AND MAINTENANCE OBLIGATIONS
THIS DECLARATION is made this day of
2017, by Jarad B. Elder ("Declarant") whose address is 227 N. Meadow Drive, Rifle, Colorado
81650.
WHEREAS, Declarant is the owner of two tracts of land known as Lot 1: 4280
County Road 331 and Lot 2: 0066 Chipperfield Lane, Elder Minor Subdivision, according to the
Final Plat recorded contemporaneously herewith in the Office of the Clerk and Recorder, County
of Garfield, State of Colorado (collectively the "Lots"),
WHEREAS, Declarant is also the owner of a water well (the "Well") located on
Lot 1 and permitted under Colorado Division of Water Resources Well Permit No. 55921-F for
ordinary household purposes inside two single family dwellings, irrigation of not more than
2,000 square feet of lawns and gardens, and the watering of two head of livestock and a well
system to deliver the water to both Lots including a pump house and pipelines (the "Water
System").
WHEREAS, by this Declaration, it is the intent of Declarant to establish a regime
governing the joint use of the Well and Water System by the owners of the Lots (collectively the
"Owners'').
NOW THEREFORE, Declarant sets forth the regime governing joint use of the
Well and Water System by the Owners of the Lots as follows:
1. The Owner of Lot 2 shall be deemed to own an undivided one-half (1/2)
share of the Well permit, Well and the Water System including the related pump, fittings at the
Well head, meters (whether existing now or to be installed at a later tine), pump house, cistern,
foot valves, and any pipes or pipelines and any other structures which are jointly used.
2. The Owner of Lot 1 shall be deemed to own an undivided one-half (1/2)
share of the Well permit, Well and the Water System inchiding the related pump, fittings at the
Well head, meters (whether existing now or to be installed at a later time), pump house, cistern,
foot valves, and any pipes or pipelines and any other structures which are jointly used.
3. No Owner is deemed to have any ownership right in and to any pipe,
pipeline or other structure used or required solely by the Owner of the other Lot which may
utilize a portion of the water flowing from this Well and its structures. This Declaration does not
relate to such individually owned or used rights or structures. Nothing in this Declaration shall
be construed to give any Owner any rights to such non -shared property of the other Owner or to
obligate either Owner to pay any costs associated with non -shared structures.
4. The Owners shall cooperate with each other at all times in all matters
necessary to promote the proper functioning and use of the Well and Water System to provide an
optimum water supply on demand at all times possible based upon the natural availability of
water. The Owners shall not waste water and shall endeavor to use no more than their respective
share of the available water. At this time, no individual water meters are installed. If at any time
after the date of this Declaration, either Owner requires that meters be installed, then each of the
Owners shall install meters at their individual expense. Waste or over -use shall be deemed to be
a violation of this Declaration for which the non -defaulting owner may seek remedy at law or
equity for damages or for injunctive relief or both.
5. The Owner of Lot 2 shall use no more than one-half (1/2) of the water
legally allocated to the Well and the Owner of Lot 1 shall use no more than one-half (1/2) of the
water legally allocated to the Well. Irrigation uses shall be limited to not more than 750 square
feet of lawn and garden irrigation on Lot 2 and 1250 square feet of lawn and garden irrigation on
Lot 1. In the event the water physically available from the Well is less than the legally available
amount, each Owner shall proportionately reduce the consumption of the water to the amount
actually available. Any household use of the Well water must provide for return flow through an
onsite waste treatment system of the non -evaporative type, returning the water to the watershed
in which the Well is located.
6. Declarant has previously constructed the Well and Water System; other
wort: required on shared components of the Well and Water System, including electrical charges,
to cause the water at the Well to become and remain available to deliver water to the Owners
shall be shared by the Owners in proportion to their share of ownership in the Well. This
Declaration shall relate only to costs incurred after the date hereof.
7. The Owners agree to cooperate on the fixture maintenance, operation,
repair, replacement or improvement of the Well, Water System aild all common facilities. In the
event the Owners are unable to agree on any required maintenance, repair, replacement or
improvement, either Owner shall be entitled to undertake the minimal maintenance, repair,
replacement or improvement necessary and essential for proper functioning of the common
facilities. In the event an Owner determines to undertake such work unilaterally, such Owner
shall notify the other Owner in writing. The Owner undertaking the work shall, upon
completion, provide the other Owner with a written statement of work performed and the other
Owner's proportionate share of the cost of same. In the event an Owner fails to pay the
proportionate share of any amount due within thirty (30) days after presentment, the Owner
which has paid such cost and expense shall be entitled to pursue any remedy available at law or
in equity. The Court, in its discretion, may award to the prevailing party Court costs and
attorney's fees incurred.
S. Declarant hereby creates and dedicates to the Owner of Lot 2 a permanent,
non-exclusive easement across the portion of Lot 1 for a Well and Water System Easement.
which will be identified as "'0' Utility Easement" on the Final Pkat of Elder Minor Subdivision,
recorded contemporaneously herewith in the Garfield County Clerk and Recorder's Office, for
the Owner of Lot 2 to receive water from the Well.
9. Each Owner shall not interfere at any time with the proper use by the
other Owner of his or her interest in any water structure and shall indemnify and hold harmless

