I. PROCEDURAL REQUIREMENTS
A. One of the following 3 procedures shall apply to a request for an Amended
or Conected Plat.
1 . Application for an amendment to a recorded plat may be made, if the amendment
a) does not increase the number of subdivision lots or dvrrclling units, b) results in
the major relocation of a road or add new roads, or c) does not result in the
relocation of property lines betureen more than tvr,o adjaent properties.
An application for an amended plat shall be considered by the Board at a
regularly scheduled public meeting. lf apprcved, the amended plat shall comply
with plat requirements outlined below (subseciion B).
2. An application for an amendment to a plat of an existing subdivision, established
prior to County subdivision regulations, that does not have an approved
Preliminary Plan to verify the consistency with the proposed amended plat, or
that results in the relocation of property lines betvrreen more than two (2) adjacent
properties, shall be subject to the criteria and public nreeting requirements as
follows:
A. The Board shall not approve an application for an amended plat as
mentioned above unless the applicant has satisfied the following criteria:
1) AllGarfield County zoning requirements will be met;
2) All lots created will have legalaccess to a public right-of-way and any
necessary access easements have been obtained or are in the process of
being obtained;
3) Provision has been made for an adequate source of water in terms of
both the legaland physical quality, quantity and dependability, and a
suitable type of sewage disposalto serve each proposed lo
4) Allapplicable state and localenvironmental health and safety
requirements have been met or are in the process of being met
5) Provision has been made for any required road or storm drainage
improvements;
6) Fire protection has been approved by the appropriate fire district;
7) Any necessary drainage, inigation or utility easements have been
obtained or arc in the process of being obtained; and
8) Schoolfees, taxes and special assessments have been paid.
B. The Board shall consider the amended plat request at a public hearing.
The applicant shall be solely responsible for the publication, posting and
mailing of all notices and shall present proof of publication and mailing at
or before the meeting. lf proper notice has not occuned, the public
hearing will not occur. Notice for the meeting shall be given as follows:
(1) Notice by publication, including the name of the applicant, clescription
of the subject lot, a description of the proposed amendment and nature of
the meeting, and the date, time and place for the hearing shall be given
once in a newspaper of general circulation in that portion of the County in
which the subject prcperty is located at least thirty (30) but not more than
sixty (60) days prior to the date of such meeting, and proof of publication
shall be presented at hearing by the applicant.
(2) Notice by mail, containing information as described under paragraph
(1) above, shall be mailed to allowners of record as shown in the County
Assessol's Office of lots within two hundred feet (200') of the subject lot
and to all owners of mineral interest in the subject property at least thirty
(30) but not more than sixty (60) days prior to such meeting time by
certified return receipt mail, and receipts shall be presented at the
meeting by the applicant.
(3) The site shall be posted such that the notice is clearly and
conspicuously visible frcm a public right-of-way, with notice signs
provided by the Planning Department. The posting must take place at
least thirty (30) but not more than sixty (60) days prior to the hearing date
and is the sole responsibility of the applicant to post the notice, and
ensure that it remains posted until and during the date of the hearing.
lf approved, the conec*ed plat shall comply with the requirements outlined below
(subsection B).
3. A conection may be made to an approved plat, if the sole purpose is to conect
technical errors such as minor surveying errors and drafting errors, and the
conection is consistent with the approved Preliminary Plan. Within thirty (30)
days of being deemed in technical complian@, the correcled plat shall be
brought before the Board at a regularly scheduled public meeting for review and
decision.
lf approved, the coneded plat shall comply with the requirements outlined below
(subsection B).
B. Upon approval of an Amended or Corrected Plat by the Board, the
following plat requirements shall apply:
A plat titled "Amended Final Plat of (subdivision name)" shall be signed and dated by the
County Surveyor, then signed and dated by the Chairman of the Board, as a consent
agenda item, at a regularly scheduled Board meeting, and recorded in the Clerk and
Recordeds Office of Garfield County within ninety (90) days of Board approval.
The Amended Plat shall meet the minimum Colorado Revised Statues ("CRS")
standards for land survey plats, as required by Colorado slate law, and approved by the
County Surveyor and shall include at least the information as outlined in Section 5:22
[Final Plat Requirements] of the Garfield
County Subdivision Regulations.
C. Application process steps:
1. Submit this completed application form, base fee, and all submittal requirements
outlined below to the Garfield County Planning Department. lt will be received
and given to a Staff Planner who will review the application for technical
compliance (completeness).
2. Once the application is deerned technically complete, the Staff Planner will send
you a letter indicating the application is complete and will requesl additional
copies for the Board to review. ln addition, shallthe request require a public
hearing, Staff will also send you a "Public Notice Form(s)" indicating the time and
date of your hearing before the Board. Prior to the public hearing, Staff will
provide you with a Staff Memorandum regarding your requested amended or
conected plat.
The Applicant is required to appear before the Board at the time and date of the
public hearing or public meeting at which time the Board will consider the
request. Should the request require a public hearing, the Applicant shall provide
proof, at the hearing, that proper notie was provided.
once the Board makes a decision regarding the amended or corrected plat
request, Staff will provide the Applicant with a follow-up letter outlining the action
taken by the Board.
APPLICATION SUBMITTAL REQU IREMENTS
(The following steps outline how an amended or conected plat application review
process works in Garfield County.)
A. The following application submittal requirernents shall only be applicable to
Procedurc 1 and 3 listed above in the "Procedural Requirements" section of this
application. The application for an amended plat or conected plat shall be
submitted with the following:

