Plan, Study fuea I.
DESCRIPI'ION OF THE PROPOSAL
A. Site DescriFtion: The 85 acre property lies immediately west of County Road 100,
approximately two (2) miles east of Carbondale, along the Roaring Fork River.
Vegetation consists of large cottonwood trees, willows and associated riparian and
wetland plants. The majority ofthe site is characteristically, low-lying and significant
portions of the site are within the designated floodplain of the Roaring Fork River.

B. Adjacent Land Uses: Preshana Farms is located immediately north of the subject
property, The Ranch at Roaring Fork is located west of the property and Te-Ke-Ki
is located south, across the river fiom the property.
C. Proposal: The applicant is proposing a 14 lot subdivision of the 85 acre tract,
creating single-tbmily homesites ranging in size from 2.0 acres to 13.3 acres. It
appears that the proposal is also suggesting the addition of one (1) accessory dwelling
unit for each lot, presurnably conqtructed at the behest of the individual property
owner. See sketctr *up, pug. . ? -
D. Flistory: Saint Finnbar Farms has been through a number of proposals and has been
modified significantly ttuough time. Resolution No, 79-136 approved a PUD for the
site, which was later rescinded by Resolution No. 82-15, changing the zoning back
to A/R/RD. In 1990, the Planning Comrnission considered a sketch plan for a l2 lot

subdivision of the property, which, apparently after the issuance of Special Use
Permits fbr two (2) floodplain crossings, progressed to the Preliminary Plan phase.
In 1993, the Planning Commission entertained this modifled subdivision proposal
which specified a nine (9) lot subdivision and was subsequently withdrawn by the
applicant in April, 1993. It should be noted that the issuance of the SUP is
independent of the subdivision approval process and in no way implies approval of the
overall project.
A. Division of Wildlifle: Kevin Wright of DOW responded noting this land is critical deer
habitat and that all earlier comments on all earlier proposals are still valid.
Specifically, no net loss of wetlands; no grazing in wetlands or along streambanks,
maintenance of a buffer zone between building envelopes; maintenance of existing,
native vegetation; no dogs, but if this is not feasible, then limited to one (l) dog per
lot and kept kennelled; fencing to be done consistent with Dell( guidelines; all utilities
should be placed underground. See retter on pages EIJIL
B. Town of Carbondale: Mark Chain, planner for the Town commented noting that
suflicient time did not exist for a full review by the'fown's planning commission, but
.iffiempt to comment at time of preliminary plan submittal. See letter, page
C. Carbondale & Rural Fire Protection District, Recommends that all "access
easements" be designed and constructed to allow sulllcient access and the ability for
emergency vehicles to turnaround, as well as the ability to support a weight of up to
30 tons. 'l'he proposed, shallow well infiltration gallery should be buitt so it may be
easily accessed by fire apparatus and be constructed with no more than a 10 foot
vertical lifi. lmpact f-ees of $3290.00 ($235.00_per lot) must be paid prior to the
recorcting of the final plat. See leter., pages E* lL
MAJOR ISSUES ANp CONCEnNS
A Koartng t'ork Rtver t'loodplain: 'lhe chief constraint to this tract of land is the
floodplain of the Roaring Fork River, wliich occupies a signiticant portion of the 85

acre site. Without exception, every proposed Iot contains at least a portion of the
designated floodway oleither the Roaring Fork River or Blue Creek. Associated with
the floodway designation is a general correspondence of identified and regulated
wetlands, whioh further constrain the tract. This floodplain designation is fbr the 100
year floodplain, mapped in 1982. In researching the older subdivision sketch plan and
preliminary plan subrnittals, it appe?u's there may be some conjecture as to the current
location of the floodplarq and g[rannel of the Roaring Fork River. See earlier
correspond.n.., pug., 1|1- ll . The applicant's planner indicates that another
oonsultant consiclers ". . ,the gross movement of the river channel as very unlikely."
Staff suggests additional information is recluired to adequately understand the
likelihood of; and potentialfor, the movement of the channel and related floodway of
the Roaring Fork River, specific to this proposed subdivision.
T'he applicants requested a Special Use Permit - Floodplain for the construction of
two (2) crossings of the secondary floodway channels that cross the property. The
first crossing would provide &ccess to proposed lots 6 and 7, the other crossing would
provide access to proposed lots 8, 9, 10, I I and 12. The Board of County
Commissioners approved this SUP request (Resolution 92-083), conditioned upon
receiving final approval of the crossings liont the Colorado Water Conservation
Board and the Army Corps of Engineers, which must be granted prior to constnrction
of the crossings. See letter of approval, page'_Zl1 - There is no record of either
agency gtving its approval. Furthermore, there rnay be further restrictions placed on
this type of river crossing, as a letter contained in the file indicates the expiration date
of a "nationwide general permit allowing the discharge of dredged or fill material into
waters of the United States, in association with minor road crossings " This general
pernrit was set to expire on January 13,1992. Staffdoes not know how this may

