PROJECT INFORMATION AND STAFF COMMENTS
REQUEST: An exemption from the definition of
Subdivision
APPLICANT: Norm Schmeeckle/Pat Irwin

the intersection of C.R. 320 and

I. RELATIONSHIP TO THE COMPREHENSIVE PLAN
The subject property is located in District B - Subdivisions Rural Serviceable Areas 0
to 1/2 mile radius as designated on the Garfield County Comprehensive Plan
Management Districts map.
II. DESCRIPTION OF THE PROPOSAL
A. Site Description: The subject property is the first parcel on the east side of the
County Road (C.R. 323) after crossing the Colorado River at Rulison.
The property extends southward from the river to C.R. 320. An undetermined
portion of the property is in the regulated floodplain of the Colorado River.
Improvements on the property consist of a small log cabin, a single family
residence under construction and a temporary mobile home. The remainder of
the property consists of both trees and pasture.
B. Project Description: The applicants are requesting an exemption to allow the
41.8 acre parcel to be split into two (2) twenty-two (22) acre parcels. The
applicants, brother and sister, purchased the property together and would both
like to build residences and live on the property. The residence currently under

construction on the property belongs to Mr. Schmeeckle.
III. MAJOR ISSUES AND CONCERNS
1. Section 8:10 (Applicability - Exemptions) states that the Board has discretionary
authority to except a division of land from the definition of subdivision.
Following a review of the facts of each application, the Board may approve
conditionally or deny an exemption request. The Board may not grant an
exemption unless the applicant can demonstrate compliance with zoning, legal
access, adequate water and sewer, state environmental health standards,
necessary road and drainage improvements, fire protection, adequate easements
and school impact fees.
2. The proposed split appears to conform to the requirements of Section 8:10 with
regard to the four (4) lot limitation. If approved, the proposed exemption would
create the second parcel of record from that parcel in existence on January 1,
1973. This regulation would potentially allow for the creation of two (2)
additional parcels at a later date, unless otherwise prohibited.
3. The Comprehensive Plan designation on the subject property indicates the site's
proximity to a developed subdivision. However, the designation belies the fact
that only a sketch plan approval for an industrial park exists in the vicinity of
the Rulison interchange. Otherwise, the proposal does not appear to conflict
with the goals of the Comprehensive Plan.
4. The regulated floodplain parallels the Colorado River along the northern
portion of the property. Soils information indicates the presence of some clays.
Percolation tests for the new wastewater system indicate acceptable rates.
5. The Rifle Fire District has reviewed the application and has indicated no
objections to the proposal.
6. Access to the new parcels could be obtained directly from the County road(s)
depending on the orientation of the common lot line or via easement across the
adjacent parcel.
7. In their review letter, the Division of Water Resources indicated the presence of
a second well serving the residence under construction. However, there is no
physical evidence of this well on the subject property. The Division of Water
Resources has requested that the application be held in abeyance. This matter
should be resolved, and some assurance of the availability of a well permit, prior
to the approval of a plat and resolution.
IV. SUGGESTED FINDINGS
1. The proposal is in general compliance with the Garfield County Comprehensive
Plan and the Garfield County Zoning Regulations.
2. The proposed land use would be consistent and compatible with the existing
surrounding land uses.
3. If the noted access concerns can be adequately addressed, the proposal is in best

interest of the health, safety, morals, convenience, order, prosperity and welfare
of the citizens of Garfield County.
V. RECOMMENDATION
APPROVAL, subject to the following conditions:
1. All representations of the applicant shall be considered conditions of approval
unless otherwise stated by the applicant.
2. The applicant shall have 120 days to complete the required conditions of
approval. Extensions of 120 days may be granted by the Board for a period of
up to one (1) year.
3. The applicant shall submit $200 in School Impact Fees.
4. The following notes shall be included on the exemption plat:
a. All lots may be subject to the requirement of engineered foundations and
wastewater systems.
b. State Forest Service wildfire prevention guidelines shall be required for
residential construction.
c. The regulated floodplain of the Colorado River traverses the subject
property. Floodplain regulations are applicable.
5. All existing easements shall be depicted on the exemption plat.
6. Approval of the proposed water supply plan from the Division of Water
Resources shall be provided.
7. A well sharing agreement shall be prepared and recorded with the exemption
plat. The agreement shall address maintenance, access and improvements to the
water system. An easement from the well to the larger parcel shall be provided.

Dear Mr. McGregor:
We have reviewed the above referenced proposal to split 41.8 acres into two tracts of
approximately 21 acres each. The water supply for the two parcels is apparently to be provided by
well permit number 63623. Our records indicate another domestic well, permit no. 149640, was
registered in the SW 1/4 of the SW 1/4 of section 30 on a 7.7 acre parcel. The location indicated
on the application for well permit no. 149640 would place the well on the above referenced 41.8
acre parcel. No mention of this well or the 7.7 acre parcel was included in the subject proposal.
Due to the possible conflict in parcel information and well location, we are unable to
continent on the adequacy of the water supply until a surveyor's plat map can be provided that
shows the parcel boundaries and the location of all wells on the property. Until this information
can be provided, we must ask that this proposal be held in abeyance.

