj-c land. I am concerned that this proposed road l-ocation will merel-y provide an uncontrolled public access pointto BLM when restrictions to vehicle access would seem to be the 1ike1y answer.f think it is vitally important that this parcel continue to be managed as open space, perhaps with some limitations placed on certain uses. Someobvious controls to consider would be a closure or limitation on vehicles andhunting. The increase in people and their likelihood to use the adjacentpublic land appears to warrant the need for these restrictions. If this PUD amendment is approved, we would be willing to work with theproponent to develop and identify a solution to mitigate potential recreation and OHV use problems on the neighboring BLM 1and. I envision a strategy thatcould involve cooperative management by the BLM and developer (perhaps throughthe Homeowners Association) to resolve these 1ike1y use conflicts. Another important. consideration for managing the BLM as open space is toprovide a big giame movement corridor through the public lands between theRoaring Fork River and the upland mesa. The need for this t.ravel corridorwould seem evident given the development that has and will occur on the nearbyprivate 1ands. After review of our records, it should be noLed that there are various parcelswithin the PUD that have mineral-s reserved Lo t.he United States. Thedeveloper and the County should be aware that in t.he future, mining cl-aimscould be located and mineral leases or permits could be issued. AIso, use ofbuilding stone, moss rock, gravel, or any other mineral- material from landswith federal mineral ownership would require a permit from the BLM. Accordingto our records, no minerals within the PUD are currently under l-ease.Furthermore, the potential- for economic development. of the leasable andlocatable minerals in the vici-nity, wiLhin the foreseeabl_e future, isconsidered to be Iow. Any roads or util-ities such as water, electric, phone or otherwise crossing BLM would require right-of-way (ROW) permits from this office. As we discussed in our telephone conversation last Friday, I was somewhat surprised to read the conclusions reached in your letter to Garfield County Planner Mark Bean concerning the District's sewage treatment capacity. The purpose of this letter is to suggest an approach which should alleviate any concerns you may have regarding the ability of the District to service lots contained in Los Amigos Ranch Subdivision Filings 5A-11. As you know, the District has recognized the need for plant expansion for quite some time and has received site application approval to expand existing facilities. At the present time, the District is diligently proceeding with its plans to expand existing wastewater treatment facilities. Los Amigos Ranch Partnership has submitted its land use proposal to the Garfield County Planning Commission for preliminary plan approval, and the preliminary plan contemplate,J use of the District's central sewer service, but only for a very rninor portion of the submittal. As an alternative to the Water Quality Control Division's position that the preliminary plan should be denied because the District does not possess sufficient capaciry to service new filings in the Los Amigos Ranch Subdivision, we would recommend imposition of a District plant expansion condition as part of Garfield County's preliminary plan approval. The District believes that, given the fact that only preliminarv plat approval is requested, it would be more appropriate to ask the County to impose a condition on any preliminary plat approval requiring a demonstration before final plat approval of any filing requiring central sewer service from the District that the District can provide additional plant capacity for that filing. Such a condition would ensure that actual demand does not exceed plant capacity until and unless an expansion has occurred or is sufficiently certain to permit final plat approval.
