(4) Adjournment • • ZBOA 3/22/90 PROJECT INFORMATION AND STAFF COMMENTS REQUEST: Variance from Section 3.07.06(2) APPLICANT: John Colby and Arthur Phillips LOCATION: A parcel of land located adjacent to the south city limits of Glenwood Springs off of State Highway 82, at 2552 Hwy. 82. I. VARIANCE REOUEST The applicant proposes an approximate 560 sq. ft. addition to an existing upholstery shop. The addition would be built to within five (5) ft. of the rear property line, which is not consistent with the minimum rear yard setback of 7.5 ft. required in the Commercial/Limited zone district. (See Pgs•2) Garfield County approved the creation of the 0.226 acre parcel as a lot split through the exemption from the definition of subdivision process. At that time, the existing building was on the property and within approximately two (2) feet of the property line. At the time this parcel was created, there was no requirement that the applicant adhere to the zone district setback requirements. As a result, the applicant has a physical limitation for any area to expand. II. SUGGESTED FINDINGS 1. That the application for variance was found to be consistent with the requirements and stands of Section 9.05 of the Garfield County Zoning Resolution of 1978, as amended. 2. That proper publication and public notice was provided as required for the public hearing before the Zoning Board of Adjustment. 3. That the public hearing before the Zoning Board of Adjustment was extensive and complete, that all facts, matters and issues were submitted and that all interested parties were heard at the hearing. III. RECOMMENDATION APPROVAL of a variance from Section 3.07.06 (2) to allow a five (5) foot variance from the rear yard lot line.
