The following comments based on the 1988 edition of the
Uniform Building CodeTM shall be resolved. The approval of
plans and specifications does not permit the violation of
any section of the Uniform Building Code or any federal,
state or local regulations. Any and all deviations from the
original plans and speculations approved by the Building
Department shall be submitted to the Building Department for
approval.
GENERAL COMMENTS
GEN -1 It was assumed that the uses and materials in the
building will be compatible with a R -3 /M -1 Occupancy.
Mi Approved numbers or addresses should be provided for
all new buildings in such a position as to be plainly
visible and legible from the street or road fronting the
property. Section 513. This requirement should be noted on
the plans.
GEN -8 Insulation requirements must be met with R -10
Foundations, R -19 walls and R -30 ceiling. Required
insulation must comply with Section 1712 and 1713 UBC 1988
i.e. paper shall not be left exposed).
GEN -19 All electrical work shall be approved by the state
electrical inspector and verification of such approval shall
be provided to the building inspection department prior to
issuance of a Certificate of Occupancy.
GEN -29 Foundation insulation shall extend down below grade
to the top of the footing.

BUILDING AND PLANNING
AGREEMENT REGARDING CERTIFICATE OF OCCUPANCY
WHEREAS, Harold and Anne Madeen (hereinafter "Owner") have applied
for a Certificate of Occupancy for a house located at 0999 County Road 309,
Garfield County, Colorado and,
WHEREAS, the following items have been determined to be apparent
defects or deficiencies with the application which prohibits the issuance of
a Certificate of Occupancy until they have been resolved pursuant to codes
adopted by Garfield County and approved by the Garfield County Chief
Building Official:
1.The forced air heating unit was relocated from the location indicated
on the plans approved by the Garfield County Building Department.
Approval by the building department for relocation of the heating unit
in an under floor crawl space was not requested by the owner or
contractor and was not granted by the building department.
The U.M.C. (Uniform Mechanical Code) Section 504 (f) LPG Appliances.
States, "Liquified petroleum gas- burning appliances shall not be
installed in a pit, basement or similar location where heavier - than -air
gas might collect. Appliances so fueled shall not be installed in an
above -grade under -floor space or basement unless such location is
provided with an approved means for removal of unburned gas."
The providing of a detection device interconnected with a fuel shut
off does not negate this requirement although it may be acceptable as
a supplement to an approved means for the removal of the unburned
gases.
and,
WHEREAS, the Owner is willing to make certain assurances and
agreements relating to these identified code deficiencies and on the basis of
such assurances the County is willing to issue a Certificate of Occupancy.
NOW, THEREFORE, it is agreed as follows:
A. The Owner agrees to do the following:

Deficiency No. 1.
ACTION REQUIRED OF THE OWNER:
Provide and submit a plan for the providing of a system for the
removal of unburned gases from crawl space or for the relocation of
the appliance to the building department for approval. After approval
of the plan the owner will cause the correction of the violation to be
completed as required in this document.
FURTHER ACTION REQUIRED OF THE OWNER:
The Owner is to shut off the fuel supply to the appliance before
it enters the under -floor space and the appliance is to not be
fired or used until required corrections have been made.
The Owner will complete all work described herein and request
inspection of all work by the Garfield County Building
Department. All work shall be completed in compliance with the
stated provisions of the codes currently adopted by Garfield
County in a manner that will enable approval of all work. All
work, inspections and approval of work shall be completed
within fifteen (15) days of the date of signing of this document.
B. In the event the Owner fails to perform as agreed on the above, the
County may revoke any permits or certificates of occupancy which
may have been granted to the Owner. The County may require the
habitation and occupancy of the house cease immediately.
C. This agreement is binding upon the heirs, successors in title, and
assigns of the parties.
