DESCRIPTION OF THE PROPOSAL BOA 10/22/92 Variance from Section 3.04.06 - Minimum Setback Tom Clark Lot 24, Ranch at the Roaring Fork, Phase 5 (0369 Stagecoach Lane). The lot is roughly 10,485 square feet in size. Community water and sewer. Driveway via Stagecoach Lane PUD A. Site Description: The subject property is a residential lot in the Ranch at Roaring Fork Planned Unit Development. The rear yard of Mr. Clark's property fronts directly on the 6th Fairway, approximately 150 yards west of the tee box. improvements on the property include a single-family dwelling unit with a 10'x16' uncovered deck. An Improvement Location Certificate is attached on page' • B. Request: The applicants are requesting a variance from the required thirty foot (30') rear yard setback on the north side of the lot along 6th fairway of the golf course to allow for the extension and screening of the existing porch. Because the porch was constructed without screening or roofing, the required setbacks did not apply. The proposed enclosed porch will enc oach roughly ten (10) feet. Mr. Clark's application letter is attached on page II. MAJOR ISSUES AND CONCERNS 1. The PUD zoning for this portion of Phase V requires the following setbacks: FRONT: 30 feet REAR: 30 feet (for lots fronting onto golf course) SIDE: 10 feet 1 • 2. The Ranch at the Roaring Fork covenants require approval by both the County and the Architectural Committee for variances to setbacks. In a letter dated September 3, 1992, the Architectural Review Committee approved Mr. Clark's request, with the following conditions: A.) the proposed porch is never heated; B.) the porch is never converted to living space; C.) the screens are never replaced with a solid form of barrier. A cop of the Committee's 9-3-92 letter indicating approval is attached on page • 3. In the application, the applicant contends that the location of the porch in relation to the fairway presents safety concerns. Simply stated, the porch has been subject to errant golf balls in the past. 4. Section 9.05.03 states that "by reason of exceptional narrowness, shallowness or shape of the specific piece of property at the time of enactment of this resolution or by reason of exceptional topographic conditions or other extraordinary and exceptional situation or condition of such piece of property," the Board may authorize a variance. In addition, the Board must also find that: A. That the variance granted is the minimum necessary to alleviate such practical difficulties or undue hardship upon the owner of said property; and B. That such relief may be granted without substantial detriment to the public good and without substantially impairing the intent and purpose of the General Plan or this Resolution; and C. That the circumstances found to constitute a hardship were not caused by the applicant, are not due to or the result of general conditions in the district, and cannot be practically corrected; and D. That the concurring vote of four (4) members of the Board shall be necessary to decide in favor of the applicant. 5. In staff's opinion, the close proximity to the sixth fairway represents an extraordinary and exceptional situation or condition on the property. III. SUGGESTED FINDINGS 1. That the application for Variance was found to be consistent with the requirements and standards of Section 9.05 of the Garfield County Zoning Resolution of 1978, as amended. 2. That proper publication and public notice was provided as required for the public hearing before the Zoning Board of Adjustment. 3. That the public hearing before the Zoning Board of Adjustment was extensive and complete, that all facts, matters and issues were submitted and that all interested parties were heard at the meeting. 2 IV. RECOMMENDATION, Staff agrees that the likelihood of being hit by errant golf balls represents "other extraordinary and exceptional situation or condition of the property", consistent with Section 9.05.03.
