We would like to respectfully request a waiver of Submission requirements and
the Development Agreement and Improvements agreement. Our rationale for
requesting these waivers is that the exterior envelope I existing site conditions of
the project are not planned to change in any way. The exterior walls, window
location I size, exterior I site drainage, site and unit access, parking location , site
foliage and landscaping -are all to remain as currently existing .
We have
1 . Current plans -existing and proposed .
2 . Current ILC
3 . Current Existing conditions map
4. Owners within 200 feet of property list
5 . Mineral owners search yielded no results. Casey Lawrence with the
Assessor's office searched his database and came up w ith no active
accounts.
6 . Intention to serve letter from GWS Water dept. I WGWS sanitation.

We would like to remove the upper East side office and change it into (2) 1 BR
apartments. The units have s.f. numbers of 484.89 and 369.86 respectively . The
Parcel (2185-062-00-038) is zoned R2 , so our parking shou ld not have to
change. The building 's exterior, roof, grades, dra i nage, etc. is not planned to
change . We plan on leav ing the s ite 100% as it is . All trees, grassy areas, gravel
coverage , street access, utility hookups, etc. is to remain as is.

We have a residential neighborhood to the East (behind a 6 '-0 " tall fence), a
trailer style residential area to the North (behind a 6'-0" tall fen ce), Hwy. 6 & 24 to
the South , and a commercial property to the West.
2.Site Features:
No streams, no flooding areas, no lakes, no high ground water areas, flat
topography, nothing exciting vegetative cover, normal Colorado climatology .
3.Soil characteristics :
We are not doing anyth ing with soil -the project is a simple interior remodel.
4.Geo log y an d Hazard :
None present.
5.Ground water an d A qui fe r re charge areas:
See #3 above.
6. Env iro nm e nta l i m pacts:
a. no effect on flora I fauna .
b. no wildlife habitat.
c . no wildlife impacts .
d . no radiation impacts.

Will not be producing any of these nuisance items, except noise i n the 6 weeks of
the project construction .

The proposed project is an interior remodel, and is contained completely to the
interior. It is not planned to change any part of the site .

vegetation to remain as is.
7-304 Lighting standards: Downcast, shielded lighting fixtures will be used.
No hazardous lighting will be used . No flashing lights will be used . The
only light we will add is over vestibule entrance door to apartments.
7-305 Snow storage Standards: Snow will be pushed into yard. No snow will be
stored i n parking spaces or right of ways.
7-306 Trail and walkways standards: no trails present. Walkway will be
maintained in existing condition .

The proposed project is not planned to change the driveway, road access,
parking, change any utility locati ons , pedestrian access, emergency access,
drainage, drainage collection, trafic controls, lighting, ralat io nship to existing
topography, street names, and will not increase, (but decrease), congestion.
Mineral rights statement
Public records search 07-25-17
I, Kurt Carruth , in preparation of a Land Use Change Permit application , spoke
with Casey Lawrence in the Garfield County Assessor's office -inquiring about
mineral records of the PIDs with in 200 feet of our properties ' boundary. Casey
did an internal search of the Assesor's database, and found no mineral records
for the 200 ' adjacent property owners. I went to the GarCo. clerk and recorder's
office to double check, I searched each of the 200 ' adjacent PIO numbers and
they as well showed no mineral rights records of any sort.

The applicant Is requesting a permit for a Two Unit Dwelling on a 0.895 acre parcel located just west
of the City of Glenwood Springs on Highway 6 and 24. It is understood that the Applicant would like
to convert the second floor of an existing office building into two residential apartments. The first
floor of the build Ing is proposed to remain as an office use.
Staff understands the property is served by the City of Glenwood Springs water and West Glenwood
Sanitation. The applicant will need to provide a can and will serve letter from both the water suppl y
entity and wastewater treatment entity stating that they can and will serve the proposed unit.
Access to the property is via Highway 6 and 24. The Applicant will need to demonstrate legal and
adequate access to the State highway in the form of a driveway permit from COOT.
Since the building is proposed to have multiple uses, the building will need to meet the County
Building Code as well as applicable fire codes. The applicant is encouraged to meet with County
building officials and the City of Glenwood Spring Fire Department to analyze the specific building
requirements necessary.
As the request Is not exempt from the Landscaping submittal requirements (Section 4--203(F)) and
standards (Section 7-303), the application will need to provide the required information to meet
these standards. In addition, as the property is adjacent to commercial property within the City of
Glenwood Springs, adequate pedestrian access will need to be provided to satisfy the standards in
Section 7-306.

Mineral interests may be severed from surface right interests in real property. Colorado revised
statute 24-65.5-103 requires notification to mineral owners when a landowner applies for a land
use designation by a local government. As such, the landowner must research the current owners
of mineral interests for the property.
The Garfield County Land Use and Development Code of 2013 C'LUDC") Section 4-
101 (E)(l )(b )( 4) requires written notice to owners of mineral interests in the subject property "as
such owners can be identified through the records in the office of the Clerk and Recorder or
Assessor, or through other means."
It is the duty of the applicant to notify mineral interest owners. The following is a suggested
process to research mineral interests:
1. Review the cwrent ownership deed fur the property (i.e. Warranty Deed, Special
Warranty, Quit Claim Deed or Bargain and Sale Deed-NOT a Deed of Trust). The
ownership deed is usually one or two pages. Is there a reservation of mineral interests on
the ownership deed? Are there any exceptions to title? A deed may include a list of
reservations that reference mineraJ owners or oil and gas leases.
2. Review your title insurance policy. Are there exceptions to title listed under Schedule B-
U? If so, review for mineral int.erests that were reserved and oil and gas leases.
3. Check with the Assessor's office to determine if a mineral interest has been reserved
from the subject property. The Assessor's office no longer docwnents the mineral
reservation ownership for its tax roll records unless ownership has been proven. There
are only a limited number of mineral owners who have provided such infonnation to the
Assessor's office so this may not provide any infonnation, depending on your property.

4. Research the legal description of the subject property with the Clerk and Recorder's
computer. You can search the Section, Township, and Range of the subject property.
You may find deeds for mineral interests for the subject property.
5. Research whether a Notice of Mineral Estate Ownership was filed for the subject
property. On the Clerk and Recorder 's computer, search under Filter (on the right hand
side of the screen), General Recordings, Notice of Mineral pstate Ownership for the
subject property.
6. If you find mineral interest owners as reservations on your deed, listed in your title
insurance policy, from the Assessor's records or the Clerk and Recorder's computer, you
need to detennirte whether these mineral interests were transferred by deed and recorded
in the Clerk and Recorder's office.
7. Enter the name of the mineral interest owner as the Grantor in the Clerk and Recorder's
computer to see if the mineral interest was transferred. If you fmd a transfer deed, you
