over and across St. Finnbar Farm as shown on the Plat, said easement being for emergency aecess

(b) A nonexclusive easemeol l6v ingress and egress is hereby granted to all police,
sheriff, fire protecliort, ambulance and other emergency agencies servicing St. Finnbar Farm and
its residents.
9,8 Road Easement. There is hereby reserved a permatrent aud perpenral easemem for the
Road over and across St. Finnbar Farm as shown on the PIat, sairl easement being for the purpose of ttre
construction, maiutenance, repafu and replacement thereof and for the installation, mainrenance and repair
ofundergroundutilitiesarulforsuchotherpurposesasareprovidedinthisDeclaration, Declarauthereby
permanently and perpetually rledicates the Road for the use, benefit nnd enioyment of all Owners, their
family members, guests and invitoes and for use by employees of rhe Association. Once constructed by
Declarant, the Association shall be responsible for the maintenance, repair and replacement of the Road
including snowplowing. Declarant or the Aseociation shall have the right to install securify or enrry gates,
securiry gate house, fenses, signage, speed bumps or dips, culverts, guard rails and the like.
9.9 E4$qryents for Central Water System, Each of the Lots in St, Finnbar Farm is to bc served
by an individual well to be installed by Owners; provided however, should circumstances change where
the best interests of Owners of Ints in St. Finnbar Farm would be served by the installation, operation and
maintenance by the Association (or another entity performing such function) of a central water system,
there is hereby rcserved for such systemeasements ttie utility ea$efirents reserved under Section g.4 above.
9. i0 Easement and Fence-M4,iqlenance Oblieation. Reference is made io the easementdescribed
as "Parsel 1" in that certain Agreement, Easement Grant and Munral Release recordod in Book 597 at Page
616 of the real estale records of the Counfy, excepting that portion of said Parcel "8" cotrveyed to Ratptr
L. Braden by deed recorded in Book 725 at Page 792, The foregoing insrumerrt resolved a boundary
dispute between portions of St. Finnbar Farm and adjaceut Rensh at Roaring Forlr. Declarant hereby
eonveys m the Association all right, title and interest of Declarant in aud to said hstrument anrl easement
creatEd thereunder and the Association shall be responsible for the feuce mainterunco obligations set forth
in said instrument.
9.11 Fishing Easement. With respect to the Roaring Fork River, Lots 7, 8, 9 and 10 shall be
subjecttoafishingeaseme[trecordedinBook-,Page-,flSReceptionNo'-ofthereal

9.12 Ownership of Easements. Any easement$ or rights reserved by Declarant in Sections 9.2
and 9.4 above shall remain vested in Declarant until such time as Declarant has execumd and delivered an
instrument in writing transferring the same to the Association or arry succes$or or assign of Deolarant.

water rights application that may be filed by ttre Declarant or Association with respect to any water rights
reserved to Declarant or owned by the Association so long as such apptication does not seek to tanstbr
or divert such \ryater rights off St. Finnbar Farm or threateu injury to the Wetls reserved to any Lots. Each
Owner hereby irrevocably constitutes and appoints Declarant or ttre Association its attorney-in-fact to file,
joiu irr or object as Declarant or the Association deems appropriate in its sole cliscretion to any water rights
application affecting St. Finnbar Farm.
1l- SEWER-,$FRVICE DISCLOSURE. Pursuant to the Sewer Service Agreement, Bewer
service to St. Finnbar Farm is provitled by the Rauch Association which is a private homeowners
a$sociation entitled to establish rules and regutations for thc provision of such servise but which is not
subject to rules or regulations affecting public utililies. Declarant does hereby assign to the Association
the Sewer Service Agreemeut and the Association, by execution of this Declaration, hereby accepts said
assignment and hereby assuruos eaoh and all of Declarant's obligations and rights under said Sewer
Service Agreement. Without limit to the powers of the Association granted under Section 4.g above, the
Association shall heve such lien and assessment rights and the power to enforce such lien and assessments
as shall be suffroient to allow ttre Association to meet its obligations undsr the Sewer Service Agreement,
including the power to levy and collect etsffisrneffs AE$essme$g for zuch purpose without need for
Memberapproval.

17,. COLORADO IS A RIGHT-TO-FARM STA-TE. Colorado is a "Right- to.Farm" Sr*re
pursuant to Colorado Revised Statrrtes 35-3,5-101 e[, EEq. Landowuers, including Owners of L,ots itr Sr.
Pinnbar Farm, must be prepared to accept the activities, sights, sounds and smells of Garfield County's
agricultural operations (as defined in Colorado Revisecl Stanrrcs 35-3.5-102(2)) as a norraal and necessary
aspect of living in a County with a suong rural character antl a healthy ranuhing sector. Au agricultural
operation is not, nor shall it become, a private or public nuisance by any changed conditions in or about
the locality of such operation after it has been in operation for more than oue year, if such opcration was
not a truisanae at the timE the operstion began; exq,ept that this provision shall not apply in the case of a
negligent operation or when a change in operation would result in a private or public nuisance or when a
substantial increase in the size of operations ocsurs, ln the event of any amendmenl to Colorado Revised
Statutes 35-3.5-101, this Section 12 of ttre Declaration shall automatically be amended to conform to such
arnendment to said Colorado Stahrtes.
13. V,ARIANCES FROM DECI.{RATIQI{. The Assoeiation may, by the majority vote of
the members of its Board, gratrt rcflsotrable variances from the strict compliance with the provisions of ttris
Declaration in ttre case of undue hardship. The Owners of all of the l,ots sha[ be given at loasr meuty (20i
days advance written notice $ettiflg forth the time and place of the meeting of the Board at which any
request for a varianc+ is to be considered and doscribing the requested variance. Owners or their
representatives shall be afflorded the opporurniry to appear before ttre meeting of the Board and be heard
with respect to the requestod variance. Separate procedures are provided in Section 5.6 and shall be
followed with regard to variances from architectural controls.

