Dear Mr. Badgett;
This letter is being provided to you as the owner of 956 CR 106 in regard to a
General Administrative Review Application for an Accessory Dwelling Unit at your
property. The proposed use is located west of the Town of Carbondale in the
Townsite of Cooperton (aka Satank). The site is also known by Assessor's Parcel
No. 2393-283-00-003.
The Director's Determination on the Application is based on the following findings
and subject to the Applicant's submittal documents and representations as well as
conditions of approval.
1. That proper public notice was provided as required for the Director's Decision.
2. The Director's review was extensive and complete, that all pertinent facts,
matters and issues were submitted and that all interested parties were given
an opportunity to be heard.
3. That for the above stated and other reasons the proposed Land Use Change
Permit for the 956 CR 106 Accessory Dwelling Unit is in the best interest of the
health, safety, convenience, order, prosperity and welfare of the citizens of
Garfield County.
4. That with the adoption of conditions, the application is in general conformance
with the 2030 Comprehensive Plan, as amended.
5. That with the adoption of conditions, the application is in general conformance
with the 2013 Land Use and Development Code, as amended.

A Director's Decision is hereby issued approving the Application with the following
conditions.
1. All representation of the Applicant contained in the application shall be
considered conditions of approval.
2. The Applicant shall comply with Additional Standards for Residential Uses
contained in Section 7-701, Accessory Dwelling Units, of the Land Use and
Development Code of 2013, as amended.
3. Floor Area for the Accessory Dwelling Unit shall not exceed 1,500 square
feet.
4. The ADU shall be subject to all Garfield County Building Code
Requirements. The property owner shall obtain any necessary Garfield
County Building Permits for the proposed ADU structure.
5. All exterior lighting shall be downcast and shielded and comply with Section
7-304, Lighting Standards, of the Land Use and Development Code of 2013,
as amended.
6. An ADU is restricted to leasehold interest in the dwelling unit and is for
residential or Home Office/Business use only, as described in the Land Use
and Development Code of 2013, as amended.
7. Prior to issuance of the Land Use Change Permit the Applicant shall provide
the following information:
(1) A minimum 4 -hour pump test shall be performed on the well(s) to be
used. The results of the pump test shall be analyzed and summarized
in a report, including basic well data (size, depth, static water level,
aquifer, etc.) pumping rate, draw down, recharge, and estimated long-
term yield. The report shall be prepared by a qualified professional
engineer or ground water hydrologist and shall include an opinion that
the well will be adequate to supply water for the proposed uses. The
report shall also address the impacts to ground water resources in the
area.
(2) Water quality shall be tested by an independent testing laboratory for
the following contaminants: alkalinity, arsenic, cadmium, calcium,
coliform bacteria, chloride, conductivity, copper, corrosivity, fluoride,
hardness, iron, lead, magnesium, manganese, nitrate/nitrite, pH,
sodium, sodium adsorption ratio, sulfate, total dissolved solids, uranium,
zinc and alpha/beta radioactivity. Additional testing may be required for
other contaminants that occur within the County. The results shall show
that the Maximum Contaminants Levels (MCLs), as set forth by the
CDPHE within the Colorado Primary Drinking Water Standards, are not

exceeded, or the Applicant has otherwise identified a treatment system
that will bring the water within acceptable MCLs. Annual testing, testing
for other contaminants, and testing for secondary drinking standards
including taste, odor, color, staining, scaling, and corrosion is also
recommended.
This Determination will be forwarded to the Board of County Commissioners for a
period of 10 days so that they may determine whether or not to call up the
application for public hearing. According to the Land Use and Development Code,
Section 4-112(A), "a call-up may be initiated by the BOCC, the Director, the
Applicant, or any affected Adjacent Property Owner." Should this time period pass
with no request for review or public hearing, the decision shall be final.

I. DESCRIPTION OF THE PROPOSAL
The Applicant is requesting approval for an
Accessory Dwelling Unit (ADU) on a .905-
07 acre parcel located within the Residential
Urban zone district, as shown in Figure 1.

The required minimum lot size for an ADU in
this zone district is 15,000 square feet, twice
the minimum lot size of 7,500 square feet,
which the subject site exceeds. An ADU of
up to 1,500 square feet can be constructed
on the site subject to Section 7-701 of the
2013 Land Use and Development Code, as
amended (LUCD).
II. DESCRIPTION OF THE SITE
A single family home currently exists on the
parcel which is proposed to be demolished.
A new structure is proposed which will
contain both the single family residence as
well as the ADU.