B. Zoning. The property is within the A/R/RD zone district which mandates a minimum
lot size of two (2) acres. All proposed lots conform to this minimum requirement.
However, as discussed above, the floodplain constrains a number of lots, sufficiently
reducing building envelopes to smaller sizes and requiring these envelopes to be
placed in very certain locations. Again, based on the speculation that the floodplain
of the Roaring Fork River has shifted, there is no guarantee that these envelopes are
completely removed h'om the existing 100 year floodplain. The County has specific
permitting procedures that allow use of the flood fringe, yet do not allow residential
use of the floodway, using the lloodplain study and maps fi'om 1982. It appears that,
for rnuch of this site, there is no distinction between the floodway and the flood
fiinge. This analysis is initiated on a macro scale, using these maps drawn in 1982, and
is then required to conform to other, more specific, criteria. It is conceivable that, if
this plan progresses to later phases, it would be necessary to conduct additional
floodplain mapping. The applicant states that "in the spring of 1995 a new wetlands
verification process was initiated;" however, staffdoes not know the outcome of this
process. Additionally, the existing wetlands willbe resurveyed by the Army Corps
of Engineers this spring (1996), as the verification of these wetlands has expired.
The sketch plan also specifies the potential for each lot having an accessory dwelling
unit (ADU). The mininrum lot size requirenrent that would allow an ADU is four (4)
acres, which would preclude lots 2, 4,5, ll and 13, tor-n having ADUs, in their

Access/ltoads: All proposed lots would be accessed from County Road 100, via an
internal access road and additional acoess easements. Assuming for a moment that
all nine (9) proposed lots that are large enough to allow ADUs would later have
accessory dwelling units built, this subdivision would eflectively contain 23 individual
units requiring what is known as St. Finnbar Drive to be built to Secondary Access
standards, which provicles: 50 foot right-of-way; I I foot travel lanes; 6 foot
shoulders;ard a 6 foot ditch width 'I'he roads designated 'Access Easement'would
be requiled to be built to Semi-Primitive standards, providing: 40 foot right-of-way;
8 foot travel lanes; 6 foot shoulders and ditches Furthermore, St. Finnbar Drive is
a cul-de-sac nearly 1000 feet in length, with two (2) additional access easements
originating llom it. County subdivision regulations allow fbr ctrl-de-sacs of up to 600
feet in length. In excess of this length, longer cul-de-sacs may be permitted for
topographical reasons granted it can be proven that fire protection and emergency
egress and access is provided as a part ofthe longer design.
The argurnent could be made that the ADUs would only be built at the discretion of
the individual lot owner and that not all lot owners would opt fbr an ADU; however,
the provision fbr ADUs would certainly be included within any water augmentation
contracts, agreenlents with the Ranch at Roaring Fork for use of their sewage plant
and the homeowners covenants that would allow any lot owner who met the zoning
criteria to add an ADU For this reason, wise proactive planning would dictate the
inllastructure contbrm to the allowed uses.
Water: The applicant is planning the use of individualwells for the 14 proposed lots
and has secured nine (9) contracts liom Basalt Water Conservancy District to provide
a legal supply of water. See water allotment contract, pages U -3 ( The wells
would be completed in the alluvial terrace deposits of the Roaring Fork River. Given
the hydrogeology of this specific po(ion of Garfield County, staff expects an
adequate, physical supply of water exists fbr the proposed uses. However, at time of
Preliminary Plan submittal, it will be necessary to conduct site specific drilling and
pump tesling to demonstrate the hydraulic characteristics of the aquifer that would be
ut.ilized for the water supply. The geotechnical report indicated that the groundwater
in this area can be expected to carry significant quantities of sulfbtes. Additionally,
it will be necessary to acquire the rernaining water allotment contracts,

