HomeMy WebLinkAbout1.0 Application• • PETITION FOR EXEMPTION TO: BOARD OF COUNTY COMMISSIONERS OF GARFIELD COUNTY, COLORADO ELWYN J. SCHROCK and SYLVIA JOAN SCHROCK (Schrock) and DONALD F. STARR and SHIRLEY A. STARR (Starr), hereby petition the Board of County Commissioners of Garfield County, Colorado, to adopt a resolution excepting the sale of a parcel of land from Schrock to Starr from the definition of the terms "subdivision" and "subdivided land" under C.R.S. 1973, 30-28-101, 10(a) and from regulation under the Garfield County Subdivision Regulations, as amended and as reason therefor state as follows: 1. Schrock is the owner of the parcels of land described on Exhibit "A" attached hereto and by this reference made a part hereof. 2. Schrock occupies as his residence Parcel No. 1 described on Exhibit "A" hereof and Starr, under a rental agreement with Schrock, occupies Parcel No. 2 described on Exhibit "A" as his residence, which rental agreement has been in effect for a period in excess of five years. 3. The construction of the residences on Parcels 1 and 2 as aforesaid and the occupation thereof has been in existence since a time prior to the adoption of the legislation known as Senate Bill No. 35 and prior to the adoption of the Garfield County Subdivision Regulations. 4. Each of the residences located on Parcels 1 and 2 described on Exhibit "A" hereof receive their water from the Noname Creek Water Association Incorporated; each residence has its individual septic tank and leech field; access to the property • • is obtained from Colorado Highway 6 & 24 to a 25 foot easement which traverses the Westerly side of both Parcels 1 and 2 described on Exhibit "A" hereof. 5. That neither Schrock nor Starr own any other property which is contiguous to the parcels of land the subject of this petition. 6. That Schrock now desires to sell and Starr desires to buy Parcel No. 1. 7. That by granting the requested exemption, the intent and purpose of State and County statutes, resolutions and rules and regulations will be fulfilled in fact. Parcel No. 2: The Northerly 100 feet of the following described tract of land. A tract of lard being a part of the property acquired by Robert P. Dally from George Hammerich and Charlotte E. Hammerich by Warranty Deed dated April 24, 1961, recorded in the office of the Clerk and Recorder of Garfield County, Colorado, as Doc. No. 213611 in Book 333 at Page 583, said tract of land being situate in the NE4SW1/4, Section 2, Tp. 6 S., R. 89 W., of the 6th P.M., more particularly described as follows, to -wit: Beginning at a point on the West line of said above described tract of land where said West line intersects the southerly right of way line of Colorado Highway No. 6 and 24, thence South 0°02' East along the West line of the above described tract of land 200 feet, thence South 88°18' East 124 feet to a point on the East line of the above described tract of land, thence North 0°02' West to the South right of way line of said Colorado State Highway No. 6 and 24 and thence along the South boundary of said right of way to the point of beginning. 4 #7‘ wy_p/f(?
