Commissioner Don DeFord , County Attomey Mildred Alsdorf , Clerk of the Board Ed Green , County Administrator when the following proceedings, among others were had and done, to-wit: RESOLUTION NO. 99_102 A RESOLUTION CONCERNED WITH TI{E AMENDMENT OF THE APPROVAL OF A PRELiMINARY PLAN FOR T}IE LOS AMIGOS RANCH, FILINGS 6-10 SUBDTVISION, CONTAINED IN RESOLUTION NO. 98-30. WFIEREAS, Los Amigos Ranch Partnership filed an application with the Board of County Commissioners of Garfield County to amend the approval of the Preliminary Plan for the Los Arnigos Ranch Filings 6-10 Subdivision contained in Resolution No. 98-30; and WHEREAS, the Garfield County Planning Commission reviewed the amended Los Amigos Ranch Filings 6-10 Preliminary Plan application and recommended conditional approval to the Board of County Commissioners; and WFIEREAS, based on the material submitted by the applicant, the recommendation of the Planning Commission and the comments of the Garfield County Planning Department, this Board finds as follows: That proper publication, public notice and posting was provided as required by law for the hearings before the Planning Commission and Board of County Commissioners. That the Garfield County Planning Commission recommended conditional approval of the Preliminary Plan. 4. Subject to the conditions set herein, the proposed subdivision of land is in compliance with the recommendations set forth in the Comprehensive PIan for the urincorporated area of the County. All data, surveys, analyzes, studies, plans and designs as required by the State of Colorado and Garfield County have been submitted, reviewed, and found to meet all sound planning and engineering requirements of the Garfield County Subdivision Regulations. Subject to the conditions set forth herein, the proposed subdivision of land conforms to the Garfi eld County Zonrng Resolution. For the reasons set forth herein, the proposed subdivision is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfreld County. NOW, THEREFORE, BE IT RESOLVED that the Preliminary Plan of Los Amigos Ranch Filings 6-10 Subdivision for the following described unincorporated area of Garfield County be approved with the following conditions: / All representations of the applicant, either within the application or stated at the public / hearings before the Planning Commission and the Board of Courty Commissioners shall be considered conditions of approval, unless stated othenvise by the Planning Commission and \ the Board of County Commissioners. iA 2. Prior to submittal of a Final Plat, all property shall be annexed into the Carbondale and Rural\\--- Fire Protection District that is not presently in the District. ,/ All conditions of approval contained in Resolution No. 98-30, shall be considered conditions ,/ of approval, except for the removal of conditions #5 and #6 and the modification of Condition #13 to read as follows: The Rural Residential lots shall be allowed to utilize individual sewage disposal systems.
