The basement of the home is required to have a door or an escape or rescue window in compliance with U.B.C. Uniform Building Code) Section 1204. and, WHEREAS, the Owner is willing to make certain assurances and agreements relating to these identified code deficiencies and on the basis of such assurances the County is willing to issue a Certificate of Occupancy. NOW, THEREFORE, it is agreed as follows: A. The Owner agrees to do the following: Deficiency No. 1. ACTION REQUIRED OF THE OWNER: The Owner will provide a door or an escape rescue window from the basement in compliance with U.B.C. Section 1204. If a window and a window well are provided, the well shall be no deeper than 44 inches unless a ladder or terraced route from the well is provided. The clear width of the well at the front of the window shall be not less than 3 feet. The sill height of the window shall be no higher than 44 inches above the floor of the basement. The total openable area of the window shall equal a minimum of 5.7 sq. ft. All work shall be completed in compliance with the stated provisions of the codes currently adopted by Garfield County in a manner that will enable approval of all work. All work, inspections and approval of work shall be completed by May 15, 1995 and no use or habitation of the basement is permitted until the installation has been inspected and approved. B. In the event the Owner fails to perform as agreed on any of the above, the County may revoke any permits which may have been granted to the Owner. The County may require the habitation and occupancy of the house cease immediately. C. This agreement is binding upon the heirs, successors in title, and assigns of the parties.
