2. AppLICANT understands and agrees that Garfield County Resolution No. 98-09, as amended,
establishes a fee schedule for each type of subdivision or land use review applications, and the guidelines for
the administration of the fee structure.
3. APPLICANT and COLTNTY agree that because of the size, nature or scope of the proposed
project, it is not possible at this time to ur&.tuin the full extent of the costs involved in processing the
application. APPLICANT agrees to make payment of the Base Fee, established for the PROJECT, and to
thereafter permit additional iosts to be bilied to APPLICANT. APPLICANT agrees to make additional
payments upon notification by the COUNTY when they are necessary as costs are incurred.
4. The Base Fee shall be in addition to and exclusive of any cost for publication or cost of
consulting service determined necessary by the Board of County Commissioners for the consideration of an
applicatio-n or additional COLINTY staff time or expense not covered by the Base Fee. If actual recorded costs
exieed the initial Base Fee, APPLICANT shall pay additional billings to CoLINTY to reimburse the COLTNTY
for the processing of the pROJECT mentioned ubor". APPLICANT acknowledges that all billing shall be paid
prior to the final consideration by the COUNTY of any land use permit, zoning amendment, or subdivision
plan.

Thank you fbr your lettel dated January 21,2009. l'he pulpose of this letter is to anstt'er
questions raised in your letter in order to rnove the proposcd amended plat application fonryard.
With respect to item number 2 in your letter, I note tliat Courerica Bank is the primary
lencler on tlte rubj."t properly, ancl the proposed plat includes a "lien holder consellt" evidencing
tlieir approvnl of the amended plat. Is there something more we need on the proposed plat, or
will this be sufficient?
Item number three in your letter asks about the purpose of this application and tlie
expansion of the existing building envelopes. As you may or n'Iay not lurolv, the subject property
contains jurisclictional rvetlands under the authority of the U.S. Atruy Corps of Engineers. The
original delineation of the wetlands significantly limited the size and location of the original
builcling envelopes. In April 2008, the U.S. Army Corps of Engineers approved a jurisdictional
cletermination for the St. Finnbar clevelopment, accepting a Marclt 14, 2007 Wetland
Delineations Report and upclated map subrnitted for approval on April 15, 2008, evidenced by
t[e enclosed letter frorn the U.S. fu'rny Corps of Engineers dated April 23, 2008. The approval
of the jurisdictional wetlands detennination reduced the amount of jurisdictional wetlalds
affecting the subject property by over frve acres, therefore alloiving fbr different and expanded
configurations of the building envelopes. Li light of tiris updated rvetlands delineation, tlte owner
of the subject property desires to modifu the building euvelopes on the lots.
With respect to itern number 5 in your letter, thele is a hotleorvners association for the St.
Finnbar Fanns subdivision (the "HOA"). However, I understand fi'om my client that no approval
is required fi'om the HOA, Site and Architectural Revierv Comtnittee or neighboring property
owners.

Finnbarr Farm sketch plan. This is a unique site dominated by riparian

undertaken and completed a wetland evaluation and dclirreation of the St. Firrnbar
Properfy, along Blue Creek, near Carbondale, Colorado. The attached report is
intended to provide you u,ith a summary of our findings and irrcludes a request for
changing a prior delineated rvetland boundary. The change results from a cessation of
irrigation that occurred shortly after the earlier delineation was completed and Inay have
been influerrced by the extended drorrght {i'oni 1998 through 2003. These changes
appear to have resulted in the elirnination of the hydrologic component from a portion
of the prior delineated wetland area.

