SUBJECT: Saint Finnbar Farms Sketch Plan Application
DATE: 3 February, 1998
Consistent with Section3.25 of the Garfield County Subdivision Regulations, this application is being
reviewed for comparison with the previous sketch plan application, reviewed by the Planning
Commission in March, 1996. For the sake of clarity, staffhas attached the previous report and will
note, in this Addendum, the differences with the current application.
This sketch plan application was sent to a number of review agencies, the following comments have
been received:
ll Roaring Fork School District RE-l. Advises the County of its recently completed cash-in-lieu
of land dedication fee and requests that this fee be applied to the subdivision lots. See letter
and supporting information, pages / - ?
Division of Wildlife: Has reviewed the application, noting that many of the Division's past
recommendation have been incorporated in the recent design and commends the applicants
for the wildlife manual proposal. However, more specific information concerning
management guidelines needs to be presented and something other than protective covenants
is needed to enforce management restrictions. Additionally, no grazing should be allowed
within wetlands; wetland perimeters must be marked prior to any construction, with
appropriate erosion control devices utilized; greater building envelope setbacks are
encouraged, as well as a public fishing easement. See letter, pages Q - t O
Garfield County Department of Emergency IVlanagement. Suggests that a "dry hydrant
system" be utilized for fire protection; recommends National Fire Protection Association
standards for access be employed; and encourages a thorough review offloodplain hazards.

Carbondale & RuralFire Protection District: Advises that comments from its previous letter
remain valid; the district would collect impact fees per each residential unit at time of final
plat, currently $339 See letter, page -H -
Existing site conditions: Have obviously remained the same or at least very similar.
Floodplain and river channel: In the previous staffreport and other reviews, concern was raised for
the Roaring Fork River channel and its potential for gross lateral movement. The project's engineer
has reviewed aerial photographs, existing mapping and other ffirmation, and has found no indication

of movement. As required by regulations, a drainage plan and floodplain analysis will be presented
at preliminary plan stage.
The river channel, from the Catherine Store bridge to State Highway 133, has been studied by the
Army Corps of Engineers and a master plan completed, detailing various channel stabilization
methods. This study also provided an opinion that gross movement of the river is unlikely. St.
Finnbar is a participant in this study and apparently has committed to bank stabilization and
restoration.
Wetland boundaries. Wetland boundaries were mapped and established in the Summer of 1997, and
have been verified by the Corps of Engineers. This determination is valid for five years.
Lot design and develogment: The application proposes 14 single family residential lots, with an
allowance for up to 10 lots having an accessory dwelling unit (ADU). Each lot contains a proposed
building envelope, and all lot sizes and building envelopes are very similar to the most recent sketch
plan application. For this reason, staffconsiders previous comments to be valid.
Wastewater treatment: It appears the applicants have reached an agreement with the Ranch at
Roaring Fork for wastewater treatment. At the time this report was written, this agreement had not
been presented to the Planning Department for review.
Road impact fees: The subject property is not located within any of the l2 Traffic Study Areas that
were designated for road impact fee calculation purposes. Therefore, it would appear that the road
impact fee recently adopted by the County would not be applicable to this subdivision proposal. See
map, page -/3 -
Comprehensive Plan consistency: The application contains an evaluation of consistency with the
various Goals contained within the Plan. This reviewer generally agrees with the analysis provided,
unless otherwise noted below:
Goal #9 - Natural Resource Extraction: Although it is self-evident that extraction of
aggregate from the site would have significant environmental effects, the platting of the site
for permanent development will have the net result of limiting the amount of recoverable
aggregate deposits.
Goal #10 - Urban Areas of Influence: It is true that the subject property is not within the
statutory urban area of influence (two miles). However, the applicants should seek to involve
the Town of Carbondale in the planning process, especially since the Town is currently
updating its Comprehensive Plan.
Section IV - Methodolog,v: This reviewer acknowledges the generalities that are endemic to
the process of evaluating lands and assigning specific development potentials. These
development potentials are reflected in the proposed densities that have been adopted within
the Comprehensive Plan and applied to land subdivision or other development. Based upon
a review of Table 30 of the Plan, the sketch plan application, and analysis of this Table, as

well as the Goals contained in the Plan, and after an in-depth site tour staffagrees with the
applicant's analysis, with the following reservation:
That each lot may only be developed with a single residential structure. If the provision of
accessory dwelling units, guest houses or any other residential use is allowed in combination
with the primary, residential structure, then the density of this project would not be
appropriate for the site. This determination is made based on the resultant, net density of the
property, limited developable area, floodplain and wetland constraints, and increased traffic.
The Sketch Plan process is purely informational. Completion of the Sketch Plan process does not
constitute approval of the proposed plan.
The Sketch Plan comments shall be valid for a period not to exceed one (1) year from the date of the
Planning Commission review. If a Preliminary Plan for the proposed subdivision is not presented to
the Garfield County Planning Commission within this period, the applicant shall submit an updated
Sketch Plan application to the Planning Department for review and comparison with the original
application.

