This letter of credit was issued by Alpine Bank under the reference number 0250401133. The Pinyon Mesa Filing 1 Subdivision Improvement Agreement is recorded under reception number 734760. 2. On October l,2OO9 County Vegetation Manager Steve Anthony visited the site, approved the re-vegetation efforts, and recommended the rclease of the security. 3. On October 20,2009, Mr. Brett Benzel of Pinyon Mesa Development LLC requested the release of the letter of credit. Acknowledsement NOW THEREFORE, the BOCC hereby: 1. Aclcnowledges full satisfaction of the security requirements; and 2. Acknowledges that this letter of credit is no longer required by the BOCC and is hereby retumed to the issuing bank for cancellation. WHEREAS, the BOCC approved the Preliminary Plan Application for Pinyon Mesa Subdivision submitted to the BOCC by the Owner by means of Resolution No. 2006- ("Resolution"); and WHEREAS, the Garfield County Planning and Building Department has approved Grading Permit No. with respect to the property described in the Resolution ltte *Crading Permit"), which is attached hereto as Exhibit A; and VIHEREAS, the Grading Permit requires provision of sufficient financial assurance of weed and erosion control and other matters as reflected in the Grading Permit, and Owner wishes to deposit good funds for such security; and WHEREAS, the BOCC has approved Owner's County Trbasurer's Deposit Agreement in 1i Credit as such financial assurancei and use of a Garf ie.l-d eu of a Letter of service fee C.R.S., as i.e., Eour WHEREAS, the Treasurer is willing and able to hold suchfunds in accordance wit,h the Treasurer's statutory duties outlined in Sections 30-10-701, et seq. and 30-1-102, C.R.S., as amended. NOW THEREEORE, the part.ies agree as follows I. Owner' s Treasu.rer' s Account.Owner shaLl deposit with the Treasurer the sum of Forty-Three Thousand Five Hundred Sixty Dollars ($43r 560) to secure construction requirements of the Grading Permit relating to the proposed Pinyon Mesa Subdivision. fn consideration of the service fee payable to the Treasurer, identified in Paragraph II., below, the Treasu.rer sha1l place the funds in an int.erest bearing account and disburse funds therefromin accordance with the terms of this Deposit Agreement. Such account shall be known as the "Pinyon Mesa Grading Permit Treasurer's Account" and shall be subject to the terms and conditions of this Deposit Agreement. II. Treasurer's Service Eee. The Treasurer's shall be, in accordance with Section 30-1-102 (1) (c) , amended, one percent (1.0E) of the deposited funds, 1 1-A Hundred Thirty-Five DolLars and sixty cents ($435.60). Theservice fee covers administrative costs incurred by the Treasurerin distributing and accounting for the Booms Place SubdivisionTreasurer's Account. Such fee shall be paid by Owner: A.in cash or by check made payable tothe Garfield county Treasurer, as noted in the "Receipt" sectionof this Deposit Agreement (page 6), on or before the date ofexecution of this Deposit Agreement. BOCC's Acknowledgment and Direction.