This report and all u,ork completed to delineate rvetlands upon the St. Finnbar Fartn
Subclivision has been cornpleted in accordance rvith the l9B7 "Corps of Engineers
Wetlands Delineation Maiual." The fielcl rvork was cotnpleted on May l5'r'and May
26th,2A06 at the request of Mr. Ron Liston, agent tbr St. Finnbar, rvltose address is 918
Cooper Avenuc, Glenwood Springs, Colorado 81601. Mr. Liston's telephone is 970-945-
2246.
A study completed in 1997 resulted in a finding by the delineator, and verified by the
Corps, that jirisdictional rvctlands existed .,pon th" property known as Lot 5 and Lot 6 of
the 3t. Finnbar Farrn Subdivision. The verification of the u'etland boundaries by the
Corps u,as valid for a period of five years (until August 19,2002). Irrigation of these
properties rvas ceased in 1997 and the land no longer exhibits the satne characteristics
ihui upp.or.d to exist h 1997. This report describes the changes in findings that has
o..r.i"d in the intervening nine years. The cessation of irrigation has elilninated the
hydrologic connection that led to the existence ofjurisdictional rvetlands itt 1997.
Pronerty Description. Location and Acreage Evaluated
The properfy evaluated includes approxilnately 13.407 acres on Lot 5 and I 1 '493 acres
on Lot 6 rvithin the St. Finnbar development in unincorporated Garfield County,
Colorado. The property is located approxitnate ly one-quarler mile southwest of the
intersection of Coulty itoad 103 uud Stut.llighrvay 82, approxirnately trvo miles east of
Carbondale, Colorado (near Catherine's Store) in the tvest one-half of Section 31,
Township 7 South, Itange 87 West of the Sixth Principle Meridian. The property is
located along the right bank of Blue Creek, a tributary to the Roaring Fork River and
includes uplands. open rvater (Blue Creek), grass rvetlands and riparian corridor areas
along BIue Creek. PI.ur. see the site location map attached as an appendix to this report.
'Ihe propsrty is primarily populated by upland vegetation including; narrorv-leaf
cottonwood, Mountain wiilorv, Wcstern alder, Russian olive and grasses such as tirnothy,
slender rvheatgrass, and smooth bronre. The study area included all of lots 5 and 6'
including open pastures, ditch courses on and off the properry, Blue Creek and
irnmediaiely adjacent properties. Wetlands rvere found to exist itt several areas and are
included in the attached maPPing.
The lands evaluatecl are completely rvithin the Blue Creek rvatershed and are located
betrveen the right bank of the creek to the south and rvest of these lots and an unnaned
ditch to the nolth of both lots. A comprehensive evaluation of the hvo lots including
proposed building envelopes and the previously delineated tvetland areas \Yas cornpleted
inciu6ing a sturly of vegeiation, hydrology and soils. As rvill be described belorv, only
those areas below the topographic break between the historic pasture areas on l-ots 5 & 6
and areas incllded rvithin lorvlands surrouncling these properties contain conditions
l
necessary to support a jurisdictional rvetlands.
The ternperature during the hvo field evaluations was approsirnately 75 degree
Fahrenheit under a moitly clear sky. The days preceding the field \t'ork \t'eLc dry and no
unusual conditions existed rvhich rnight have altered the findings of the study- Neither
floocl nor dr6ught conditions u,ere noted and irrigation of the property had not occurred
prior to the investigation. Mr. Liston confirnred that irrigation of the property $'as ceased
in 1997 or 1998. 'fhc conclition of the ditches historically carrf itlg irrigation \\'ater to
these lots appears to support that statement.
Work to delineate rvetlands included the subject property between the north property linc
(and beyond) to Blue Clreek at the southern and western edge of the properties' A
,lroinagl way to the east of the propeffy was also evaluated and niapped to include-
jurisdiltional rvetlands. The nvo lots are prirlarily populated by native grasses and
lltroduced pasture grasses. Vegetatiorr surrounding the lots includes narrou'-leaf
cottonrvoodi, tnountain willorv, western alder, Russian olive and quaking aspell'
Vegetative cover at the grass/forb level includes native grasses, sedge, rush, and various
bro-ad leafs including plupreless thistlc. A ivillorv cornmunity exists printarily on tlre
perimeter of both properties as a resrtlt of lorver topography artd influence by Blue Creek
and other irrigation ditches.
The proposed building envelopes Iie errtirely within the historically irrigated areas of the
trvo iotsand ur. ,"prrutrd by a gravel roacl. As depicted on the attached delineation map,
the building envelopes are located near the center ofeach lot, adjacent to the gravel road
and at a higher topographic elevation than areas detennined to qualify as wetlands.
The delineator established the dominant vegetative species of the pastures are ttative and
introduced pasture grasses (although rushes andjuncus rvere also in abundance in several
areas). Hydric soilionditions and domirancc of hydrophytic vegetation r.r'ere fottnd to
exist in aijacent areas not to be impacted by the proposed activity rvithin the building
envelopesl I-Iydric soils rvere foun<I through nurnerous soil bores to the west and south of
the two lots in lorv areas adjacent to Blue Creek and to the north and east in lorv areas
rvhere seepage u,ater fron other ditches provide saturated sonditions'
Ditches irnmediately surrounding the pastures rvere dry altd soil bores into the bottorn of
these difches indicates mineral reductions had occurred in the past at a point
approximately six inches belol the bottorn of the I 5 inch deep ditch ' No saturated soil