Dear Norm:
Your application for a Subdivision Exemption, located off County Road 323,
has been scheduled for a public meeting before the Board of County
Commissioners on June 15, 1992, at 11:30 a.m., in the Commissioners' Meeting
Room 301, Garfield County Courthouse, 109 8th Street, Glenwood Springs, CO
81601. It is suggested that you be present at the time of the meeting.
Copies of the enclosed exemption public notice form need to be mailed by
certified return -receipt to all property owners adjacent to or within 200 ft.
of your property at least 15 days, but not more than 30 days, prior to the
meeting. In addition, the notice needs to be mailed by certified return -
receipt to owners of mineral rights, or lessees of mineral owners of record
of the land proposed for exemption, at least 15 days, but not more than 30
days, prior to the meeting. The certificates of mailing and return -receipts
from these mailings need to be presented at the time of the meeting or
submitted to the Planning Department prior to the meeting. The exemption
site must also be posted with the enclosed Notice poster, visible from a
County Road, at least 15 days, but not more than 30 days, prior to the
meeting.

TAKE NOTICE that Norman Schmeckle and Pat Irwin have applied to the
Board of County Commissioners, Garfield County, State of Colorado,
to grant a subdivision exemption in connection with the following
described property situated in the County of Garfield, State of
Colorado; to -wit:

Practical Description (location with respect to highway, County
roads and residences): Located at the intersection of C.R. 320 and
C.R. 323 in Rulison.
Said subdivision exemption is to allow the petitioner to divide a
41.8 acre tract into two (2) tracts of approximately 21 acres each
in size
on the above described property.
All persons affected by the proposed subdivision are invited to
appear and state their views, protests or objections. If you
cannot appear personally at such meeting, then you are urged to
state your views by letter, particularly if you have objections to
such subdivision exemption request, as the Board of County
Commissioners will give consideration to the comments of
surrounding property owners and others affected in deciding whether
to grant or deny the request for the subdivision exemption. This
subdivision exemption application may be reviewed at the office of
the Planning Department located at 109 8th Street, Suite 303,
Garfield County Courthouse, Glenwood Springs, Colorado, between the
hours of 8:00 a.m. and 5:00 p.m., Monday through Friday.
That public meeting on the application for the above subdivision
exemption request has been set for the 15th day of June, 1992, at

55—Potts loam, 3 to 6 percent slopes. This deep,
well drained, moderately sloping soil is on mesas, bench-
es, and sides of valleys. Elevation ranges from 5,000 to
7,000 feet. This soil formed in alluvium derived from
sandstone, shale, or basalt. The average annual precipi-
tation is about 14 inches, the average annual air tem-
perature is about 46 degrees F, and the average frost -
free period is about 120 days.
Typically, the surface layer is brown loam about 4
inches thick. The subsoil is reddish brown clay loam
about 24 inches thick. The substratum is pinkish white
loam to a depth of 60 inches.
Included with this soil in mapping are small areas of
Olney, Kim, and Ildefonso soils that have slopes of 3 to
6 percent. These areas make up 10 to 15 percent of the
map unit.
Permeability is moderate, and available water capacity
is high. Effective rooting depth is 60 inches or more.
Surface runoff is slow, and the erosion hazard is moder-
ate.
This soil is used mainly for irrigated crops and hay and
for dryland farming (fig. 10). Alfalfa, small grains, and
grass -legume hay are grown. Small areas are used for
grazing.
These soils are usually irrigated by flooding. Drop
structures in irrigation ditches, grassed waterways, and
minimum tillage prevent serious erosion. Irrigation water
should be carefully managed to avoid piping and erosion.
Cover crops or stubble mulching also help to limit ero-
sion in dryfarmed areas.
The native vegetation on this soil is mainly wheat -
grass, needleandthread, and sagebrush.
When range condition deteriorates, forbs and shrubs
increase. When the range is in poor condition, undesira-
ble weeds and annual plants are numerous. Properly
managing grazing maintains and improves range condi-
tion. Reducing brush improves the range. Seeding im-
proves range in poor condition. Crested wheatgrass,
western wheatgrass, and Russian wildrye are suitable for
seeding. Preparing a seedbed and drilling the seed are
good practices.
Pheasant, mourning dove, cottontail rabbit, some mule
deer, and squirrel find habitat on this soil.
Community development and recreation are limited by
low strength and the shrink -swell potential. Dwellings
and roads can be designed to overcome these limita-
tions. Community sewage systems will be needed if the
population density increases.
This soil is in capability subclasses Ille, irrigated, and
IVe, nonirrigated.

The Potts soil makes up about 60 percent of the map
unit, and the Ildefonso soils makes up about 30 percent.
The Potts soil is on slightly concave positions, and the
Ildefonso soil is on the breaks of steeper slopes.
The Potts soil is deep and well drained. Typically, the
surface layer is brown loam about 4 inches thick. The
subsoil is reddish brown clay loam about 24 inches thick.
The substratum is pinkish white loam that extends to a
depth of 60 inches.

Dear Mr. McGregor:
We have reviewed the above referenced proposal to split 41.8 acres into two tracts of
approximately 21 acres each. The water supply for the two parcels is apparently to be provided by
well permit number 63623. Our records indicate another domestic well, permit no. 149640, was
registered in the SW 1/4 of the SW 1/4 of section 30 on a 7.7 acre parcel. The location indicated
on the application for well permit no. 149640 would place the well on the above referenced 41.8
acre parcel. No mention of this well or the 7.7 acre parcel was included in the subject proposal.
Due to the possible conflict in parcel information and well location, we are unable to
comment on the adequacy of the water supply until a surveyor's plat trap can be provided that
shows the parcel boundaries and the location of all wells on the property. Until this information
can be provided, we must ask that this proposal be held in abeyance.