the other Owner and users from any loss or damage or injury caused by the acts of the
indemnifying owner.
10. The term hereof shall be perpetual. The ownership of the Well and Water
System and the easement granted herein is appurtenant to Lot 1 and Lot 2 of the Elder Minor
Subdivision and such easement may not be transferred, assigned or conveyed apart or separately
from the respective Lot. This Declaration and the provisions contained herein are intended to and
shall run with the titles to those real properties described as Lot 1 and Lot 2, Elder Minor
Subdivision, and shall be binding upon and inure to the benefit of the Owners thereof, and their
successors and assigns. The laws of the State of Colorado shall govern the validity, effect and
construction of this Declaration. This Declaration may not be modified in any manner except by
an instrument in writing signed by the Owners of each of the Lots.

ISSUANCE OF THIS PERMIT DOES NOT CONFER A WATER RIGHT
CONDITIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit
does not assure the applicant that no injury will occur to another vested water right or preclude another owner of a vested
water right from seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval
of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation
Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37-90-137(2) on the condition that this well is operated in accordance with the Debra Kay
Engelhardt Augmentation Plan approved by the Division 5 Water Courtin case no. 2000CW 10. If this well is not operated in
accordance with the terms of said decree, it will be subject to administration including orders to cease diverting water,
4) Approved for the expansion of use of an existing well, permit no. 112035 (cancelled). This well is known as the
Engelhardt Well.
5) The use of ground water from this well is limited to ordinary household purposes inside two (2) single family dwellings,
irrigation of 2,000 square feet of lawns and gardens, and the watering of two head of livestock.
6) The maximum pumping rate of this well shall not exceed 15 GPM,
7) The annual withdrawal of ground water from this well shall not exceed 0.934 acre-foot.
8) The return flow from the use of this well must be through an individual waste water disposal system of the
non -evaporative type where the water is returned to the same stream system in which the well is located.
9) The owner shall mark the well in a conspicuous place with well permit number(s), name of the aquifer, and court case
number(s) as appropriate. The owner shall take necessary means and precautions to preserve these markings.
10) A totalizing flow meter must be installed on this well and maintained in good working order. Permanent records of all
diversions must be maintained by the well owner (recorded at least annually) and submitted to the Division Engineer upon
request.
11) This well shall be located not more than 200 feet from the location specified on this permit.

This permit to construct a well and divert water for beneficial use was issued on 6/19/2001. The expiration
date of the permit is 6/19/2002. In order for the permit to remain valid, certain actions must betaken by the
well owner and documentation must be received prior to the expiration date of the permit. As of this.date, a
completed Statement of Beneficial Use form or a request for extension of the •expiration,date has not.been
received by the Division of Water Resources.
The permit was approved under Section 37-90-137(2), Colorado Revised Statutes. Under the statute; the -
well must be constructed, pumping equipment installed and water diverted for beneficial use prior to the .
expiration date of the permit. In order to affirm that the well was used prior to the expiration date,.the- well
owner must complete and submit a Statement'of Beneficial Use, Form No. GWS -10. The completed form
must be received by the Division of Water Resources prior to the permit's expiration date. A blank Statement
of Beneficial Use form was provided with the copies of your original permit.
If the well is not in use, the well owner may request, in writing, a one-time, one year extension of the
expiration date. The request must be received with a $60.00 (sixty dollar) filing fee prior to the expiration date
and must provide a reason or reasons for not having the well in use and why the expiration date should be
extended for an additional year.
If the well has been constructed, pumping equipment installed, and water will not be used until after the
expiration date of the permit, the permit expires and will be of no force or effect. It will be necessary for you to
obtain a new well permit by submitting a completed application for an existing well along with a $60.00 (sixty
dollar) filing fee.
If the expiration date has already been extended for one year, the statute does not allow more than
one extension of time. If the well is not in use and the Statement of Beneficial Use is not received by
the expiration date, the permit expires and is of no force or effect.
If the well has not been constructed, and you do not wish to pursue construction of a well, please advise us in
writing in order that we may formally expire the permit without requiring additional notification.