For Procedure 2 listed above in the "Procedural Requirements" section of this
application, the following supplemental information shall be submitted with the
application:
1. Nanative explaining why the amended plat is being requested.
2. A plat shall illustrate the parcel(s) prior to adjustment and following the
adjustment. The plat shall delineated the fathering and receiving
parcel(s) and/or boundary line(s) prior to adjustment, and the parcel(s) or
bou ndary line(s) transferred/relocated fol lowin g the adju stment.
3. copy of the deed showing ownership of the parcel(s), or a letter from the
property owner(s), if other than the applicant.
4. Names and addresses of owrers of record of land immediately adjoining
and within two hundred feet (200') of the proposed amended plat, mineral
owners and lessees of mineral owners of record of the property to be a
part of the amended plat, and tenants of any structure proposed for
conversion.
5. Evidence of the soil types and characteristics of each type.
6. Proof of legal and adequate source of domestic water for each lot created
(which may consist of proof described in Sedion B.a2(D) of the
Subdivision Regulations), method of serarage disposal, and letter of
approval of fire protection plan from appropriate fire district.
7. lf connection to a community or municipal water or sewer system is
proposed, a letter from the goveming body stating a willingness to serve.
8. The Applicant shall sign the "Agreement For paymenf'form and provide
the Base Fee of $100.00 with the application.
9. Provide 2 copies of the Application. Staff wilt request additional copies
once the application has been deemed technically complete.

GARFIELD COUNTY BUILDING AND PLANNING DEPARTMENT
AGREEMENT FOR PAYMENT FORM
(Shall be submitted with application)
GARFIELD COUNTY (hereinafter COUNTY) and Roaring Fork Farm LLC (hereinafter
APPLICANT) agree as follows:
1. APPLICANT has submitted to COUNTY an application for an Amended Plat
(hereinafter, THE PROJECT).
2. APPLICANT understands and agrees that Garfield County Resolution No. 98-09, as
amended, establishes a fee schedule for each type of subdiMsion or land use review applications,
and the guidelines for the administration of the fee structure.
3. APPLICANT and COUNTY agree that because of the size, nature or scope of the
proposed project, it is not possible at this time to ascertain the full extent of the costs involved in
processing the application. APPLICANT agrees to make payment of the Base Fee, establjshed for
the PROJECT, and to thereafter permit additional costs to be bitled to APPLICANT. APPLICANT
agrees to make additional payments upon notification by the COUNTY when they are necessary as
costs are incuned.
4. The Base Fee shall be in addition to and exclusive of any cost for publication or cost of
consulting service determined necessary by the Board of Coung Commissioners for the
consideration of an application or additiona! COUNTY staff time or expense not covered by the Base
Fee. lf actual recorded costs exceed the initial Base Fee, APPLICANT shall pay additional billings to
COUNTY to reimburse the COUNTY for the processing of the PROJECT mentioned above.
APPLICANT acknowledges that all billing shall be paid prior to the final consideration by the
COUNTY of any land use permit, zoning amendment, or subdivision plan.

Dear Mark:
Attached is a proposed amended plat affecting Lots 5 and 6 of the St. Finnbar Final
Plat. The proposed changes affect only the building envelopes in each of these lots.
There are no changes to the lot lines of any lots.
At the time of the origina! plat, the size of the building envelopes on Lots 5 and 6 were
confined by wetland mapping. Since that time, the irrigation practices in the field where
the building envelopes are located have been altered and the wetlands in this area
have receded.
Attached with this application is a letter from Gary Beach of Beach Environmental
documenting that the proposed building envelopes are free of any jurisdictional
wetlands. Gary had visited the site both prior to staking of the building envelopes and
again after the new building envelopes were staked in the field.
The expanded envelopes offer more flexibility in the placement of a residence and
accessory structures. Building envelopes on adjacent lots are a significant distance
away, across Blue Creek and are not impacted by the changes to the envelope
configurations on Lots 5 and 6. The distance between these newly defined envelopes
is slightly greater than that shown on the recorded plat.

