The property had previously been before Garfield County in a prelininary plan review process in 1993. At the tine the County requested that the Applicant nake another effort at entering into an a.greenent with the Ranch at Roaring Fork for wastewater treatnent. For that reason the prelininary plan was withdrawn and negotiations continued wit,h the Banch at Roaring Fork. Included with this subnittal is a "Menorandun of Understanding" between the Ralch at Boaring Fork Homeowners' Association, Inc. and the St. Finnbar Land Company. The menorandun identifies the key elenents of an agreenent that would provide wastewater service to St. Finnbar for 14 single family hones. A definitive agreement is anticipated by April 1, 1996 per the memorandun. Such definitive agreement would be subject to the vote of approval by the general membership of the Ranch at Roaring Fork Honeowners' Association. The Applicant is confident of the Ranch at Roaring Forks comnitment to achieving an agreenent and is therefore proceeding with the new sketch plan subnittal. Existing Site Conditions The Sketch PIan includes detailed topographic mapping, 100 year floodplain and floodway, wetlands mapping and vegetation massing. The site is bounded by the Roaring Fork River on the south, Preshana Farn equestrian center on the north, County Road 100 on the east and the open spa.ce &reas of the Ra^nch at Roaring Fork on the west. The site is approximately 85 &cres in size and is Zoned Agriculture/ Besidential/Bural Density. BIue Creek runs along the northerly edge of the property then splits and one branch angles to the south west before turning west. Both branches of Blue Creek exit the site through the west property line. Approximately 32 acres of the site have been historically irrigated for hay or pasture. The PO. Box 517. The east central area of the site displays a number of nature Ponderosa Pine trees. Nativer Narrowleaf Cottonwoods are the predominant tree species on the site alonS with typical riparian vegetation in the lower areas of the site. I{etland areas have been napped and verified by the Corps of Engineers in the past but the verification periods have expired. In the spring of 1995 & new wetlands verification process was initiated. Previously issued pernits for driveway crossings of wetlands wilI also be renewed during this process. The wetlands were again mapped including all wetlands bounding the development area. The Corps of Engineers will conduct the field verification of the napped wetlands in the spring of 1996. Thg. unverifiert mapping as identified by Acquatic and Wetland Consultants of Boulder is shown on the Sketch P1an. The 100 year flood plain and floodway are shown on the Sketch PIan' In most areas the floodplain line and the floodway line are coincidental. AIl lots have buildable areas outside of the floodway and floodplain. A detailed drainage and flood study will be presented with the preliminary plan. Included in this submittal is a soils and geologic report that was originatly prepared for both the St. Finnbar and Preshana Farns siteg. The high water table in the area of the building sites will required some considerations in the design of building foundations and floor systems' During previous reviews by Garfield County the Colorado State Geologic Service commented that there w&s potential for the gross relocation of the Roaring Fork River which could endanger the proposed building sites. This concept was discounted at a meeting this past sutrEer conducted by the Corps of Engineers and the U.S. Justice Department. At this meeting a consultant hired by the Justice Department made a presentation on the characteristics of the Boaring tr'ork niver and the typeg of activities that the Corps of Engineers would support for the stabilization for river channel' The U.a. governnent's consultant described the gross rovenent of the river channel as very unlikely. At this neeting the corps representatives encouraged the property owners along this area of the Roaring Fork Biver to unite and prepare a master plan for the stabilization of the river. If prepared in close coordination of the Corps, it was suggested that a blanket pernit for river stabilization could be issued for the entire &rea. At the prelininary pla^n we will endeavor to have a specific report thet speaks to the issue of river channel relocation. a o o o o a a o o o o Mark Bean t/37/e6 page 3 The site is rich in wildlife, particularly snall namnals, song birds and waterfowl. The Division of Wildlife issued a letter with reconnendations for the site at the tine of the original sketch plan several years ago. It was the applicants desire then as it is now,to observe these reconnendations. Sketch Plan Description The Sketch Plan proposes 14 single family lots. The gross density of the project is just over 6 acres/dwelling. AII but three of the proposed building sites are located in the open fields or upland meadows of the property. Three sites are Iocated in more heavily treed upland areas and will require greater sensitivity to vegetationin the design of the residence and site services. A11 si.te developnent will require approval by the Architectural Beview Comnittee established by the protective covenants. The Architectural Review Connittee wiII adopt design guidelines to promote the preservation and expansion of tree and shrub plantings on theproperty. Sone liuited }ivestock aEtivity nay be allowed on lotsthat have irrigated pasture. Two of the lots are located across BIue Creek. There has been a Special Use Pernit issued by Garfield County for the construction of a crossing of BIue Creek and a second crossing of a narrow piece of floodway. This pernit nay need to be updated prior to theprelininary plan. The access road (St. Finnbar Drive) from County Road 100 is identicalto the alignment of the road presented in the previous prelininary plan reviewed by the County. It is