conditions $,ere folrnd rvithin or immcdiately adjacent to the proposed building
envelopes. As verified by other soil bores and soil pits, rttoist soils were not ellcountsred
i1 any tf tn" pits or borei but reducing soils rvere notecl belorv 2l inches in sotne but not
all of:the pits/bores. One soil pit dug io 30 inches in the micldle of Lot 6 rvas dry to the
bottom of the pit.
Justifi cation for Wetland Boundaries
The u,etland boundaries indicated on the attached dralvirrg u'ere field established by
Beach Environmental at lirnits defined by conditions including hydrologic, vegetative'
soil and topographic break points. Numerous soil bores and soil pits rvere completed
across the irvo lots ancl ,ro,l. .n"or.,,rtered saturated soils rvitlrin the area desigrrated for
building envelopes.
Jurisdictional rryetlarrds do exist rvithin Lot 5 and Lot 6, as shorvn on the attached
cjelineation map, but these u,etlan<Js clo not occur rvithin the area of the proposcd building
envclopes. The wetlands delineated included saturated soil conditions, a dotninance of
phreatophytic and hydrophytic vegetation apcl the existence ol'hydric soils' Analysis of
soils in these areas "onnr*"d the ieduction of iron to varying degrees. A Munsell soil
color chart was used to identifo the hue, value ancl chrolna of the soils and to deternine
the corresponcling col0r and proportions of thc reduced iron mottles.
Noted Field Conditions
As stated previously, Lots 5 and 6 of the St. Finnbar Famrs Subdivision rvere evaluated
to cletermi;e the existence of rvetlands upon these propelties. While u'etlands rvere found
to exist on both lots, the u,etlancl trounrlaries have rececled lrorn their delineated location
in 1,997. Tlris retreat appears to be directly related to the cessation of irrigation in 1997
apcl the rerloval of flood irrigation from these lands. New rvetland boundaries have been
established in areas rvhere thi topography slopes to stream, ditch or drainage corridors'
Earlier rvork completed to identify r.vetlands upon Lots 5 and 6 tl'as consulted prior to
eonpletilg the May delineation. Mapping from the 1997 delineation indicates wetlands
in areas that no longer qualiff as rvetiands. This may be a result of cessation of irrigation
but may also be a result of a hr" y"ot clrought during this sartle period' Hydrologically'
this area of Colorado went through 5 years of drought behveen 1998 and 2002, n'ith 2002
being the driest year of record in westertr Colorado. Since 2002, precipitation has
increased and 2005 and 2006 receivecl above average snowlalls and sumtner rains'

