Our rationale for requesting these waivers is that the exterior envelope I existing site conditions of the project are not planned to change in any way. The exterior walls, window location I size, exterior I site drainage, site and unit access, parking location , site foliage and landscaping -are all to remain as currently existing . We have 1 . The units have s.f. numbers of 484.89 and 369.86 respectively . The Parcel (2185-062-00-038) is zoned R2 , so our parking shou ld not have to change. The building 's exterior, roof, grades, dra i nage, etc. is not planned to change . We plan on leav ing the s ite 100% as it is . Mineral rights statement Public records search 07-25-17 I, Kurt Carruth , in preparation of a Land Use Change Permit application , spoke with Casey Lawrence in the Garfield County Assessor's office -inquiring about mineral records of the PIDs with in 200 feet of our properties ' boundary. Casey did an internal search of the Assesor's database, and found no mineral records for the 200 ' adjacent property owners. I went to the GarCo. clerk and recorder's office to double check, I searched each of the 200 ' adjacent PIO numbers and they as well showed no mineral rights records of any sort. Colorado revised statute 24-65.5-103 requires notification to mineral owners when a landowner applies for a land use designation by a local government. As such, the landowner must research the current owners of mineral interests for the property. The Garfield County Land Use and Development Code of 2013 C'LUDC") Section 4- 101 (E)(l )(b )( 4) requires written notice to owners of mineral interests in the subject property "as such owners can be identified through the records in the office of the Clerk and Recorder or Assessor, or through other means." It is the duty of the applicant to notify mineral interest owners. The following is a suggested process to research mineral interests: 1. Review the cwrent ownership deed fur the property (i.e. Warranty Deed, Special Warranty, Quit Claim Deed or Bargain and Sale Deed-NOT a Deed of Trust). The ownership deed is usually one or two pages. Is there a reservation of mineral interests on the ownership deed? Are there any exceptions to title? A deed may include a list of reservations that reference mineraJ owners or oil and gas leases. 2.
