As you know, Los Amigos has previously filed its Preliminary Plan Application for Filings 5,{-1 l. That Application was originally scheduled for a public hearing before the Garfield County Planning and Zoning Commission on January 14,1998, but as a result of our letter request of that date, the public hearing was continued until February 11, 1998. Los Amigos has now decided and does hereby withdraw the pending Preliminary Plan Application for Filings 5A- 1 1. It is our understanding that this will make it unnecess ary to appear before the Planning and Zoning Commission at their February 11 meeting date. The reason for this withdrawal is that Los Amigos has determined to reconfigure its Preliminary Plan and submit a new Preliminary Plan Application. We are therefore delivering with this letter twenty copies of a Preliminary Plan Application for Los Amigos Ranch Filings 6- 10. Also being delivered is a check to the Colorado Geologic Survey in the amount of $595.00 and a check to Garfield County in the amount of $675.00 which we understand to be the applicable Application fees. The primary difference between the within Application and the withdrawn Application is that the new Preliminary Plan submittal does not propose to subdivide any lots within the Spring Valley Sanitation District. Thus, there are no lots proposed to receive central sewer service from Re: L:'I[it,,l l-y Mark Bean January 21,1998 Page 2 the Spring Valley Sanitation District. Although this modification does not involve a large number of lots, we believe it is a significant change from the previous Application and requires the submittal of entirely new Application as we have done. We look forward to processing this Application in accordance with applicable Garfield County regulations. As always, please contact me if you have any questions. Very truly yours, DELANEY & BALCOMB, P.C. LRG:bc xc: Greg Boecker
