Inproverneuts Agre€m€nt with the Board ofCounty Commissioners of Garfield County, Colcrado
(lrereinafter "Boardn), recorded in Book 1226 *Page 331 as Reception No. 574732 ofthe Garfield
County records on January 9, 2001, for the improvements of the St. Finnbar Frm nrMivisioq and
WHEREAS, the obligations of rhe Ovmer have been satisfied, as verified in attacbed
stat61rput from Leslie Hope, P. E., High Country Engineering, Inc. datod October 16, 2001, tbat
work has been corryleted consistent with improvements described in the Subdivhion ImProvemcnts
Agfeetrent.
NOW THEREFORE, at the request of ttr Owner and in consileration of the premiscs and
prior agrccrrents, the Board trereby acknowledges the satisfaction ofthe Subdivision kryroventeds
hgce*m eotered into by Ov,,ner and th€ Board for ttre release of security in the amunt of
$l-,010,562.30 for work completed consistent with inryrovements described in the Subdivision

l. Au costs for which the release is being requested have been incurred in connection
with the constnrction of tbe Improvements;
2. All work performed and materiats supplied are in accordance with the plans and
specifications;
3. All work has been performed in a workmanlike manner;
4. No funds are beingrequested for work not complcted, or for materials not installed or
stored on site; and
5. The Project Engineer has inspectcd, approved and has certified that all such
improvimens f,ave been "onstrucrcd
in accordance with the plans and spccifications.