On October 27,2000 and November 3, 2000 we conducted tests of the St. Finnbar Farm
Subdivision dry hydrant in conjunction with Wright Water Engineers. The system performed
according to expectation and meets otr requirements. We have also received the certification
documentation from Wright Water Engineers and High Country Engineering for submittal to
ISO (nsurance Services Ofiice) which we had requested.

Dear Mark:
I am writing on behalf of the St. Finnbar Land Company and the Roaring Fork Farm, LLC
("Owners"). In accordance with the terms of the Subdivision Improvement Agreement by and
between the Owners and the board of County Commissioners of Garfield County, each request
for pamial release of collateral must be signed by the Project Engineer, and shali certify that:
l. All costs for which the release is being requested have been incurred in connection
with the construction of the Improvements;
2. All work peiformed and materials supplied are in accordance with tlre plans and
specifications;
3. All work has been performed in a workmanlike manner;4. No funds are being requested for work not completed, or for materials not installed or
stored on site; and
5. The Project Engineer has inspected, approved and has certified that all such
improvements have been constructed in accordance with the plans and specifications.
Please consider this letter certification by the Project Engineer, High Country Engineering, Inc.
(HCE), that allof the foregoing requirements have been met up to the date of this request. The
January 2001 Payment Request from M&M Construction is attached hereto and incoiporated
herein by reference. The original amount of the Construction Costs for Public Improvements was
S1,010,562.30. We are requesting the funds in the amount of $996,270.30 be released and

Enclosed please find a revised Final Plat for St. Finnbar Farm (the ,,Plat,) and a revised
Subdivision lmprovements Agreement ("SlA'). The PIat and StA incorporate your comments and
respond to the issues identified in your letter to Ron Liston dated October 13, 2OOO.
To facilitate your review of the PIat and SlA, please note the following. The paragraph
numbers and letters below correspond to the numbers and letters in your letter. Also, I have
enclosed clean and redlined versions of the SlA.
l.Final Plat
The roads are identified as "being dedicated to the public,, in the Certification of
Ownership and Dedication.
The Title Company's Certificate has been replaced with the Attorney,s Certificate.
The Planning Commission Certificate has been removed.
All of the easements are now contained in plat note 7.
Plat note 7(b) conuins language granting to emergency agencies a non-exclusive
easement to use all private roads, access easements, driveways and other property.
Therefore, we have not separately dedicated to the Homeowners Association the
emergency access across Lot I I to CR 100.
The 100 year floodplain is shown on the plat.

2. SIA/Owners'Performance
a. The date of completion has been changed to December 3r,2ooo.
b. We have added the language you suggested concerning the Ranch's acceptance of
constructed sewer lines and receipt of payments; however we included the language
at the end of section 2(e)(l ) rather than as a new section 2(e)(3), because we
believe that is the more appropriate location.
c. We have added the language you suggested concerning release of the security for
the water system; however we included the language at the end of the first
paragraph of section 3(b) rather than as a new section 2(e)(4), because we believe
that is the more appropriate location.
3. Additional Issues Noted Reeardine the SlA.
a. The revised Fire District Fees are reflected in the SlA.
b. Sections 10 and I 1 of the SIA now incorporate the language you suggested.
4. Contract with Basalt Water Conservancv District. prior to the time of recording of the Final
Plat, we will provide the commitment of St. Finnbar Land Company to convey the contract with
the Basalt water conservancy District to the Homeowners Association.
5. Lender Subordination. The lenders subordinate their deeds of trust to the PIat in the
Mortgage Holder Certificates on the plat.

The Water Quality Control Division has reviewed and evaluated your site application and supporting
documentation received March 22,2000 and August g,2O0O for the St. Finnbar Farm Subdivision
Sewer Lift Station in the SW l/4, NE 1/4, Section 31, T7s, Rg7w, Garfield Counry.
We find your application to be in confonnance with the Water Quality Control Commission,s
"Regulations for Site Applications for Domestic Wastewater Treatment Works.,, Therefore, the siteapplication is approved with the following conditions listed below:
1.Based upon application information, the system design will be for:
Hydraulic Design Capacity - Average Daily Flow = 0.00g1 MGD
Peak Daily Flow = 0.020 MGD
Treatment process to be used - Duplicate pump sewer lift station.
The St. Finnbar Farm Home Owners Association will be legal owner and responsible for
operating the lift station and force main.
This site approval will expire one year from the date of this letter if the construction of
the project has not commenced by that date. If expiration occurs, you must apply for a
new site approval. Construction is defined as entering into a contract for the erection or
physical placement of materials, equipment, piping, eirthwork, or building which are to
be a part o a domestic wastewater treatment works.

approved with the following conditions:
4. The applicants registered engineer must furnish a statement prior to the commencement
of operation stating that the facilities were constructed in conformance with a approved
plans, specifications, and change orders'
5. The application request for a variance of Part 3.2.2.a.3. of the Design Criteria
Considered in the Review of Wastewater Treatment Facilities Policy 96-1 is hereby
approved.
Failure to comply with any conditions contained herein will render this approval void and another site
application will have to be processed.
In accordance with Colorado Water Quality Control Commission regulations, this approval is subject to
appeal as stated under Section 22.8(7) of "Regulations for Site Applications for Domestic Wastewater
Treatment Works".
This approval does not relieve the owner from compliance with all county regulations prior to
construction nor from responsibility for proper engineering, construction, and operation of the facility.