A soil pit dug in the bottom of a ditch to the east of Lot 5 shorved moist soils at 30"
below the surlhce of tlie pasture. Iron reductiotts rvere noted at a point 23 inches belorv
the pastures surf-ace.
Hvdrolosic Source
Tlre source of u,ater tbr the delineated rvetland areas is surface rvater from Blue Creek
and seepage and return flolvs fi'om irrigation ditches ad-iacent to Lots 5 and 6' These
rvetlands lies outsicle of the proposed birilding envelopes fbr Lots 5 and 6 and proper
hydrology to support a jurisdicfionalrvetlands rvas not present rvithin the building
env"top"i but is preseni in other areas ofLqts 5 and 6. See attached nrapping'
Plant Cornmunities Noted
The property is located in Garfield County at approximately 6,260'MSI-. The dorninant
'egetative
communities upon the property include native grasses such as nrountain
foxtail, rvheatgrass and broure, intioduced grasses such as crested wheat grass, and
shrubs such as serviceberry and rvillolv. Tiees surrounding the building envelopes for
Lots 5 and 6 contained priir:arily uarrolr,-leaf cottonrvoods rvith an occasional aspen,
spruce and Russian nlive.
The vegetative community of the delineated wetlands includes Nebraska sedge (carex
nebrasiensi.t), variegated scouring rwh (Equiselum variegatunt)-, Colorado rush (Jurzctt's
conJilsus) and grasses including niountain foxtail (Alopecurus alpinus), and slender
rvheatgriss @[ropyron rrachyiaulunr). Tbe shrub layer of vegetatiori rvithin the
rvetlands includes western alder Qllnu's tenuiJblia) and mountain rvillorv (Saix
nrunlicolu).
Ths $,etland indicator status of the sedges and rushes contained on site is obligate. Tlie
indicator status of the rush is obligate arrd the s,etlanrl intlicator lbr the alder is lacultative
rvet and mountain willorv is obligate. Consequently, the dorninant vegetative species
rvithin the rvetland boundary haie a 67Yo to 9l9o/o ptobability of occurrellce in rvetlands'l

Soil Description
'Ihe soils of the St. I?innbar property include those cotnprised prinrarily of decornposing
sandstones ancl irrclude fluvaquents and Redrob loanrs' Fluvaquents are deep and
somerv|at poorly drained. They are lbmred in alluvium derived domirrantly liorn
sedimentary rock such as sandstones and shales. The sitc evaluation confirmed the
existence of these soits on-site and the existence of alluvialmaterials carried by Blue
Creek. This soilunit rvas identified in areas belorv the pastures of Lots 5 and 6.
Redrob soils are also deep poorly drained soils. They forttted in alluviurn dcrivcci from
sandstone and shalc. Thcse loams lvere noted on site and often appeal'with the
fluvaquents notecl above. Permeability oIthese soils is nroderate at the surface and rapid
in thel.est of the soil profile. This is the soil unit identified in the pasture areas of Lots 5
and 6.
Observed Interstate or Foreign Comnterce Cclnnection
No connection to any interstate or foreign cornmerce tvas noted, including; no recreati0n
or other use by travelers; no sale offish, shellfish or othcr aquatics appeared to be
possible; and ihere was no industrial, agricultural or collllnercial use of the St. Finnbar
Property being rnade at the tirne of the rvetland evaluation/delineation.
Waters of the United States
Blue Creek is a florving perennial stream that abuts the trvo lots to the south and Lot 6 to
the rvest. Other thal Blue Creek, the rvetlauds and florving ditches identified hereiu, t'to
special aquatic sites rvere noted on the property. Numerous ditches traversing the
building envelopes frorn east to west were dry. One ditcli running across the north part
of bothlots u,as flowing and influencing vegetation on both sides of the ditch. The active
clitch appeared to have been maintained in accordattce with local custom and standards'
There ivere several areas of the property rvhich evidenced crossings by deer and small
lnammals. There rvas no indication of any rvaterfou,lor other migratory birds upon the
property during the field investigation, horvever several harvks and one bald eagle n'ere
present in the cottonrvoods along BIue Creek.