During ihe course of several months, the school district. with inpur frorn planners of rhe
various governments within the District's boundaries, has researched anc evaluated land
dedication fee formulas to be applieri in accordance with Colorado Revised Statures.
This research culminated in a resoiution which was adopted by the Roaring Fork School
District Board of Education at their regular meering on Juiy 7. t9g7 . The District
encouraces the counties of Eagle, Garfield and Pitkin. the City of Glenr,vood Springs, and
the Towns of Basalt and Carbondale to adopt the provisions of this resolution to be
applieci to residentiai development occurrinrr lvithin the District's boundaries.
The District will continue to evaluate and respond to specific subdivision requests. andwill determine whether land dedication or cash-in-lieu of land dedication is appropriate
_siven the nature of each request.

I have reviewed the St. Finnbar Farm sketch plan and will refer
you to my previous letters of 7-6-90, 9-24-9L, and 2-28-96 to the
6ounty. -Al indicated in previous letters, the main values to
wildlife on this parcel aie its wetlands, riparian areas, and
associated cottonwood and ponderosa pine trees. The ta1l
cottonwood and ponderosa tiees provide excellent habitat for
perching, feediig, and nesting iavities for a variety of species
iepenaeil upon that habitat tipe. A variety of raptors, ow1s,
..,& =ong niias use this habit.il. The associated wetlands and
ripariai areas along Blue Creek and the Roaring Fork River are
esiecially importani, providing habitat for nesting waterfowl and
ot'her =orr| niias and srnall mammals (raccoons, skunks, mink,
beaver, mriskrat, mice, vo1es, etc). Mule deer also utilize the
area and move throughout the bottomland.
The sketch plan has incorporated many of my past recommendations
to protect Lne riparian and wetland areas and associated
cottonwoods. f cornmend the applicant for that. Their proposal
to develop a wildlife manual is a great idea.
The following are additional comments and recommendations
regarding the latest proPosal.
l-. The proposal- stitea that special management guidelines
would be included in the protective covenants to assure
preservation of the present qualities of the open space
areas. What are these nanagement guidelines? I have stated
in previous letters my concern over protective covenants and
their effectiveness. There are several issues which will be
addressed in the covenants such as maintenance of native
vegetation/cottonwoods/snags, fencing, dogs, etc. which are
.r"iy important from a wi-faiife management perspective. I
would recommend that these issues be addressed as condi-tions
of approval and not placed within the covenants'

Impact Fees
The distnct has revised its impact fee rates since the previous submittal (currently $339.00 per urut)
The fees are subject to penodic review and revision by the district. Fees for this development would
be based upon the per lot impact fee adopted by the District at the time of recording of final plat or
at the time of execution of an agreement between the developer and the district.

RELATIONSHIP TO THE COMPREHENSTVE PLAN
The subject property is located within the (Proposed) Low Density Residential (10 + aglgg
per dwelling unit) Land Use District as designated by the Garfield County Comprehensive
Plan, Study Area I.
DESCRIPTION OF THE PROPOSAL
A. Site Description: The 85 acre property lies immediately west of County Road 100,
approximately two (2) miles east of Carbondale, along the Roaring Fork fuver.
Vegetation consists of large cottonwood trees, willows and associated riparian and
wetland plants. The majority ofthe site is characteristically, low-lying and significant
portions of the site are within the designated floodplain of the Roaring Fork fuver.

