following proceedings, among others were had and done, to -wit:
RESOLUTION NO. 90-105
A RESOLUTION CONCERNED WITH GRANTING AN EXEMPTION FROM THE GARFIELD
COUNTY SUFDIVISION REGULATIONS FOR DUANE SCOTT.
WHEREAS, Duane Scott has petitioned the Board of County
Commissioners of Garfield County, Colorado, for an exemption from the
definition of the terms "subdivision" and "subdivided land" under C.R.S.
1973, 30-28-101 (10) (a) -(d), as amended, and the Subdivision
Regulations of Garfield County, Colorado, adopted April 23, 1984,
Section 8:00 through 8:60 and for the division of a 331 acre tract as
described in Book 704, Page 094, as filed in the Office of the Clerk and
Recorder of Garfield County, Colorado into three parcels of
approximately 2.00 acres, 2.00 acres and 227 acres each, more or less,
which proposed divided tracts are more practically described as follows:

Parcel 2: See Attached
Parcel 3: See Attached
(in the State of Colorado and the County of Garfield); and
WHEREAS, the Petitioner has demonstrated to the satisfaction of the
Board of County Commissioners of Garfield County, Colorado, that the
proposed division does not fall within the purposes of Part 1, Article
28, Title 30, Colorado Revised Statutes 1973, as amended, for the reason
that the division does not warrant further subdivision review, and
WHEREAS, the Petitioner has demonstrated to the satisfaction of the
Board of County Commissioners of Garfield County, Colorado, that there
is a reasonable probability of locating domestic water on each of said
parcels, that there is existing ingress and egress to said parcels, that
the location of septic tanks will be permitted by the Colorado
Department of Health, that the requested division is not part of an
existing or larger development and does not fall within the general
purposes and intent of the subdivision regulations of the State of
Colorado and the County of Garfield, and should, therefore, be exempted
from the definition of the terms "subdivision" and "subdivided land" as
set forth in C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended;

NOW, THEREFORE, BE IT RESOLVED that the division of the above
described parcels "1", "2" and "3" from the above described 331 acre
tracts are hereby exempted from such definitions and said tracts may be
divided into said parcels "1", "2" and "3" and may be conveyed in the
form of such parcels "1", "2" and "3", all as is more fully described
above and that a copy of the instrument or instruments of conveyance
when recorded shall be filed with this Resolution.

NE 1/4 NE 1/4 of Section 36, Township 6 South, Range 92 West of the 6th
Principal Meridian, County of Garfield, State of Colorado, and being
more particularly described as follows:
Commencing at the Northeast corner of said SE 1/4 NE 1/4;
thence N 00 48' 25" E a distance of 26.68 feat to the point
of beginning; thence N 89 08' 56" W a distance of 60.00 feet;
thence S 00 48' 25" W a distance of 157.05 feet; thence N 89
43' 54" W a distance of 292.90 feet; thence N 37 40' 51" W a
distance of 83.09 feet; thence N 51 43' 36" W a distance of
180.05 feet; thence N 00 48' 25" E a distance of 34.65 feet
to the Southerly line of Lot 2, Scott Exemption Plat; thence

thence N 00 48' 25" E a distance of 81.29 feet to the point
of beginning; thence N 00 48' 25" E a distance of 159.20
feet; thence N 89 43' 54" W a distance of 547.53 feet; thence
S 00 48' 25" W a distance of 159.20 feet to the Northerly
line of Lot 1, Scott Exemption Plat; thence along said
northerly line S 89 43' 54" E a distance of 547.53 feet to
the point of beginning, described parcel containing 2.00 acres
more or less.
LOT 3
Lot 4 of Section 30; Lot 1 of Section 31, Township 6 South, Range 91
West of the 6th Principal Meridian; S 1/2 SW 1/4; SE 1/4 SW 1/4 and that
part of NW 1/4 SE 1/4 of Section 25 lying South and East of Divide
