We cannot approve any further encroachments ¡nto the 35ft. setback from the high water mark as required by section 7-203 Protection of Water Bodies. lt would appear the gazebo is a legal nonconforming structure due to a port¡on of it being in both the required setback and also the 100 year floodplain. Allowing the new construction to further encroach or become more non-conforming is counter to the code as per section LO-t-2 A of the Land Use and Development Code adopted by the county. Replacement of the roof and other improvements not in the setback or floodplain as per your approved building plans are O.K. to proceed with. Any landscape work within the floodplain could require a floodplain review and possibly a permit. Please contact Glenn Hartmann our floodplain administrator if you anticipate any work in the 100 year floodplain. Please call with any questions or comments. We will be issuing the building permit later today with the above conditions attached. From what I understand, Colorado Revised Statute 25-7-40L (the county has adopted this for wood burning stoves) is based off the EPA Phase ll Devise standards... which are meant for fireplaces/stoùes, not appliances. The EPA has never tested appliances, therefore no standards exist. The intent of this wood burning pizza oven is to use it occasionally in the summer or early fall, and not ¡n the winter months. This project, including the knowledge of the wood burning pizza oven, has already been approved by Aspen Glen... they only asked that we run it by the county to make sure that it falls within their regulations. ln speaking with the wood burningpizza oven manufacturer (Mugnaini), their wood burning ovens are very efficient and use minimal amounts of wood for the process... the particulates that this oven will give off are much less than any fire- pit you can buy from Walmart and set out on your back patio. Older surveys of the lot also show a small portion of the building envelope possibly in the floodway at the location of the gazebo. We could not find a floodplain permit related to the gazebo and are of the impression the structure is non-conforming but legal. Any substantial changes to the structure within the 100 year floodplain would need a floodplain permit at a m¡n¡mum. lt also could be further construction within the 35 ft. river setback is not allowed. We need to check this with the legal department and the director at the next staff meet¡ng to determine. No construction of this type is allowed in the floodway. We will not be able to issue the grading permit or the building permit until the above items are addressed. Verification of the 35 ft. setback, 100 year flood plain and actual floodway might also be a good idea. We will hold the plans until we hear from you.