B. Adiacent Land Uses: Preshana Farms is located immediately north of the subject
property, The Ranch at Roaring Fork is located west of the property and Te-Ke-Ki
is located south, across the river from the property.
C. Proposal. The applicant is proposing a 14 lot subdivision of the 85 acre tract,
creating single-family homesites ranging in size from 2.0 acres to 13.3 acres. It
appears that the proposal is also suggesting the addition of one ( l) accessory dwelling
unit for each lot, presumably constructed at the behest of the individual property
owner. See sketch map, page - A/'
D. History: Saint Finnbar Farms has been through a number of proposals and has been
modified significantly through time. Resolution No. 79-136 approved a PIID for the
site, which was later rescinded by Resolution No. 82-15, changing the zoning back
to A/R/RD. [n 1990, the Planning Commission considered a sketch plan for a 12 lot
subdivision of the property, which, apparently after the issuance of Special Use
Permits for two (2) floodplain crossings, progressed to the Preliminary Plan phase.
In 1993, the Planning Commission entertained this modified subdivision proposal
which specified a nine (9) lot subdivision and was subsequently withdrawn by the
applicant in April, 1993. It should be noted that the issuance of the SLIP is
independent of the subdivision approval process and in no way implies approval of the
overall project.
REVIEW AGENCY/PUBLIC COMMENTS
A. Division of Wildlife: Kevin Wright of DOW responded noting this land is critical deer
habitat and that all earlier comments on all earlier proposals are still valid.
Specifically, no net loss of wetlands; no grazing in wetlands or along streambanks;
maintenance of a buffer zone between building envelopes; maintenance of existing,
native vegetation; no dogs, but if this is not feasible, then limited to one (l) dog per
lot and kept kennelled: fencing to be done consistent with DOW guidelines; all utilities
should be placed underground. See letter on pages -?e -S ,'
B. Town of Carbondale: Mark Chain, planner for the Town commented noting that
sufficient time did not exist for a full review by the Town's planning commission, but
would attempt to comment at time of preliminary plan submittal. See letter, pageag
C. Carbondale & Rural Fire Protection District: Recommends that all "access
easements" be designed and constructed to allow sufficient access and the ability for
emergency vehicles to turnaround, as well as the ability to support a weight of up to
30 tons. The proposed. shallow well infiltration gallery should be built so it may be
easily accessed by fire apparatus and be constructed with no more than a 10 foot
vertical lift. Impact fees of $3290.00 ($235.00 per lot) must be paid prior to the
recording of the final plat. See letter, pages -?a - 3O .
ry.MAJOR TSSUES AND CONCERNS
Roaring Fork River Floodplain: The chief constraint to this tract of land is the
floodplain of the Roaring Fork River, which occupies a significant portion of the 85
acre site. Without exception, every proposed lot contains at least a portion of the
designated floodway of either the Roaring Fork fuver or Blue Creek. Associated with
the floodway designation is a general correspondence of identified and regulated
wetlands, which further constrain the tract. This floodplain designation is for the 100
year floodplairL mapped in 1982 In researching the older subdivision sketch plan and
preliminary plan submittals, it appears there may be some conjecture as to the current
location of the floodplain_ and channel of the Roaring Fork River. See earlier
correspondence, page s 3 / - S L. The applicant's planner indicates that another
consultant considers ". . .the gross movement of the river channel as very unlikely."
Staff suggests additional information is required to adequately understand the
likelihood of, and potential for, the movement of the channel and related floodway of
the Roaring Fork River, specific to this proposed subdivision.
The applicants requested a Special Use Permit - Floodplain for the construction of
two (2) crossings of the secondary floodway channels that cross the property. The
first crossing would provide access to proposed lots 6 and 7, the other crossing would
provide access to proposed lots 8, 9. 10, ll and 12. The Board of County
Commissioners approved this SUP request (Resolution 92-083), conditioned upon
receiving final approval of the crossings from the Colorado Water Conservation
Board and the Army Corps ofEngineers, which must be granted prior to construction
of the crossings. See letter of approval, page - 3 -- There is no record of either
agency giving its approval. Furthermore, there may be further restrictions placed on
this type of river crossing, as a letter contained in the file indicates the expiration date
of a "nationwide general permit allowing the discharge of dredged or fill material into
waters ofthe United States, in association with minor road crossings." This general
permit was set to expire on January 13,1992. Staffdoes not know how this may
affect the crossings of the channels or the Special Use Permit granted by Resolution
92-083. See letter pages 3 3 5*
Zoning. The property is within the A/R/RD zone district which mandates a minimum
lot size of two (2) acres. All proposed lots conform to this minimum requirement.
However, as discussed above. the floodplain constrains a number of lots, sufficiently
reducing building envelopes to smaller sizes and requiring these envelopes to be
placed in very certain locations. Again, based on the speculation that the floodplain
of the Roaring Fork River has shifted, there is no guarantee that these envelopes are
completely removed from the existing 100 year floodplain. The County has specific
permitting procedures that allow use of the flood fringe, yet do not allow residential
use of the floodway, using the floodplain study and maps from 1982 It appears that,
for much of this site, there is no distinction between the floodway and the flood
fringe. This analysis is initiated on a macro scale, using these maps drawn in 1982, and
is then required to conform to other, more specific, criteria. It is conceivable that, if