INTRODUCTION
Debra Kay Engelhardt is the owner of a 5 acre of land in Garfield County at 4280 331 Road. The
parcel is located in the Dry Hollow Creek drainage more specifically in the NW'/4 NE'/a, Section 34,
Township 6 South, Range 92 West, 6th P.M. (see attached Location Map, Figure 1).
Ms. Engelhardt holds well permit No. 112035. It is an exempt well permit which allows for
ordinary household uses inside a single family home. Ms. Engelhardt proposes to construct a
second dwelling on the property and include lawn and landscape irrigation for 2,000 SF and
stockwater for two horses out of the well.
The additional uses are not allowed under the existing permit. The purpose of this report is to
provide the information necessary to file application for water rights and a plan for augmentation
in Division 5 Water Court, which water rights and plan for augmentation will cover the proposed
uses for the well.
WATER REQUIREMENTS
The water requirements for the Engelhardt property consist of two single family homes at 320 gpd,
per home (640 gpm), two head of livestock at 11 gpd each (22 gpd), 2,000 square feet of lawn
and landscape irrigation at 2.74 acre feet per acre and evaporation from an on-site pond at 3.02
acre feet per surface acre.
The consumptive uses are 15% domestic, based on septic tank/leachfield wastewater treatment
system; 100% of livestock water; 80% of irrigation water based on sprinkler application and 100%
of pond evaporation.
Table 1, Water Requirements, shows the monthly distribution of the diversions and consumptive
use of water for the property. The total diversions are 1 .537 acre feet per year and consumptive
use is 0.846 acre feet per year.

New water rights will be required for the Engelhardt Well and the Engelhardt Pond. Following is
the water rights information for each of the two structures:
Engelhardt Well (Permit No. 112035)
Location: A well located in the NW'/a NE'/a, Section 34, Township 6 South, Range 92 West, 6th
P.M. at a point 900 feet from the North line and 2,200 feet from the East line of said Section 34.
Source: Alluvial formation tributary to Dry Hollow Creek, tributary to the Colorado River. The depth
of the well is 160 feet.
Appropriation: September 9, 1999, by formation of intent to expand the uses of the well.
Amount: 0.033 cfs (15 gpm), conditional.
Use: Domestic, including lawn and garden irrigation and livestock watering.
Engelhardt Pond
Location: The centerline of the dam is in the NW'/a NE'/a, Section 34, Township 6 South, Range
92 West, 6th P.M. at a point 800 feet from the North line and 2,250 feet from the East line of said
Section 34.
Source: Natural runoff from an unnamed tributary to Dry Hollow Creek, tributary to the Colorado
River.
Appropriation: September 9, 1999 by formation of intent to use an existing on-site pond for
augmentation purposes.
Amount: 1.5 AF, conditional.
Use: Domestic, stockwater and fire protection.

During the winter season or during the snowmelt runoff period when no call exists on Dry Hollow
Creek below the subject Engelhardt Well and Engelhardt Pond nor on the Colorado River at Cameo,
water available in the unnamed tributary to Dry Hollow Creek will be stored in the Engelhardt Pond.
During periods of a call on the Engelhardt Well either from Dry Hollow Creek or the Colorado River,

This is to let you know that I spore earlier in the month with Mark Bean at the county Building
Department. My understanding of the conversation regarding the procedure needed for your septic
system is as follows: 1) since his inspector had observed a failed standard seepage test within the
county tolerances, your next step was to hire a professional engineer to design your system, and this
engineer was to oversee the construction of the system, including inspections at critical phases; 2)
this engineer was to tender a signed and sealed report to the county for their files on the system as
built. These steps would be sufficient as replacement for the county inspector observing
construction of a standard system.
To this point I have designed the system, staked the layout, met and worked with your dirt
contractor in that phase of the construction, including placement of two 1000 gallon tanks,
placement of the sand filter, gravel and pipe distribution system, pump installation, and finally the
covering of the mound system. I have also met with your electrical contractor concerning the
installation of the pump wiring and controls, which include the safety alarm.
You now need to obtain your occupancy inspections from the county and begin to operate the
system. After the tanks fill and a week of use, I will refine any adjustments that may be needed in
the pump float valves and check all aspects of the systems operation. After this I will send the as -
built plans to the county.
It was also my understanding from the discussion with Mark Bean that you would be refunded part
of your original $150 application fee because of reduced need for county inspectors to oversee the
construction of your system.

