HomeMy WebLinkAbout2.0 BOCC Staff Report 05.21.1990REQUEST: BOCC 5/21/90 PROJECT INFORMATION AND STAFF COMMENTS Exemption from the Definition of Subdivision APPLICANT: Andrew Schwaller LOCATION: A tract of land situated in the SE 1/4, Sec. ,21 and the SW 1/4 of Sec. 22, T7S, R88W of the 6th P.M. ; located 1.5 miles north of Carbondale in the Red Hill area off County Road 107 (Red Hill Rd.). SITE DATA: The site consists of a 124 acre tract. WATER: Individual Well SEWER: Individual Sewage Disposal System ACCESS: Access off County Road 107. EXISTING ZONING: A/R/RD ADJACENT ZONING: A/R/RD and O/S I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The subject property is located in District F, Rural Areas with Severe Environmental Constraints as designated on the Comprehensive Plan Management District map. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The site is located in a rural portion of the County with adjacent land uses primarily agricultural, residential and open space. The site is divided in half between meadows and slopes treed with pinon-juniper. The only improvement on the property is an existing metal barn. B. Project Description: The applicant proposes to divide the 124 acre parcel into two tracts of 114 and 10 acres in size. The proposed 10 acre tract will be located at the northeast corner of the parent parcel. The reason for this request is to create a salable tract. C. History: The existing 124 acre parcel was created in March of 1990 by splitting a 250 acre parcel roughly in half. III. MAJOR ISSUES AND CONCERNS 1. The proposed 10 acre tract is steeply sloped, with slopes ranging from 25% to 30%. These slopes are potentially unstable and may be subject to subsidence. Engineered foundations and wastewater systems should be required. 2. The parent parcel is currently traversed by an irrigation ditch. According to the applicant, half -interest in an existing well on adjacent property will provide domestic water. Division of Water Resources has not responded to staff's request for comment on this proposal. IV. V. 0_776; 1 e (1U34 ,e • 3. County Road 107 runs parallel to and forms the eastern boundary to a portion of the parent parcel. An access easement from C.R. 107 to the proposed 10 acre tract will be required. Road cuts should be limited to avoid extensive scarring and increasing erosion potential. 4. Electric power is currently available to the property. 5. The applicant is an authorized representative of the owner, who resides out of state. SUGGESTED FINDINGS 1. That proper posting and public notice was provided as required by law for the meeting before the Board of County Commissioners. 2. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. That for the above stated and other reasons, the proposed exemption is in the best interest of the health, safety, welfare, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. RECOMMENDATION APPROVAL, with the following conditions: 1. That the following plat notes be included on the Exemption Plat; a. That engineered foundations and individual sewage disposal systems,,' be required. b. That an access easement of at least 30 foot width be shown extending to the proposed 10 acre tract from C.R. 107. 2. That the applicant shall demonstrate approval of a shared domestic well by the Division of Water Resources. Easements for the waterline shall be included on the Exemption Plat. 3. That the applicant submit $200 in School Impact Fees for the creation of the one new lot. 4. That the applicant shall obtain a permit for the access easement off C.R. 107 from the County Road and Bridge Department. 5. That all representations of the applicant, either within the application or stated at the meeting before the Board of County Commissioners, shall be considered conditions of approval. 6.