this plan progresses to later phases, it would be necessary to conduct additional
floodplain mapping. The applicant states that "in the spring of 1995 a new wetlands
verification process was initiated:" however, staffdoes not know the outcome of this
process. Additionally, the existing wetlands will be resurveyed by the Army Corps
of Engineers this spring (1996), as the verification of these wetlands has expired.
The sketch plan also specifies the potential for each lot having an accessory dwelling
unit (ADL.I). The minimum lot size requirement that would allow an ADU is four (4)
acres. which would preclude lots 2. 4, 5, ll and 13, from having ADUs, in their
present configurations. See ADU information, page - /O -
AccesVRoads: All proposed lots would be accessed from County Road 100, via an
internal access road and additional access easements. Assuming for a moment that
all nine (9) proposed lots that are large enough to allow ADUs would later have
accessory dwelling units built, this subdivision would effectively contain 23 individual
units requiring what is known as St. Finnbar Drive to be built to Secondary Access
standards, which provides: 50 foot right-of-way; 1l foot travel lanes; 6 foot
shoulders. and a 6 foot ditch width. The roads designated 'Access Easement'would
be required to be built to Semi-Primitive standards, providing: 40 foot right-of-way;
8 foot travel lanes; 6 foot shoulders and ditches. Furthermore. St. Finnbar Drive is
a cul-de-sac nearly 1000 feet in length, with two (2) additional access easements
originating from it. County subdivision regulations allow for cul-de-sacs of up to 600
feet in length. In excess of this length, longer cul-de-sacs may be permitted for
topographical reasons granted it can be proven that fire protection and emergency
egress and access is provided as a part of the longer design.
The argument could be made that the ADUs would only be built at the discretion of
the individual lot owner and that not all lot owners would opt for an ADU; however,
the provision for ADUs would certainly be included within any water augmentation
contracts, agreements with the Ranch at Roaring Fork for use of their sewage plant
and the homeowners covenants that would allow any lot owner who met the zoning
criteria to add an ADU. For this reason, wise proactive planning would dictate the
infrastructure conform to the allowed uses.
Water: The applicant is planning the use of individual wells for the l4 proposed lots
and has secured nine (9) contracts from Basalt Water Conservancy District to provide
a legal supply of water. See water allotment contract, pages 4 i - 4{ . The wells
would be completed in the alluvial terrace deposits of the Roaring Fork fuver. Given
the hydrogeology of this specific portion of Garfield County, staff expects an
adequate, physical supply of water exists for the proposed uses. However, at time of
Preliminary Plan submittal, it will be necessary to conduct site specific drilling and
pump testing to demonstrate the hydraulic characteristics of the aquifer that would be
utilized for the water supply The geotechnical report indicated that the groundwater
in this area can be expected to carry significant quantities of sulfates. Additionally,
it will be necessary to acquire the remaining water allotment contracts.

E Sewer: The method of waste water treatment for this proposal would be furnished
by the existing waste water treatment facilities located at the Ranch at Roaring Fork.
The applicants have entered into a Memorandum of Understanding (MOU) with the
owners of said facilities, which sets forth an outline of the principal terms of the
agreement. See MOU, pages 4b - 4a . It appears that, at this time, this MOU
is sufficient; however, it becomes null and void if a Definitive Agreement has not been
executed by both parties on or before April l, 1996 Staffsuggests that the successful
execution of the Definitive Agreement is crucial to this subdivision proposal
advancing into later stages.
Soils: The Soil Conservation Service (SCS) has designated three (3) different soils
on the subject property, each with its own characteristics and constraints to
development. The soil type most conducive to development is the Atencio-Azeltine
complex, which is typically deep and well-drained and located on the highest (relative)
portions of the property; however, the areal extent of this soil is small. The main
limitation of this soil to community development is the presence of small stones. For
buildings without basements, constraints to development are considered to be slight.
The other two (2) soils. Fluvaquents and Redrob. carry much more severe constraints
to building site development, due to flooding and general wetness.
The geotechnical report submitted with the application indicates that groundwater
varied in depth from three (3) to seven (7) feet and would be expected to rise as
runoff increases, perhaps presenting a construction problem in lower areas. The
report indicated the soils would probably not be susceptible to significant settling or
expansion as long as foundations penetrate to underlying alluvial gravels. The report
further noted that the lree water level. in some locations, can be expected to rise and
could conceivably be encountered at the ground surface. Basements or similar
structures are not recommended and dewatering techniques may be required in the
installation of foundations.
Building Sites/Open Space: Due to the constraints of the subject property, building
sites have been designated to specific envelopes located outside of the floodplain and
wetland areas. It appears these building envelopes have been designated in respect
to existing plant communities, floodways and wetlands. However, by doing so, some
of the proposed lots have building envelopes that may present problems to
conventional home desigq which could be further compounded by the addition of an
accessory dwelling unit.
Large portions of the tract, specifically the unbuildable lands contained within
floodplain and wetland areas, would be dedicated to open space and common use
easements, denoted on the sketch plan by a series of small dots. Staffwould question
these easements as they constitute significant portions of the larger lots and would
presumably be maintained by the individual lot owners for other's enjoyment. If
fences were later erected on an individual's property, there would appear to be no
guarantee ofaccess.