Dear Mr. Liston:
I have recently completed an additional site evaluation of the building envelopes on
Lot 5 and Lot 6. This was completed in late October: it was a warm and sunny day,
there were all conditions precedent to determine whether or not jurisdictional wetlands
occur on or adjacent to these parcels.
The finding of my most recent reconnaissance is similar to previous trips and I have
determined that jurisdictional wetlands do not exist upon or within the building
envelopes for Lot 5 or Lot 6 of the St. Finnbar development. It is important to note,
however, that a couple of small areas within the east portion of Lot 5's building
envelope do contain vegetation that is typical to wetland areas, but these are not
jurisdictional wetlands since there is no evidence of hydric soils. I made several soil
bores to a depth of approximately 17 inches and no evidence of peraquic conditions
exist. The wetland type of vegetation included Nebraska sedge and Colorado juncos,
with a perimeter community of willow.
As I ha.,ze explained. previously, thesc 'willow, sedgcs, & juiicus can exisi in areas
where irrigation water is routinely applied to the land, as they find the abundance of
water suitable to their growth. Their mere existence, however, does not constitute a
finding that jurisdictional wetlands exist.
With regard to Lot 6, this envelope has a growth of Colorado juncus in the north
quarter ofthe envelope, but, again, soil bores did not show any evidence ofhydric
soils, or the reduction of minerals occurring within the soils, and, therefore, although
some wetland-type grasses occur in this area, the site is not a jurisdictional wetland.

The area down gradient of both Lot 5 and Lot 6 has been appropriately staked
previously as both riparian and wetland areas. The conidor along Blue Creek, which
is adjacent to these building envelopes, contains the three parameters necessary to f,rnd
that these wetland areas are jurisdictional in nature, and provide significant value to
the Blue Creek ecosystem. As you have properly described, no development should
occur within this area.

Dear Mr. Jarman:
We are respondlng to your March 28, 2006, request for
comments on the Roaring Fork Farm, LLC & Finnbar Land Company,
amended plat application. This project is located at Latitude
39" 24t L2.}tt, Longitude 7O'7" gt 20.6", Section W L/2 37,
Township 7 South, Range 87 West, near the Roaring Fork River,
within Garfield County, Colorado.
The Corps of Engineers' jurisdiction within the study area
is under t.he authority of Section 404 of the Cl-ean Water Act. for
t.he dj-scharge of dredged or fill material into waters of the
Unit.ed States. Waters of the United SLates include, but are not
limited to: rivers, perennial, ephemeral, or inLermitLent
streams, lakes, ponds, wetlands, vernaf pools, marshes, wet
meadows, and. springs. Project features that result in the
discharge of dredged or fiII material into waters of the United
States will require Department of t.he Army authorization prior to
starting work.
We have previously verified wetlands at the St. Finnbar Farm
Subdivision by l-etter dated August L9 , L997. This verif icat.i-on
was valid for a period of 5 years from the date of this fett.er.
Howewer, we have not had the opportunity to review any recent
data used to modify (expand or el-iminate) the limit.s of federal
jurisdictlon under Section 404 of the Clean Water Act at this
project site.

As we discussed yesterday, the 120 day period in which to produce a wetlands
verification letter from the US Corps of Engineers, included as a condition of the Board
of County Commissioners approval of the St. Finnbar Plat Amendment of the Lot 5 and
Lot 6 Building Envelopes, has passed as of September 1tt. Unfortunately, the Corps
has still not responded to our submission requesting a letter of verification. The
surveyed wetlands mapping was submitted to the Corps of Engineers by Beach
Environmental, in mid June. Gary Beach recently spoke with Mark Giffillan in the Corps
of Engineers office in Grand Junction and confirmed that our submission had been
received but that due to his heavy work load he did not know when hew would be able
to complete a review of the submission and issue a letter. Mark offered to Gary that he
had briefly reviewed the package and did not anticipate any challenge with the
verification request.
Given this challenge with the Corps letter, I respectfully request that the 120 day time
period described in Condition #4 as listed in your letter of May 3, 2006 be extended by
the Board of County commissioners for an additional 120 days. Hopefully that will give
the Corps time to respond.
