I. BACKGROUND — DESCRIPTION OF PROPOSAL
The Roaring Fork Water and Sanitation District requests a Location & Extent review by
the Garfield County Planning Commission for their existing wastewater treatment facility
and the proposed expansion. The proposed expansion is needed to allow the District to
meet future effluent limits required by the State Water Quality Control Commission. It will
also allow the District to provide adequate service to an expanding population according
to the District's 20 -year planning horizon.
The proposed expansion will occur on an approximately 6.06 acre parcel, where a
wastewater treatment facility is already located. Currently, the primary influent is
residential wastewater. The anticipated utility connections to the RE -1 Eastbank School
will result in modest commercial contributions to the facility. The current wastewater
treatment facility is operated with an existing capacity of 0.107 million gallons per day.
The proposed expansion will increase the total capacity to 0.214 million gallons per day,
with an anticipated third phase, that will result in a capacity of 0.321 million gallons per
day at buildout.
The Service Area for the District can generally be described as the Roaring Fork Valley
floor between Carbondale's and Glenwood Springs' municipal service area boundaries.

II. VICINITY AND ADJACENT USES
Generally, the parcel is located west of SH 82 and the Roaring Fork River, approximately
3.3 miles northwest of Carbondale and is located off of County Road 109. The county
parcel id is 239513102065.
Adjacent land uses to the property include a gravel pit and some open space parcels
owned by the District and the Aspen Glen Homeowners Association. Although not
directly adjacent to the property, there are some single-family residences located in the
area. Because of existing topography, the facility is well -screened from adjacent uses.
III. REFERRALS
Staff referred this application to the following agencies for review and comment (see
attached exhibits for full comments):
1. Garfield County Road & Bridge (Exhibit 7): Michael Prehm responded that Road
and Bridge had no concerns.
2. Carbondale & Rural Fire Protection District (Exhibit 2): Bill Gavette responded that
the current access to the existing facility is adequate for fire apparatus and that
he has no other issues with the proposed expansion.
3. State of Colorado Water Quality Control Division (Exhibit 8): Bret Icenogle
responded that the Water Quality Control Division had no comments.
4. Garfield County Attorney (Exhibit 3): Kelly Cave responded that she did not have
any additional comments on the application.
5. Garfield County Vegetation Manager (Exhibit 4): Steve Anthony responded with a
request that the applicant map the property for county listed noxious weeds and
manage any weeds that are found. He requested that the Applicant supply his
office with treatment records by September 30, 2017.
6. Parks and Wildlife (Exhibit 6): Perry Will responded that the Wastewater
Treatment Facility is located approximately 300 feet from a known osprey nest
site and within the great blue heron nesting buffer of the largest heronry along the
Roaring Fork River. Additionally, this area experiences heavy use by elk during
winter months and is classified by CPW as general winter range habitat for elk
and mule deer. Mr. Will recommended that construction activities not occur
between the dates of February 15 to June 15 to account for Great Blue Heron
nesting season. Additionally, he recommended that construction workers keep all
food and trash within locked vehicles and haul their trash off-site at the end of
each workday to address possible bear attractant issues.

7. Mountain Cross Engineering (Exhibit 5): Chris Hale responded that the review
generated no comments.
Referrals were also sent to Aspen Glen HOA — Design Review Board, Roaring Fork
Water and Sanitation District, RE -1 School District, US Army Corps of Engineers, US
Army Corps of Engineers Biologist, State of Colorado Health Department — Air Pollution,
State of Colorado Health Department — Hazardous Materials and Waste, and Garfield
County Environmental Health. No comments were received from these agencies.
Staff has received no public comment on the wastewater treatment facility or proposed
expansion.
IV. AUTHORITY — CRITERIA
1. The request is being considered in accordance with Garfield County Land Use
and Development Code, Section 4-111 Location and Extent Review. The review
criteria for a location extent review is noted below.
Location and Extent Review Criteria — Section 4-111 (C)
The Planning Commission shall determine whether the project is in general
conformance with the Comprehensive Plan.
2. Decision making authority for Location and Extent Review is with the Planning
Commission and the Commission may approve or disapprove of the request
based on the above criteria. A finding of disapproval may be appealed in
accordance with the Colorado Revised Statutes.
3. The basis for the Location and Extent Review is found in the Colorado Revised
Statutes (§30-28-110(1)(a)) that requires "... Whenever any county planning
commission...has adopted a master plan of the county...no road, park, or other
public way, ground, or space, no public building or structure, or no public utility,
whether publicly or privately owned, shall be constructed or authorized in the
unincorporated territory of the county until and unless the proposed location and
extent thereof has been submitted to and approved by such county planning
commission."
4. Review with the County Attorney's Office has determined that conditions of
approval relevant to the review criteria may be appropriate and can be included
in the Planning Commission decision on the Location and Extent Review.
V. STAFF REVIEW AND ANALYSIS
1. Public notice required for the Location and Extent Review included publication,
posting, and certified mailing to property owners within 200 ft. and mineral right owners.
Review of the Applicant's Public Notice demonstrated that no legal description had been
included in the published newspaper notice. Staff has determined that this omission can

be addressed under the Constructive Notice Provision of the Land Use and Development
Code, Section 4-1O1(E)(5). According to this provision, the planning commission can
make a formal finding regarding whether there was substantial compliance with the notice
requirements of this Code before proceeding with the hearing. No public comments have
been received on the application.
2. Future Land Use Map - The Garfield County Comprehensive Plan 2030 designates
the parcel as Residential Medium High. An excerpt from the Comprehensive Plan Future
Land Use Map is available on the following page.