located to allow good site distance on County Road 100 and to avoid the mature Ponderosa Pinesthat the road weaves through. The access drive is in excess of 600foot naximun length recopnended by the subdivision Begulations. Thealternative would be a looping road which would result in a secondpoint off access on County Boad 100. This would create an unnecessary safety hazard as well as a waste of land and resourcea. To nininize any risk fron restricted access, a sep&rate euergency access easenent is proposed across lots 11 e L2, This will provide an alternate route to the cul-de-sac should the st. Finnbar Drive become obstructed in some D&rrner. [ots 6 through L2 are accessed bylinited use access easenents. AII lots are of more than adequate size to accomnodate all required offstreet parking. a o a a o o o o o a Mark Bean 7/31/e6 page 4 A large part of the site is covered by a copmon use e&sement which will allow aII residents of St. Finnbar Farn to enioy the natural environnent of the site. No fornal trail systen is proposed at this time although the Sketch PIan shows the connon use easenents interconnecting such that a trail could be created that circuited the entire site. Basalt Water Conservancy District contracts have been acquired for nine of the proposed lots. Additional contracts will be provided for prior to preliminary plan for the additional lots. Following the issuance of the additional contracts application wilI be nade for well permits. Each lot will have a private donestic well. Fire protection water is proposed to be provided by a shallow well infiltration gallery. This wiII allow the Carbondale Fire District trucks to punp directly from the shallow ground water reservoir. The infiltration design wiII assure the availability of adequate volunes of water for fire fighting. This design was approved by the Carbondale Fire District Fire Chief at the time of the previous prelininary plan. This proposal wilt again be reviewed with the District prior to the preliminary plan' As described above, wastewater treatnent is anticipated to be provided by the Ranch at Boaring Fork. Power and telephone service are available in the area. Comprehensive PIan Compatibility The new Garfield County Conprehensive PIan for the Roaring Fork Valley identifies the St. Finnbar site as tow Density Besidential (10+ acres/dwelling unit). a. The previous project which proposed individual sewage disposal systens would have agreed with this density. The additional expense of connecting to the Ranch at Roaring Fork wastewater treatment plant has prompted the Applicant to redesign the project to accommodate additional lots. The Sketch PIa.n represents a density of 6.1 acres per dwelling unit. The fourteen lot layout does not iupact any new areas of the site, it has simply reduced the auount of space between dwellings. Connon Use Open space easenents represent over 40 per cent of the site. The proposed parcels are consistent in size or Iarger than the residential parcels located &cross the Roaring Fork o o o e a o o O o o o Mark Bean r/31/96 page 5 fron St. Finnbar Farm. The nuch higher density Ranch at Boaring Fork is located inuediately to the northwest and Preshana Farms ad.jacent to the north wae at one tine approved for a level of developnent higher than proposed by St. Finnbar. This proposal is consistent with the adjacent uses and in fact establishes a transition to the undeveloped areas upriver. The availability of central wastewater treatnent and fire protection water further suggest conpatibility with the intent of the comprehensive plan in regards to conmunity services. b. Environnentally sensitive &reas of the site (wetlands and floodplain) have been avoided by the proposed development. Each lot has a very gracious buildable area that does not infringe upon wetlands or floodplain. Most sites c&n be built with minimal disturbance of live trees. Sore dead standing trees in cloge proxiuity to building sites nay be renoved for safety purpoaes. Iletlands danaged by the floodway channel crossings will be nitigated as proposed to the Corps of Engineers, resulting in no net loss of wetlands. AIl site disturbance, alteration of native and proposed landscape and aII building construction will require approval by the St. Finnbar Architectural Review Comnittee as established by the protective covenants. Language of the protective coven&nts is desigled to protect the wetlands and wildlife resource of the site. The wetlands are further protected by the jurisdiction of the Corps of Engineers. AIl wetland edges in general proxinity to building sites have been identified, surveyed and will be reverified in the field by the Corps of Engineers. c. Access is via County Road 100, a paved road with a channelized intersection with Hwy 82 approxinatel.y one half uile to the north. In the future, public transportation will likely be available at this Iocation along Hwy 82. d. The site has a history of agricultural activity in the open neadows but in recent years this has been reduced to grazing because of linited production and snall size fields. Some of these fields will continue to be utilized for livestock grazing. Irrigation water for the property will be owned a^nd adninistered by the St. Finnbar Honeowners Association to assure the preservation and wise use of these irrigation rights. The water will continue to be used to irrigate the historic pastures and possibly be introduced to are&s previously not accessible by flood irrigation. o ',1. t Mark Bean r/3L/96 page 6 e. Visually, the proposed developnent is largely concealed from public view. OnIy three building sites front onto County Boa.d 100' Building sites along the Boaring Fork Biver are screened by the dense native vegetation along the river bank which witl be preserved due to floodway a.nd wetlands criteria. f. The proposed subdivision offers diversity to residential housing opportunities in