I. DESCRIPTION OF THE PROPOSAL
A. Site Description: The site consists of land sloping from the
north to the south, with slopes in excess of 50% to areas around
10%. The site presently has two houses, with associated
improvements such as storage sheds and a small swimming pool.
B. Project Description: It is proposed to split the 1.47 acre
parcel into two parcels approximately .053 and .094 acres in
size. Each parcel would have one of the existing houses which
each have an individual sewage disposal system (I.S.D.S.) and
water tap from the No Name Creek Water Association. Access to
the easterly property is technically from the I-70 right-of-way
and an easement granted by the Colorado Department of Highways.
The westerly property is accessed from the grontage road for
I-70.
C. History: These parcels were originally purchased under separate
deed in 1949 and 1954. As a result of taking the two deeds in
the same name and type of ownership, they were merged together
for the purposes of subdivision and assessment.
II. MAJOR ISSUES AND CONCERNS
A. Zoning: The property is zoned R/L/SD, which allows a minimum lot
size f 20,000 sq. ft. This lot is technically a non -conforming
lot of record with regard to the minimum lot size requried for an
I.S.D.S. The Zoning Resolution calls for a minimum of a 1.0 acre
lot, if there is central water. Prior to I-70 condemnation, both
of these parcels met the 1.0 acre requirements.
B. All water, utility and access easements must be shown on the
Exemption Plat.
III.SUGGESTED FINDINGS
1. That proper posting and public notice was provided as required by
law for the meeting before the Board of County Commissioners.

2. That the meeting before the Board of County Commissioners was
extensive and complete, that all pertinent facts, matters and
issues were submitted, and that all interested parties were heard
at that meeting.
3. That for the above stated and other reasons, the proposed
exemption is in the best interest of the health, safety, morals,
convenience, order, prosperity and welfare of the citizens of
Garfield County.
IV. RECOMMENDATION
APPROVAL, with the following conditions:
1. That the following plat notes and graphic representations be
included on the recorded Exemption Plat:
A. No further divisions by exemption from the definition of
subdivision will be allowed.
B. That all water, utility and access easements be shown on the
plat with reference to any recorded document having legal
descriptions of said easements.
2. That all representations of the applicant, either within the
application or stated at the meeting before the Board of County
Commissioners shall be considered conditions of approval.
