Dear Mr. Horch,
Garfield County had reviewed the above referenced application for technical
completeness and provided a letter dated January 23, 2017, regarding deficiencies
pursuant to the submittal requirements of the 2013 Land Use and Development Code,
amended (LUDC). The letter also referenced Section 4-101 B.(2.)(a.) which requires that
the applicant correct the application deficiencies within 60 calendar days or the
application shall be considered to be withdrawn. The deadline for technical completeness
was March 23, 2017
Based on discussions with you, it was understood that the additional information was
immediately forthcoming. Email contact has been attempted with you on March 23, 2017,
May 15, 2017, and May 23, 2017. Correspondence dated May 23, 2017 informed you
that the application will be withdrawn on June 1, 2017 unless either 1) the additional
information was submitted, or 2) a request for extension in writing was provided and
approved that requested a new deadline. As of the writing of this letter, neither additional
information nor an extension has been requested. As a result, the County has deemed
your application withdrawn.
Please feel free to contact me with questions.
Sincerely,
David Pesnichak, AICP

Subject: RE: Horch ADU Application - Expiration
Hi John,
As the official expiration to supply additional information to make the application you submitted for an ADU complete
was two months ago today (March 23), it is necessary for me to start the process of withdrawing your application from
our files. As I sent you an email on May 15 and have not heard back, I will provide you until June 1, 2017 to either 1)
provide the additional information to make your application complete, or 2) request an extension in writing with a new
deadline (subject to review and approval).
If I do not hear back from you by June 1, your application will be withdrawn. Please consider this your final notice. No
refund will be issued. In order to pursue the request after June 1, you will be required to submit a new application.
Thanks,
Dave

Subject: Horch ADU Application - Expiration
Hello John.
As you know, your application for an ADU on your property has been reassigned to me following Kathy Eastley's
departure.
While reviewing deadlines this morning, it appears that the deadline for submittal of the requested additional
information is today, Thursday March, 23 (please see the attached letter from Kathy Eastley sent on January 23).
Should you need additional time to compile the requested information, please let me know. While an extension may be
requested, it is necessary that the new requested deadline date be approved by the Planning Manager. Such a request
for extension must be made in writing (an email is acceptable) and must request a new deadline date.
Thanks,
Dave
