A RESOLUTION CONCERNED WTIH THE APPROVAL OF A PRELIMINARY PLAN FOR TTIE ST.FINNBAR SIJBDTYISION.
WHEREAS, st. Finnbar L-and Company fi!:d an application with rhe Board of co,ntycommissioners of Garfield county for approval of n fi.iorry iian for thc st. Finnbar Subdivision; and
WHEREAS' the Garfield County Planning Commission reviewed the St. Finnbar preliminary plan
application and recommended approval to the Board of county commissioners; and
WIIEREAS' based on the material submitted by the applicant, the rocommendation of the planning
commission and the comments of the Garfield County rhnning Department, this Board finds as follows:
l.That proper publication, public notice and posting was provided as required by Iaw for the
hearings before the Planning commission and Board oicounty commirrio#s.
That the hearings before the planning commission and Board of county commissioners
were extensive and complete, that all pertinent facts, matters and issues wire submitted and
that all interested parties were hcard at that hearings.
That the Garfield county Planning commission recommended approval of the preliminary
Plan.

6' Prior to the approval ofthe Pretiminary Plan, the Applicant shall submit documentation thatwould allow the State Deparknent of Water Resources to recommend approval of theproject's water supply.

8' That the fsherman's easement be made a public easement very clearly in the covenants andon the plat and consistent with the Division of wildlife comments.

District.
That acc-essory dwellings subject to the standards in the Zoning Resolution, be approved as
a part of the suMivision approval for the lots at least four (4)icrcs in size.
That the applicants shall pleparg ani submit protective covenants, articles of incorporationand other Homeownet's Association documents including by-laws wi1 bc submitted forrcview by the County Attorney prior to the approval of Oi finat ptat.
All mitigation proposed by the Division of Wildlife contained in their letter of July 6, 1990and septembff 24, l99l shall be considered conditions of approval . AU grazing is limitedto historic hay fields and individual catch pens will be limirca to 7500 sqlft..

That the following plat notes shall be included on the final plat:
"Prior to ttre issuance of a building permit, each lot will be staked and certified by a R.L.S.verifying building location within approved envelope."
"Portions of subdivision are in areas defined by FEMA as regulated floodplain. Minor
channel shifting has occurred in the past, and will likely continuJin the future. These shifts
can occur in events less than the theoretical I 00-year flood event."
"The minimum defensible space distance shall be 30 feet on level terrain, plus appropriate
modification to recogrize the increased ratc of firc spread at sloped sites. fire me*roaotory

and drainage plan consistent with the engineer's report submitted at preliminary plan,
showing the physical improvements necessary to mitigate the 1O0-year flooa flow from the
drainage basin located west ofthe county road."
"One (l) dog will be allowed for each residential unit within the subdivision and the dog
shall be required to be confined within the ownet's property boundaries, with enforcement
provisiors allowing forthe removal of a dog from the area as a final remedy in worst cases.,'
