RESOLUTION

WHERAS, Elwyn J. Schrock, Sylvia. joan Schrock,
Donald F. Starr and. Shirley a. Starr have petitioned the Loa, -.(d
of County Commissioers of Garfield County, Colorado, for
an exemption und= C.R.S, 1973, 30-28-101(10)(a) and (d),
and the Garfield County Subdivision Regulations, as amended,
and.
WHEREAS, the Board finds that the division of the
tract of land located in the NE1/4SW4 of Section 2, Township 6
South, Rang 89 West of the 6th P,M. into the two parcels
of land denominated Parcel 1 and Parcel 2 ori Exhibit "A" attached
hereto and by this reference made a part hereof, will not
be made for the purpose of evading State and County statutes
and resolutions pertaining to the subdivjsion of land and
that the same should be exempt from the definition of the
terms "subdivision" and "subdivided land" and from regulation
under the Garfield County Subdivision Regulations, as amended.

NOW, THEREFORE, upon motion
seconded by 1,7 777%,: ' ' and unanimously carried, the
division of the tract of land above referred to into the tracts
of land more particularly described as Parcel 1 and Parcel 2
on Exhibit "A" hereof is hereby exempted from the definition
of "subdivision" and. "subdivided land" and from regulation
under the Garfield County Subdivision Regulations and that:
the property may be divided into the pareels as described

Zoning Board of Adjustpcnt ana a variance J: granted thereof.

A tract of land being a part of the property acquired by
Robert. P. Dally from George Hammer: ch and Charlotte E. Hammerich
by. Warranty Deed dated April 24, 1961, recorded in the office
of the Clerk and Recorder of Garfield County, Colorado,
as Doc. No. 213611 in Book 333 at Page 583, said tract of
land being situate in the NE1/4SN4, Section 2, Tp. 6 S., R.
89 W. , of the 6th. P.M.., more particularly described as follows,
to -wit:
Beginning at a point on the West line of said above described
tract of land where said West line intersects the southerly
right of way line of Colorado Highway No 6 and 24, thence
South 0°02East along the West line of the above described
tract.of land 200 feet, thence South 88'18' East 124 feet
to a point on the East lino of the above described tract
of land, thence North 0002' West to the South right of way
line of said Colorado State Highway No. 6 and 24 and thence
along the South boundary of said right of way to the point
of beginning.