Garfield County because of the efforts to preserve the unique environmental characteristics of the site' The St' Finnbar Farn Sketch PIan is conpatible with the available utility transportation services a,nd preserves the wetlands and floodplain the site. The test drillingprogram will be completed for the preliminary plat submission. ln addition, we will be peiorminga 24 hour pump test on one well and we wilt be collecting water samples for quality analysis at Jnindependent laboratory. Water quality tests will be perfoimed based on Colorado bepariment ofHealth non-community water supply requirements. Enclosed is a copy of one of the g existing Basalt Water Conservancy District contracts on filewith your office. Also included is our estimates of the water requirement to support thedevelopment of an.augmentation plan to provide a "legal" watei supply to the 5i. finnOar farmSubdivision. We will be applying for 5 additional Basafi Water Conservancy District contracts;one for each of the proposed 14 lots. The St. Finnbar Farm Subdivision is proposed to be located in the Catherine area just east ofCarbondale, Colorado. The St. Finnbar Farm Subdivision wilt inctude 14 single famity residencesand a guest or caretaker house with 8,800 ft2 of lawn and gardens. The Subiivision is locatedwithin area A of the Basalt District and will be eligible for thle Basalt District temporary exchangeplan approved by Garfield County and the Colorado Division of Water Resources, until such timeas the augmentation plan moves through water court. We have estimated that these 14 single family residences and caretaker units will each beoccupied by 3 people_ using 100 gallons of water per person per day. Water will be diverted toinigate up to 8,800 ft2 of lawn at each residence.'We have also inctuded 4 livestock units in eachwater service plan. Table 1 presents the diversions and consumptive use for each lot in the St.Finnbar Farm Subdivision. As can be seen from Table 1, the subdivision will divert on the average 1.g4 AF or ,1.2 gpm andconsumptively use 0.97 AF or 0.6 gpm. The peak month of June wolto require a continuousdiversion of 2.64 gpm. O o We have reviewed the local geology for the posssiblity of available water in the St. Finnbar Farm - Subdivision area. By eflecution of this Contract, Applicant agrees to the following terms and conditions: 1. OUANTITY: In consideration of the covenants and conditions herein contained, Applicant shall be entitled to receive and apply to beneficial use .033 cubic foot of water per second from the District's direct flow rights and 1.9 acre feet per year of storage water owned or controlled by the District. 2. SOIIRCE OF ALLOTTED WATER: Water righs allotted pursuant to this Contract shall be from the District's water rights decreed to the Basalt Conduit, kndis Canal, Stockman's Ditch Extension, or other decrees or water rights hereafter acquired by the District, including the District's contractual right to receive storage water from Ruedi Reservoir. The District shall have the right to designate the water right or Decree of the District from which the Applicant's allotted rights shall be obtained. The Applicant's use of any of the District's water rights shall be subject to any and all terms and conditions imposed by the Water Court on the use of the District's said rights. Exchange reieases made from the District's storage rights in Ruedi Reservoir or other works and facilities of the District shall be delivered to the Applicant at the outlet works of said storage facility and release of water at such outlet works shall constitute full performance of the District's delivery obligation. Delivery of water from the District's storage rights in Ruedi Reservoir shall be subject to the Disfict's lease Contract with the United States Bureau of Reclamation and any rules and regulations promulgated pursuant thereto. 3. PURPOSE AND LOCATION OF USE: Applicant will use the waters herein granted for beneficial purposes limited to the augmentation of existing and future wells and other water sources, within or through facilities or upon lands owned, operated, or served by Applicant, which lands are described as Lot 1, St. Finnbar Farm Subdivision, Garfield County, Colorado; provided that the location and purpose of Applicant's use of said water shall be legally recognized and permitted by the applicable governmental authority having jurisdiction over the property served. Applicant's contemplated usage for the water allotted hereunder is for the following use or uses: Domestic/Municipal _ Industrial/Commercial - Agriculturalx Other Applicant acknowledges that usage of the District's water rights as herein contemplated shall be in lieu of or supplemental to Applicant obtaining or adjudicating, on its own, the right a o o o O o a o o o t to use certain waters. It is acknowledged that certain locations within the District may not be susceptible to service solely by the District's water rights allotted hereunder or the District's said water rights may not satisfy Applicant's needs and purposes. To the extent that service cannot be achieved by use of the District's allotted water rights, or in the event said service is inadequate, Applicant may, utilize such other water rights, by way of supplementing the District's water rights, or otherwise, as is necessary to assure water service sufficiently reiiable for Applicant's intended purpose or pu{poses. All lands, facilities and areas served by water rights allotted hereunder shall be situated within the boundaries of the District. The District reseryes the exclusive right to review and approve any conditions which may be attached to judicial approval of Applicant's use of the District's water righs allotted hereunder. Applicant agrees to defray any out-of-pocket expenses incurred by the District in connection with the allot- ment of water rights hereunder, including, but not limited