Hi Chris: Thanks for meeting regarding your plans for an ADU on your Lot #5 at the
Roaring Fork Preserve. After additional research and staff meetings the following
determination has been made regarding your proposed ADU.
- Pursuant to Plat Note # 10, on the Roaring Fork Preserve Final Plat, recorded at
Reception No. 603992 with the County Clerk and Recorded, "Accessory dwelling
units ("ADUs") shall be permitted on Lots 5, 6, 7, and 8 only. Each ADU shall
comply with the standards applicable to ADUs set forth in Garfield County Zoning
Resolution of 1978, as amended".
- The Garfield County Zoning Resolution of 1978 included in the A/R/RD zone
district, (the previous zoning for the Roaring Fork Preserve property), as a Use by
Right, "Accessory Dwelling unit approved as part of a public hearing or meeting
on a subdivision or subdivision exemption or guest house special use approved
after 7/95 and meeting the standards in Section 5.03.02".
The Roaring Fork Preserve was approved after 7/95 and was approved including
per Plat Note #10 allowances for ADU's on 4 specific Tots. Based on the existing
approvals and plat note you can proceed with submitting a building permit
application for an ADU on your property without further Land Use Permitting.
- The proposal however will need to meet the ADU standards in the Garfield
County Zoning Resolution of 1978, as amended, Section 5.03.02. A copy of
those provisions is attached. Please note size limitation on the ADU as it is
smaller than the current code provision.
Please include a copy of this email when you submit your building permit application to
facilitate the Building Department review of your request. In additional your building
permit application will need to document compliance with the ADU standards from
Section 5.03.02. Thanks again for meeting with us and for your efforts to comply with
the relevant provisions of the County Codes and the Roaring Fork Preserve subdivision
approvals.

(D) The manufactured home has brick, wood or cosmetically equivalent exterior
and has a pitched roof with no metal materials not pre -painted with a
non -reflective color and permanently affixed to the metal by a manufacturer;
5.03.02 ]tow House: A subdivision plat must be approved whereon the minimum lot area for a row
house lot is one thousand four hundred (1,400) square feet, a minimum of six (6) row house
lots appear on the plat and the plat includes sufficient land area in lots and common area to
satisfy floor area ratio requirements under the appropriate Zone District Regulation.
5.03.021 Accessory Dwelling Unit: Use of a structure as an accessory dwelling whether approved
by Special Use, use by right in a new subdivision approval, or on an existing lot must meet
the following standards, as well as all other standards applicable to residential use:
(1) The minimum lot size shall be four (4) acres containing a building site with slopes

(3) Approval from the subdivision homeowners association and/or allowed by covenant if

Proof of a legal ability to connect to an approved central sewage treatment facility.
(6) Only leasehold interests in the dwelling units are allowed.
(7) That all construction complies with the appropriate County building code

Group Residential f=acility for Children & Youth: Before approval is granted for any group
residential facility for children and youth, the Applicant shall provide proof of any required
local, state, and/or federal licenses, as applicable to the services provided and population
served by the facility. (Add 2004-62)
Guest House: Use of a structure as a guest house must meet the following
Conditions as well as all other standards applicable to residential use:
(1) The gross floor area or the area used for residential occupancy shall not exceed one
thousand (1,000) square feet;
(2) The minimum lot size shall be fifty percent (50%) larger than the minimum required
for a residential use in the same zone district; and
(3) The length of stay of a guest shall be limited to thirty (30) days, unless said guests are
the grandparents, parents, siblings or children ofthe occupants ofthe primary structure. (A.

Shooting Range Facility: A shooting range facility shall meet the following standards as
well as all other standards applicable to a Special Use: (A. 98-108)
(1) All outdoor shooting ranges shall be designed by a NRA Range Technical Team, in

The Roaring Fork Preserve Architectural Review Committee (ARC) approves the combination non-residential
outbuilding and ADU, as identified on the attached signed ARC Application submitted by the homeowner. This
approval is based upon meeting the criteria outlined in the Roaring Fork Preserve CC&R's, with regard to
conformity of selected building materials, continuity with existing structures, and natural (landscape)
surroundings.
This approval letter does not expressly imply any written warranty with regard to architectural design,
structural integrity, and conformity to building codes, environmental impact or clean water assessment. These
items are the sole responsibility of the owner and the Authority Having Jurisdiction (AHJ). Any expenses with
regard to compliance or corrective action will be the responsibility of the homeowner.
This approval is subject to the following condition(s):
1) This approval is valid for six (6) months from the date of this letter. If construction does not begin
within this time period, the property owner will need to resubmit plans for final approval. Also, if any
changes are made to the design, materials, layout or any other feature as included in the Roaring Fork
Preserve CC&R's and Building Guidelines, the property owner will need to resubmit those changes to
the ARC for final approval, prior to the start of construction.

1) This well shall be used in such a way as to cause no material injury to existing water rights, The issuance of this permit does not ensure that
no injury will occur to another vested water right or preclude another owner of a vested water right from seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval of a variance has
been granted by the State Board of Examiners of Water Well Construction and Pump Installation Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37-90-137(2) on the condition that this well is operated as an alternate point of diversion to the Basalt Conduit (if
applicable per decree) and in accordance with one or more of the augmentation plans approved by the Div. 5 Water Court for the Basalt Water
Conservancy District in Case Nos. 87CW0155, 93CW0319, 98CW0026/98CW0089, 01CW0305, & 02CW0077 (and Case No. 10CW0047 if in
Area A-3 as described in decree), or operating pursuant to an approved substitute water supply plan If this well is not operated in accordance
with the terms of said decree(s) or SWSP, it will be subject to administration including orders to cease diverting water. BWCD contract #367
4) Approved for the installation of a pump in, and the use of, an existing well, constructed on December 7, 2001, to a depth of 102 feet, under
permit no. 55889-F (expired) and later permitted for use under permit no. 64455-F (expired) .
5) The use of ground water from this well is limited to ordinary household purposes inside one (1) single family dwelling, one (1) accessory
dwelling unit, the irrigation of not more than 7,500 square feet of gardens and lawns, and the watering of two head of livestock. All use of this
well will be curtailed unless the water allotment contract or a plan for augmentation is in effect. This well is known as Roaring Fork Preserve
Well no. 5.
6) The pumping rate of this well shall not exceed 15 GPM.
7) The annual withdrawal of ground water from this well shall not exceed 1 23 acre-foot.
8) The return flow from the use of this well must be through either a central treatment system, a septic tank and leach field system, or an
evaporative system, whichever does not exceed the amount specified in the Basalt contract.
9) The owner shall mark the well in a conspicuous place with well permit number(s), name of the aquifer, and court case number(s) as
appropriate. The owner shall take necessary means and precautions to preserve these markings.
10) This well shall be located not more than 200 feet from the location specified on this permit.
11) A totalizing flow meter must be installed on this well and maintained in good working order. Permanent records of all diversions must be
maintained by the well owner (recorded at least annually) and submitted to the Division Engineer upon request.