Water is proposed via construction of a new well on the site, Permit Number 78587. This
permit is supported by an augmentation contract with the Basalt Water Conservancy
District. The well permit requires that the well be operated in accordance with the Basalt
Water Conservancy District Augmentation Plan approved by the Division 5 Water Court
in case no. 02CW0077 (Ruling 1 of 2).
A new septic system is proposed which will be sufficient to serve both the primary and
the accessory units.
The Rockford Ditch flows through the property and the ditch company has provided
documentation regarding improvements that were required of the Applicant.
The site is designated as Urban Growth Boundary for the Town of Carbondale, therefore
consultation with the Town of Carbondale Comprehensive Plan is appropriate.
III. APPLICABLE REGULATIONS
A. The Land Use Table contained in Section 3-403 of the LUDC designates an
Accessory Dwelling Unit within the Rural Zone District as requiring Administrative Review.
B. Section 4-103 of the LUDC sets forth the Administrative Review Procedures by
which the current Application is being considered.
C. Article 7 of the Land Use and Development Code sets forth General approval
standards in DOivision 1, General Resource Protection Standards in Division 2 and Site
Planning and Development Standards in Division 3. Accessory Dwelling Units are also
subject to Section 7-701. The standards are addressed in the Application submittals and
in the Staff Analysis section of this report.
IV. PUBLIC AND REFERRAL COMMENTS
The Applicant has provided documentation that all required notice mailings have been
completed in accordance with the LUDC. No public comments were received as a result
of the public notice.
Referral Comments received on the Application are attached as Exhibits and summarized
below:
1. Mountain Cross Engineering, Exhibit F: Chris Hale responded with several comments
regarding the water system including what would be done with the existing shared
well, and the requirement that the new well provided pump tests and water quality
analysis.
2. Resource Engineering, Exhibit H: Michael Erion responded on behalf of the Basalt
Water Conservancy District that water issues are addressed from a legal perspective
but that testing for quantity and quality need to occur.

3. Carbondale and Rural Fire Protection District, Exhibit G: Bill Gavette responded that
the FPD had no issues with the request.
No response was received from Road & Bridge, Vegetation Management, Environmental
Health, and Town of Carbondale.
V. STAFF ANALYSIS
Article 7, Division 1: General Standards
Section 7-101: Compliance with Zone District Use Regulations
The property is in general compliance with Zone District Regulations for the Residential
Urban Zone District. The proposal meets maximum lot coverages, property setbacks and
exceeds the requirement for a minimum lot size of 15,000 square feet for an ADU.
Section 7-102: Conformance with Comprehensive Plan and compliance with IGAs
The site is located on the Garfield County Future Land Use Map (FLUM) within the Urban
Growth Boundary for the Town of Carbondale, therefore we look to the Comprehensive
Plan for the Town. That Comprehensive Plan identifies the Satank area as Phase 2
Potential Annexation: Infill Areas. Satank (Cooperton) is a low priority according to the
explanation of the Phase 2 Infill Areas, but also states that the area currently functions as
a part of the town. Demand for sewer could motivate petitions for annexation but the
opportunities for public benefit to the town are few.
Section 7-103: Compatibility
The proposed use is located within a residential subdivision and is therefore compatible
both with the use and density of the area.
Section 7-104: Sufficient, Adequate, Legal and Physical Source of Water
Currently the site shares a well with an adjacent property however the redevelopment of
the parcel will result in new infrastructure including a new well which is proposed to be
drilled to serve the two units. This well is augmented by a Basalt Water Conservancy
District contract that is required to be maintained by the Division of Water Resources Well
Permit Number 78587. Should the request for an ADU be approved the Applicant will be
required to provide a 4 -hour pump test and water quality analysis sufficient to determine
that physical water is adequate to serve the two units.
Section 7-105: Adequate Central Water Distribution and Wastewater
The existing single family home is served by an Onsite Wastewater Treatment System
(OWTS) that is proposed to be de -commissioned upon redevelopment of the parcel. A
new OWTS is proposed to be constructed sufficient to serve two units.
Section 7-106: Adequate Public Utilities
The site is currently served with adequate public utilities.