Pror:osed Activities and Conclusions
No activities are proposed u,ithin the delineated rvetland area. 'I'his tvetlands delineation
report has been prepared to re-confirrr prior rvetland boundaries or to establish tterv
boundaries resulting liorn changed conditions upon the property. It is clear that
conclitions upon the properfy have changed sirrce 1997 due to drought conditions betrveen
I998 and 2003, and a cessation offlood irrigation practices at both Lots 5 and 6 ofthe St.
Fin6bar Farms Subdivisiorr. These changed conditions have led to the receding of prior
wetland boundaries to areas not subject to saturation frorl flood irrigation'
Areas historically irrigated lie 20" to 30" higher in elevation tlran the areas delineated as
jurisdictional wetlands. The ivetland areas contairr saturated soils, hydric soil indicators
and a dominance of hydrophytic vegetation. IJistoric pasture areas that previously rvere
delineated as wetlands no Ionger contain the hydrologic characteristics noted in 1997.
This appears to be a result ofboth anthropogenic and natural changes to the lands'

Dear Mark:
As a follow-up to our field investigations on April 19,2007,I have reviewed our file to
provide the additional information you requested. I am attaching a photocopy of the
mapping provided to you earlier, which shows the location of Soil Bore #l and well as
highlighting the other five soil bores. You and I were correct in assuming that Soil Bore
No. I was in the area previously delineated by Rink as being jurisdictional. I am also
including photocopies of the Routine Wetland Delineation Data Forms for your review.
I am sorry to say they are not as complete as we usually prepare them but I chose to send
them to you in the form they were in.
You will note that the Data Forms support a finding that the wetlands that may have
been apparent in 1993-1997 are no longer in existence. It would appear that the lack of
irrigation water since 1997 has removed the hydrology and dominance of vegetation that
may have led to the previous finding. As you and I witnessed, on the 19th, there was no
hydric indicators in the soil near the west end of the property and hydrophytic vegetation
is no longer the dominant species.

WHEREAS, St. Finnbar Land Company filed an application with the Board of co*ntycommissioners of Garfield county for approval of Preliminary Pian for the st. Finnbar subdivision; and
WHEREAS, the Garfield Courty Planning Commission reviewed the St. Finnbar preliminary plan

WHEREAS, based on the material subrnitted by the applicant, the recommendation of the planning
Commission and the comments of the Garfield County Planning Department, this Board finds as follows:
I' That proper publication, publi_c notice and posting was provided as required by law for thehearings. before the Planning Commission and Board oi County Commissioners.
2' That the hearings before the Planning Commission and Board of County Commissionerswere extensive and complete, that all pertinent facts, matters and issues were submitted andthat all interested parties were heard at that hearings.

in the Comprehensive PIan for the unincorporated area of the County.
5. That all data, surveys, analyses, sfudies, plans and designs as required by the State of
Colorado and Garfield County have been submitted, reviewed, and found to meet all sound
planning and engineering requirements of the Garfield County Subdivision Regulations.
6. That the proposed subdivision of land conforms to the Garfield County ZorungResolution.
7. That for the above-stated and other reasons, the proposed subdivision is in the best interest
of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of
Garfield County.
NOW, TIIEREFORE, BE IT RESOLVED that the Preliminary Plan of St. Finnbar Subdivision for
the turincorporated area of Garfield County described in the application, be approved with the following
conditions:
All representations made by the applicant at the public hearing and in the Application shall
be considered conditions of approval, unless specified otherwise by the Board including, but
not limited to, the following items listed below.
The Homeowney's Association shall be incorporated in accordance with Colorado Revised
Statute requirements.
The applicant shall prepare and submit a Subdivision Improvements Agreement addressing
all on-site improvements, prior to the submittal of a final plat.
The applicants shall submit improvement plans for all roads, bridges, utilities, fire protection,
improvements signage and drainage structures prior to the submittal of the final plat. That
all roadways shall be constructed in accordance with the design standards in effect at the time
of submittal of the Final Plat, except for the variances approved by the Board
That the applicant shall pay the appropriate School Site Acquisition Fees prior to the
approval of the Final Plat.
Prior to the approval of the Preliminary Plan, the Applicant shall submit documentation that
would.allow the State Department of Water Resources to recommend approval of the
project's water supply.
That the building envelopes be in an additional 10', to resolve the potential conflicts with the
floodplains designations.
That the fisherman's easement be made a public easement very clearly in the covenants and
on the plat and consistent with the Division of Wildlife comments.
