OLSSON ASSOCIATES July 14, 2017 Glenn Hartmann Garfield County Community Development 108 8th Street, Suite 401 Glenwood Springs, CO 81601 ghartmann@garfield-county.com Re: PDPA-05-17-8550 BMC A Pipeline Ursa Operating Company Dear Glenn: Thank you for your completeness review of Ursa Operating Company's (Ursa) Phase II Special Use Permit Applications within the Battlement Mesa PUD. This letter serves Ursa's response to your NTC letter dated June 29, 2017. 1. Battlement Mesa Partners LLC needs to authorize Ursa to represent them. Response: A Letter of Authority from Eric Schmela representing Battlement Mesa Land Investments and Battlement Mesa Partners is included in this submittal. Also included is the recorded Statement of Authority for Ursa. 2. The Statement of Authority for the Battlement Mesa Metro District needs to be revised to include the pipeline development as the current statement is limited to authority for the road agreement. Response: Ursa is working with Battlement Mesa Metropolitan District on this item. It will be submitted to Garfield County as soon as it is received by Ursa. 3. Current easements to the site are temporary and terminable. The Application needs to address permanent legal access to the site. 4. Response: Permanent legal access is granted by Battlement Mesa Land Investments in the original Surface Use Agreement paragraphs 1 and 2 on page 2 along with the Exhibits in the original SUA and the Third Amendment to the SUA which were included in the original submittal. The language in the Battlement Mesa Metropolitan District is their standard language and provides access to the well pad as long as it is in use. 5. The Geologic Hazards Report identifies slopes and expansive soils as an issue for the site. The report needs to include site specific engineering recommendations for the proposed pipeline. The report also needs to update sections on proximity to the flood plain. Response: The Geologic Hazards Report has been updated to include site specific information addressing the cut and fill areas, slope stability, and potential for impacts due to ground water. The proximity to the flood plain information has been updated showing that this site is not within the Colorado River floodplain. Site specific engineering recommendations are addressed in the Geotechnical and Drainage Reports which will be submitted at a later date. 6. Copies of the Ursa Pipeline Operational procedures/protocol related to safety and monitoring need to be provided (similar to previous pipeline applications). Response: Included in this submittal are Ursa's Water Transfer Integrity procedures and Pipeline Corrosion Monitoring procedures. 7. Relationship of the site to the Parachute Watershed Protection District needs to be provided. Response: Per conversation with the Town of Parachute, the BMC A Pipeline is outside Parachute's Watershed Protection District boundary. 8. The LUMA comments and responses need to be included in the Application. Response: The LUMA comments and Ursa's responses are included with this submittal. Response: Copies of the recorded Statement of Authority and Easement from Battlement Mesa Metropolitan District are included with this submittal. 4.