Section 7-107: Access and Driveways
The application was referred to the Garfield County Road &Bridge Department, however
no comment was received.
Section 7-108: Natural Hazards
The site does not appear to be located within any mapped hazard area.
Section 7-109: Fire Protection
The Application was referred to the Carbondale and Rural Fire Protection District who
had no comment on the proposal.
Article 7, Division 2: General Resource Protection Standards
Section 7-201 Agricultural Lands
The proposed ADU will be accessory to the primary dwelling unit on the subject property.
The property is not currently being used for agricultural purposes. Ditch issued appear
to have been adequately resolved based upon a letter from the Rockford Ditch Company.
Section 7-202 Wildlife Habitat Areas
The redevelopment of the parcel with the inclusion of an ADU will not create additional
impacts to wildlife.
Section 7-203 Protection of Waterbodies
There are no waterbodies on the site.
Section 7-204 Drainage and Erosion
Disturbance will be minimal and positive drainage has been designed as part of the
structure.
Sections 7-205 Environmental Quality
Air and water quality will not be adversely impacted by the ADU.
Section 7-206 Wildfire Hazards
The wildfire hazard in this area is minimal.
Section 7-207 Natural and Geologic Hazards
No significant natural or geologic hazards have been identified on the subject property.
Section 7-208 Reclamation
Minimal disturbance is anticipated in completing the ADU.

Section 7-301 Compatible Design
The design of development associated with the land use change shall be compatible with
the existing character of adjacent uses.
Section 7-302 Off- Street Parking and Loading Standards:
The Applicant has demonstrated that adequate off-street parking will exist for the ADU
and primary dwelling unit.
Sections 7-303 Landscaping Standards:
The LUDC specifically exempts ADUs from Landscaping Standards.
Section 7-304 Lighting:
The Applicant has stated that the structure will comply with this standard and that all
lighting will be downcast and shielded.
Section 7-305 Snow Storage Standards:
There is adequate area within the lot to meet minimum snow storage standards.
Section 7-306 Trail and Walkway Standards:
No recreational or community facility access areas are proposed.
Article 7, Division 701, Accessory Dwelling Unit
Section 7-701.A Maximum Floor Area:
The proposed ADU will not exceed the maximum of 1,500 square feet in size permitted
in this zone district.
Section 7-701.B. Ownership Restriction:
The Applicant understands that the ADU is restricted to leasehold interests and may be
used for residential purposes only.
Section 7-701.C. Compliance with Building Code:
The Applicant has represented that the ADU will comply with all building codes.
Section 7-701.D. Minimum Lot Area:
The minimum lot area has been satisfied.
Section 7-701.E. Entrance to Dwelling Unit:
The ADU as proposed will comply with this standard.
VI. RECOMMENDED FINDINGS AND CONDITIONS
Staff recommends approval of the request for an ADU and provides the following findings
in support:

This office has performed a review of the documents provided for the Badgett ADU application.
The submittal was found to be thorough and well organized. The review generated the following
comments:
1. The proposed OWTS will need to be designed and a permit obtained from Garfield County.
2. There is an existing well on-site that is not proposed to be used. The Applicant should
explain in more detail what will be done with the existing well.
3. A new well is permitted to be drilled. Pump test results and water quality test results will
need to be submitted.

Resource Engineering, Inc. (RESOURCE) reviewed the land use application for the Badgett ADU (Permit File GAPA-05-16-
8458). Based on review of the materials submitted with the Application dated May 24, 2016, RESOURCE believes the
proposed ADU projects meets the technical criteria with respect to floodplains, grading and drainage, and geologic
hazards. The water supply is proposed to come from a new well to be drilled on the property. The legal water supply is
in place with Well Permit No.78587-F and Basalt Water Conservancy District Water Allotment Contract No.
580. Adequate water quantity and quality for the new well will need to be proved up prior to issuance of the GARCO
Land Use Permit. The wastewater treatment and disposal will be through a new OWTS to be designed by a qualified
consultant. It appears that the Applicant can meet all of the standards for the OWTS, but an approved design is needed
prior to issuance of the Land Use final approval.

Kathy,
The applicants' response to the comments of Mountain Cross Engineering, Inc.
regarding the Badgett ADU application are as follows.
1. The proposed OWTS will be designed and a permit applied for in the next
two months, before the planned start of the building project in March of
2017.
2. The existing well is not on site, but a is a legally shared well located at the
property to the North (Andy Schwaller). The applicants are considering a
sale of said well share to Mr. Schwaller, or otherwise utilizing the well
share for irrigation.
3. The applicants plan to have the new well drilled, pump installed, pump
tests completed, and water quality tests completed before the planned
start of the building project in March of 2017. These tests will be
submitted to Garfield County Planning for ADU approval as soon as
possible.
