Sims 10918 CR245 New Castle, CO 81647 Dear Mr. Sims: This letter is notification that your Certificate of Occupancy has been revoked due to your failure to obtain a final electrical inspection from the State of Colorado Electrical Inspector. A Iiual electrical inspection is required by the State of Colorado, and is required by Garfield County as a condition for a final inspection and a Certificate of Occupancy. Occupancy and use of the stn1cture without obtaining a final electrical inspection is illegal, and is in violation of Section I 02 of the Uniform Building Code, 1994 Edition. By this letter, you are being notified that any use or occupancy of the stntcture is illegal, and must be discontinued until the Garfield County Building department receives verification that the final electrical inspection has been passed. Kelly Sims -Page 2 Please be advised that the provision of the Garfield County Building Code, as amended, and Section 30-28-209 of the Colorado Revised Statutes (CRS) as amended provide that is unlawful to use any building or structure in violation of the County Building Code Resolution or amendment duly adopted by the Board of County Commissioners. Any person, firm, or corporation found to have violated such building codes is guilty of a misdemeanor and, upon conviction, can be punished by a fine of not more than $100, or by imprisonment in the County Jail for 10 days, or both. Each day can be considered a separate violation. The County also has civil remedies available to it, including the initiation of legal proceedings to obtain the injunction or abatement of any illegal construction or use of a building or structure in violation of the County Building Code Resolution. Within 15 Days of the receipt of this letter, you must contact the County Building Department to schedule a compliance inspection to verify that all use and occupancy of the building has ceased. If you do not contact this office within the time period noted, the next course of action would be to tum over all information to the County Attorney's office for legal action. It is our preference to resolve this type of issue without going to court, but your cooperation is needed to avoid litigation.