to, reimbursement of legat and engineering costs incurred in connection with any water rights adjudication necessary to allow Applicant's use of such allotted water rights;-provided, however, in the event any such adjudication involves more of the District's water rights than are atlotted pursuant to this Contract, Applicant shall bear only a pro-rata portion of such expenses. Applicant shall be soiely responsible for providing works and facilities, if any, necessary to utilize the District's water rights allotted hereunder for Applicant's beneficial use. Water service provided by the District shall be limited to the amount of water available in priority at the original point of diversion of the District's applicable water right and neither the District, nor those entitled to utilize the District's decrees, ffiay call on any greater amount at new or alternate points of diversion. The District shall request the Colorado State Engineer to estimate any conveyance losses befween the original point and any alternate point and such estimate shail be deducted from this amount in each case. The District, or anyone using the District's decrees, may call on any additional sources of supply that may be available at an alternate point of diversion, but not at the original point of diversion, only as against water rights which are junior to the date of application for the alternate point of diversion. In the event the Applicant intends to develop an augmentation plan and institute legal proceedings for the approval of such augmentation plan to allow the Applicant to utilize the water allotted to Applicant hereunder, the Applicant shall give the District written notice of such intent. In the event the Applicant develops and adjudicates an augmentation plan to utilize the water allotted hereunder, Applicant shall not be obligated to bear or defray any legal or engineering expense of the District incurred by the District for the purpose of developing and adjudicating a plan of augmentation for the District. In any event, the District shall have the right to approve the Applicant's augmentation plan and the Applicant shall provide the District copies of such plan and of all pleadings and other papers filed with the Water Court in the adjudication thereof. 4. PAYMENT: Applicant shall pay annually for the water service described herein at a price to be fixed annually by the Board of Directors of the District for such service. The initial 2lnrral payment shall be made, in full, within 15 days after the date of a notice from the District that the initial payment is due. Said notice will advise the Applicant, among other things, of the water delivery year to which the payment shall apply and the price which is applicable to that year. OTHER RULES: Applicant's rights under this Conuact shall be subject to the Water Service Plan as adopted by the District and amended from time to time; provided that such Water Service Plan shall apply uniformly throughout the District among water users receiving the same service from the District. Applicant shall also be bound by the provisions of the Water Conservancy Act of the State of Colorado, the Rules and Regulations of the Board of Directors of the District, the plumbing advisory, water conservation, and staged curtailment regulations, if any, applicable within the County in which the water allotted hereunder is to be used, together with all amendments of and supplements to any of the foregoing. 8. CIIRTAILMENT OF USE: The water service provided hereunder is expressly subject to the provisions of that certain Stipulation in Case No. 80 CW 253 on file in the District Court in Water Division 5 of the State of Colorado, which Stipulation provides, in p"rt, for the possible curtailment of out-of-house municipal and domestic water demands upon the occurrence of certain events and upon the District giving notice of such curtailment, all as more fully set forth in said Stipulation. 9. OPERATION AND MAINTENANCE AGREEMENT: Applicant shall enter into an "Qrcration and Maintenance Agreement" with the Disrict if and when the Board of Directors finds and determines that such an agreement is required by reason of additional or special services requested by the Applicant and provided by the District or by reason of the delivery or use of water by the Applicant for more than one of the classes of service which are defined in the Rules and Regulations of the Board of Directors of said District. Said agreement may contain, but not be limited to, provision for water delivery at times or by means not provided within the terms of standard allotment contracts of the District and additional annual monetary consideration for extension of District services and for additional administration, operation and maintenance costs, or for other costs to the District which may arise through services made available to the Applicant. 10. CHANGE OF USE: The District reseryes the exclusive right to review and approve or disapprove any proposed change in use of the water right allotted hereunder. Any use other than that set forth herein or any lease or sale of the water or water rights allotted hereunder without the prior written approval of the District shall be deemed to be a material breach of this Contract. 11. PRIOR RESOLUTION: The water service provided hereunder is expressly subject to that certain Resolution passed by the Board of Directors of the District on September 25, L979, and all amendments thereto, as the same exists upon the date of this application and allotment Contract. NO FEE TITLE: It is understood and agreed that nothing herein shall give the Applicant any equitable or legal fee title interest or ownership in or to any of the water or water rights of the District, but that Applicant is entitled to the right to use the water right allotted hereunder, subject to the limitations, obligations and conditions of this Contract. 13.