Overview of Resign and Construction of the Grant/Englehardt Mound System
During the first week in December, I reviewed the site, seepage information, and septic requirement for the loca-
tion and worked on a system design.
In order to get proper absorption, a mound system appeared to be the appropriate system for 0066 Chipperfield
Lane. Considering the restrictions of driveway, buildings, waterway (pond), and terrain, the sight lent itself to a
maximum size of 70 feet long and 32 feet wide. This totals 2240 square feet or 34 % more than the minimum re-
quired.
December 6, 2001, I staked the system with the help of landowner Grant. Seven -fifteen the morning of December
7, I reviewed the plan with contractor Lewis. Construction began sometime prior to December 19 with placement
of the septic and dose tanks and shaping of the basal area. Construction continued through December 21. The elec-
trical connection and float installation was completed shortly thereafter.
The materials used for construction adhered to the plan except that a 2 inch delivery pipeline rather than a 3 inch
was installed. The tanks, basal area, sand placement, gravel placement, and cover layers also were installed per
plan dimensions and material types.
Pursuant to recommended minimum requirements for individual sewage disposal systems, the three bedroom resi-
dence requires:
1) 1000 gallon septic tank
2) 3 X 558* or 1674 square feet absorption area
3) 1000 gallon dose tank
*3 percolation tests between 45 and 60 minutes per inch, thus a required absorption area of 558square feet at 60
minutes per inch per bedroom.

Mounds stem Plan
septic systems are usually composed of two main components: the septic tank, and the absorption field. Some sys-
tems, where soil absorption rates do not meet county standards, require a third component called a dosing tank or
pump tank.
1. The septic tank is where raw wastewater goes initially. Two important things happen in the septic tank. First,
40 the waste is partially treated and broken down by the bacteria in the tank. second, the waste settles into three

layers: the sludge, the liquid effluent, and the scum layer. A baffle on the tank outlet allows only the liquid
effluent (partially treated liquid sewage) to exit the septic tank and go to the absorption field, trapping every-
thing else in the septic tank.
2. The absorption field is where the liquid effluent infiltrates the ground. A mound system is a type of absorption
field.
3. The dosing tank is where the pump is located. Effluent from the septic tank enters the dosing tank and lifts the
"on" pump float switch. Once on, the pump sends effluent through the delivery line to the mound system. The
volume and rate of this dose pressurizes the distribution system and effluent is sprayed out of the 1/4 inch
holes in the laterals. The sprayed effluent is baffled (slowed) by the gravel in the bed and soaks down through
the medium sand and is incorporated into the original soil. The floats in the dosing tank are set to pump about
four times a day (1/4 of the homes wastewater flow). The pump system is set up with a high water alarm. In
the event the pump should fail, the water level in the tank will continue to rise until it trips the high water
alarm.
The area of the mound system is determined by the loading rate (how many gallons of effluent water per square
foot the soil can absorb) of the soil. Heavier soils have lower loading rates and therefore require larger absorption
fields. The absorption area for a mound system is often referred to as the Basal Area. The actual size of this area
will vary. A typical mound system for a three bedroom house in clay soils can be expected to be about 85 feet by
40 feet. Preferably long and narrow, the mound must be designed parallel with the contour. Usually the maximum
allowed slope for a mound system is 6%.
After determining the proper site for the system, the area is plowed.
The plowed area is then covered with a 1 foot deep layer of washed medium textured sand. The sand helps to dis-
tribute the liquid effluent throughout the absorption area and aids incorporation into the topsoil. This sand also
functions as an attached media filter and helps in the treatment of the wastewater.
Next, a gravel bed is installed on top of the sand area. The size of the gravel bed is determined by the loading rate
of the underlying medium sand. The bed is much smaller than the basal area and might be 65 feet long X 6 feet
wide.
Distribution laterals are placed in the gravel bed. Laterals are laid parallel into the bed about 3 feet apart. Laterals
are usually I inch to 1 and 1/2 inches in diameter and made of PVC. 1/4 inch holes are drilled on the bottom side
of each lateral every three feet. The laterals are then manifolded together and the ends are capped.
A delivery line connects the laterals and manifold to the pump in the dosing tank. This delivery line must be de-
signed to drain back to the dosing tank so the contents can drain back between doses. Incorrect design or installa-
tion of the delivery line could mean freezing.
The gravel bed is then covered with a geo-textile fabric (a coffee -filter -like fabric).
The entire mound is covered with a 6 inch layer of clay and then followed by 6 more inches of topsoil.
A thorough grass cover should be established on the mound. Don't plant trees or shrubs on the mound, however,
because their roots can cause problems.
