PROJECT INFORMATION AND STAFF COMMENTS
REQUEST: Exemption from the definition
of subdivision.
APPLICANT: Duane Scott
LOCATION: A tract of land known as Lot 4
of Section 30, Lot 1 of Section
31, 5 1/2 SE 1/4; SE 1/4 SW 1/4
and a portion of NE 1/4 NW 1/4;
N 1/2 NE 1/4 of Section 36 in
T6S, R92W of the 6th P.M.:
located 5 miles south of Silt
at the intersection of C.R. 311
(Divide Creek) and C.R. 326
(Richardson Highway).
SITE DATA: The site consists of 331 acres.
WATER: Existing well.
SEWER: Existing and proposed I.S.D.S.
EXISTING AND ADJACENT ZONING: A/R/RD
I. RELATIONSHIP TO THE COMPREHENSIVE PLAN
The subject property is located in District C - Rural Area/
Minor Environmental constraints as designated on the Garfield
County Comprehensive Plan Management Districts' map.
II. DESCRIPTION OF THE PROPOSAL
A. Site Description: The subject property is located on the
west side of Divide Creek Road south of the exotic game
ranch. The property is primarily gently sloping pasture
lands. Improvements on the property include a single
family residence and associated outbuildings. Access to
the residence is via a driveway off C.R. 326 (see
attached maps on pages & fix ) .
B. Project Description: The applicant is proposing to split
out two 2 acre from the existing 331 acre tract. The
purpose of creating the two new parcels is for homesites
for the applicant's two sons.
According to the Assessor's Office, the parcel is in its
original configuration and thus qualifies for the
exemption process.
III. MAJOR ISSUES AND CONCERNS
A. SCS soils information does not indicate any significant
limitations on conventional homesite development
including foundations and wastewater systems.
B. The applicant has an existing domestic well permitted on
the property. This well is intended to provide water for
the existing as well as the two proposed residences (see
attached permit on page J'% ). No response from D.W.R.
has been received to date.

C. The subject property is contained within the Silt -New
Castle Fire District. No site-specific response from the
Fire District was submitted with the application.
D. The two proposed parcels will be located along the south-
ern edge of the parent parcel adjacent to the existing
driveway. No new ingress/egress points onto the county
road will be required.
IV. SUGGESTED FINDINGS
1. That proper posting and public notice was provided as
required by law for the meeting before the Board of
County Commissioners.
2. That the meeting before the Board of County Commissioners
was extensive and complete, that all pertinent facts,
matters and issues were submitted, and that all
interested parties were heard at that meeting.
3. That for the above stated and other reasons, the proposed
exemption is in the best interest of the health, safety,
morals, convenience, order, prosperity and welfare of the
citizens of Garfield County.
V. RECOMMENDATION
1. That all representations of the applicant, either in the
application or stated at the public meeting, shall be
considered conditions of approval unless otherwise
approved by the Board of County Commissioners.
2. That the applicant shall have 120 days to obtain approval
of the plat. The applicant may request extensions of 6
months not to exceed 1 year from the original date of
approval.
3. The applicant shall submit $400 in School Impact fees for
the newly created lots.
4. Forest Service and State Forestry Wildfire Prevention
Guidelines shall be implemented in the development of the
proposed lots and homesites.
5. The proposed parcels shall conform with the design and
development standards outlined in Section 3.02: A/R/RD
Zone District and Section 5: Supplementary Regulations of
the Garfield County Zoning Resolution.
6. The applicant shall provide verification of service from
the Silt -New Castle Fire District. Any requirements of
the Fire District shall be considered conditions of
approval.

ISSUANCE OF THIS PERMIT DOES NOT CONFER A WATER RIGHT
CONDMONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of the
permit does not assure the applicant that no injury will occur to another vested water right or preclude another
owner of a vested water right from seeking relief in a civil court action.
2) Approved pursuant to CRS 37-92-602(3)(b)(II)(A) for expanded use of the well constructed under permit 28985 as
the only well on a tract of land of 42 acres described as the NE 1/4 of the NE 1/4 and that part of the SE 1/4 of the
NE 1/4 described on the attached exhibit 'A', all in Sec. 36, Twp. 6 S., Rng. 92 W. of the 6th P.M., Garfield County.
3) The use of ground water from this well is limited to ordinary household purposes inside 3 single family dwellings,
fire protection, the watering of poultry, domestic animals, and livestock on farms and ranches, and the irrigation of
not over one (1) acre of home gardens and lawns.
4) The return flow from the use of the well must be through an individual waste water disposal system of the
non -evaporative type where the water is returned to the same stream system in which the well is located.
5) The maximum pumping rate shall not exceed 15 GPM.
6) This well shall be constructed not more than 200 feet from the location specified on this permit.
7) Issuance of this permit cancels permit 28985. 271-177, 9-/D - ;v