Sewer: The method of waste water treatment for this proposal would be furnished
by the existing waste water treatment facilities located at the Ranch at Roaring Fork.
The applicants have entered into a Memorandunr of Understanding (MOU) *itf, tne
owners o{'said t}cilities, whic!^sets forth an outline of the principal terms of the
agreemenr. see MoU, pages SL' l{ lt appears that, at this time, this Mou
is suflicient; however, it becomes null and void if a Definitive Agreement has not been
executed by both parties on or before April l, 1996 Staffsuggesrs that the successful
execution of the Definitive Agreernent is crucial to this subdivision proposal
advancing into later stages
Soils. 'Ihe Soil Conservation Service (SCS) has clesignated three (3) different soils
on the strbject property, each with its own characteristics and constraints to
development. The soil type nrost oonducive to development is the Atencio-Azeltine
complex, which is typically deep and well-drained and located on the highest (relative)
portions of the property; however, the areal extent of this soil is small. The main
l.imitation of this soilto community development is the presence of small stones. For
buildings without basements, constraints to developrnent are considered to be slight.
T'he other two (2) soils, Fluvaquents end Redrob, carry nruch more severe constraints
to building site development, due to flooding and general wetness.
The geotechnical report submitted with the application indicates that groundwater
varied in depth fi'onr three (3) to seven (7) feet ancl would be expected to rise as
runoff increases, perhaps presenting a construction problem in lower areas. The
report indicated the soils would probably not be susceprible to significant settling or
expansion as long as fbundations penetrate to underlying alluvial gravels. The report
fi,rrther noted that the liee waler level, in sorne locations, can be expected to rise and
could conceivably be encountered at the ground surface. Basements or similar
structures are not recomntended and dewatering techniques rnay be required in the
installation of fbundations.
Building Sites/Open Space. Due to the constraints of the subject property, building
sites have been designated to specific envelopes located outside of the floodplain and
wetland areas. It appears these building envelopes have been designated in respect
to existing plant cornmunities, floodways and wetlands. Ilowever, by doing so, someol the proposed lots have builcling envelopes that may present problems to
conventional home design, which could be further compouncled by the addition of an
accessory dwelling unit
Latge portions of the tract, specifically the unbuildable lands contained within
t'loodplain and wetland areas, would be dedicated to open space and common use
easements, denoted on the sketch plan by a sedes of srnall dots. Staffwould question
these easements as they oonstitute significant portions of the larger lots and would
presumably be maintained by the individual lot owners fbr other's enjoyment. If
fences were later erected on an individual's property, there would appear to be no
guarantee ofaccess.
Fire Protection: Water to be used for fire protection would be available on the site
by means of a consttucted, shallow well infiltration gallery and, presumably, a
connected hydrant that would allow fire trucks the ability to pump directly from the
reservoir Apparently, this design ltas been approved in the past and would again be
reviewed by the Carbondale Fire District, prior to the preliminary plan submiital.
StafI Comment. It is staffs opinion that the constraints inherent to this property
dictate its potential for development. Due to the significant constraints por"d by the
floodplain and the existing wetlands, the proposed subdivision of 14 lois with up to
a total of 23 possible housing units is significantly greater than the carrying .upu.ity
of the land. It would be much more appropriate to consider either the recommended
dwelling unit density contained in the Comprehensive Plan for Study Ar-ea [, of l0+
acres per dwelling unit, or make reapplication fbr a Planned Unit Development to
allow clustered homesites that would recognize the limitations of the land,build the
homesites in a much closer proximity to one another, and retain the marginal lands as

common open space or other recreational land use designation that would not impact
the river floodplain ancl sensitive lancls as severely u, ihi, proposal would.
The Sketch Plan process is purely infbrmational. Completion of the Sketch plan process does notconstitute approval of the proposed plan
The Sketch Plan comments shall be valid for a period not to exceed one ( I ) year from the date of thePlaming Commission review. If a Preliminary Plan for the proposed subdivision is not presented tothe Garfield County Planning Commission within this period, the applicant shall submit an updatedSketch Plan application to the pranning Department ibr review ard