H. Fire Protection: Water to be used for fire protection would be available on the site
by means of a constructed, shallow well infiltration gallery and, presumably, a
connected hydrant that would allow fire trucks the ability to pump directly from the
reservoir. Apparently, this design has been approved in the past and would again be
reviewed by the Carbondale Fire District, prior to the preliminary plan submittal.
I. Staff Comment: It is staffs opinion that the constraints inherent to this property
dictate its potential for development. Due to the significant constraints posed by the
floodplain and the existing wetlands, the proposed subdivision of l4 lots with up to
a total of 23 possible housing units is significantly greater than the carrying capacity
ofthe land. It would be much more appropriate to consider either the recommended
dwelling unit density contained in the Comprehensive Plan for Study Area I, of l0+
acres per dwelling unit, or make reapplication lor a Planned Unit Development to
allow clustered homesites that would recognize the limitations of the land, build the
homesites in a much closer proximity to one another, and retain the marginal lands as
common open space or other recreational land use designation that would not impact
the river floodplain and sensitive lands as severely as this proposal would.
The Sketch Plan process is purely informational. Completion of the Sketch Plan process does not
constitute approval of the proposed plan.
The Sketch Plan comments shall be valid for a period not to exceed one ( I ) year from the date of the
Planning Commission review. If a Preliminary Plan for the proposed subdivision is not presented to
the Garfield County Planning Commission within this period, the applicant shall submit an updated
Sketch Plan application to the Planning Department for review and comparison with the original
application.

I have had the opportunity to review this sketch plan and I have
the following commenLs regarding the application at this stage.
1. The agreement, for central sewer service was not finalized as
of the date of the sketch plan application. An unequivocal
commitment t,hat central Sewer "can and wiI1" be provided will be
essential. Additionally, the legal mechanism for the landowners
in this development to enforce the sewer service contract shoul-d
be specified.
2. A11 construction in floodplains, including construction of
roads, sewer lines and other utilities (electric, telephone, 9&s,
etc. ) will require a special use permj-t. The placing of these
utitities on the site plan has noL yet been accomplished. It
should be noted that the most direct access to the Ranch at
Roaring Forks's existing sewer line appears to be to the west.
However, the entire western boundary of the site is designated as
being floodplain/floodway with some interspersed wetlands.
Additionally, the floodplaj-n/floodway designation continues
beyond the boundqry of the site and onto land belonging to the
ranch at Roaring Fork. The necessary special use permits will be
required. for al-1 construction in these areas, possibly including
permits for constructi-on on land which is not owned by the
applicant.
3. The streets providing access to rots eight through twelve,inclusive, as well as to lots six and seven are designated. by theapplicant as *30' access and ut.ility easement.,, The emergency
access easement from the street adjacent to lot L2 to County Road100 is labeled "30' emergency access easement,,, although itappears more narrow that were it joins the 30-foot-wide accessstreet at the dividing 1lne between lots 11 and L2. streets 30feet in width, in the cont,ext of this subdj-vision, may beinadequate as per subdivision regulation 9:35.
4. The t.wo access streets appear to "dead end,,, raising the
requirements for a T-shaped turnaround and minimum t.urningradj-us in subdivision regulation 9:33.
5. A11 streets in a subdivision must be dedicated as public rj-ghtor ways. rn t.he applicat.ion, the streets oLher than -sL. FinnbarDrive" are labered easements. The applicant should clarify what,if dflY, distinction is being proposed between public streets and
easements.
6. Each lot has a proposed building envelope to insure thatconstruction does not take place within wetlands or floodplanes.
AlEhough the applicat.ion specifies access to each lot line, itshould be clarified that passage through a lot to the building
envelope without breeching wetlands or floodplanes is available
and will be respected.