3. Garfield County Comprehensive Plan Elements — A review of a project for general
conformity with the Comprehensive Plan includes not only the proposed future land
use in a geographical area of the County but an analysis of the proposal based upon
the plan Elements. These include the following:

Staff has reviewed the Comprehensive Plan for general conformance and has included
the below excerpts with analysis:
Section 2 — Housing:
Goal 1: To bring about a range of housing types, costs, and tenancy options that ensure
for our current and future residents affordable housing opportunities in safe, efficient,
residential structures.
The proposed expansion of the wastewater treatment facility is necessary to
accommodate future housing development within the district's service area. The applicant
has indicated that the proposed expansion is necessary to meet their 20 -year planning
horizon.
Section 7 — Water and Sewer Services:
Goal 1: Ensure the provision of legal, adequate, dependable, cost-effective and
environmentally sound sewer and water services for new development.
The expansion of the wastewater treatment facility is directly in conformance with the
Comprehensive Plan's Goals related to water and sewer services. The proposed
expansion can help ensure that future land uses will be able to connect to an adequate
sewer system.
Section 7 - Policy 1: Development located adjacent to municipalities or sanitation districts
with available capacity in their central water/sewer systems will be encouraged to tie into
these systems.
The increased capacity to be provided by the proposed expansion will increase the ability
of future development within the District's boundaries to tie into the central sewer system.
The District has stated that this project is necessary to ensure that it can continue to
operate within its 20 -year planning horizon.
Section 8 — Natural Resources
Goal 1: Ensure that natural, scenic, ecological, and critical wildlife habitat resources are
protected and/or impacts are mitigated.

This application was referred to Colorado Parks and Wildlife (CPW) (See Exhibit 6). They
noted that the project is located approximately 300 feet from a known osprey nest site
and within the great blue heron nesting buffer of (500 meters) of the largest heronry along
the Roaring Fork River. Additionally, they noted that the area experiences heavy use by
elk during winter months and is classified by CPW as general winter range habitat for elk
and mule deer.
Because of the project's close proximity to the osprey nest and the heronry, CPW
recommended that construction activities do not occur between the date of February 15
and June 15. Additionally, CPW has recommended that construction workers keep all
food and trash within locked vehicles and haul their trash off-site at the end of each
workday to help reduce the chance of human -bear conflicts occurring at the worksite.
The recommendations provided by CPW are directly related to determining general
conformance with the Comprehensive Plan, including the above referenced Section 8 —
Goal 1, to ensure that impacts to ecological and critical wildlife habitat resources are
protected. Staff has drafted suggested conditions of approval to address CPW's concerns
and to ensure that the project is in general conformance with the Comprehensive Plan —
Section 8, Goal 1.
Section 8 — Natural Resources
Vision: The County has preserved and enhanced the habitat for wildlife, native vegetation,
riparian corridors, scenic and other important features of the natural environment. The
county has successfully worked to minimize light pollution and has protected and
improved air and water quality for the health of its citizens.
As part of the review, the application was referred to Steve Anthony, vegetation manager
for Garfield County (See Exhibit 11). He responded with referral comments that requested
the applicant map the property for county listed noxious weeds and manage any weeds
that they may find. This referral comment is supported by the Comprehensive Plan's
Vision for Section 8 Natural Resources that discusses the County preserving native
vegetation. Staff has prepared a proposed condition of approval to address these
concerns.
Summary:
With recommended conditions of approval, the existing wastewater facility and proposed
expansion appear to be in general conformance with the Comprehensive Plan.
VI. SUGGESTED FINDINGS FOR APPROVAL
The following suggested findings for approval of the Location and Extent request make
reference to the approval criteria contained in Section 4-111 (C) of the Land Use and
Development Code:

The Planning Commission shall determine whether the project is in general
conformance with the Comprehensive Plan.
Suggested Findings for Approval
1. That proper public notice was provided as required for the hearing before the
Planning Commission.
2. That the hearing before the Planning Commission was extensive and complete,
that all pertinent facts, matters and issues were submitted or could be submitted
and that all interested parties were heard at that hearing.
3. That for the above stated and other reasons, approval of the Location & Extent
request by the Roaring Fork Water and Sanitation District for a wastewater
treatment facility and proposed expansion is in the best interest of the health,
safety, and welfare of the citizens of Garfield County.
4. That the Location and Extent request has been determined to be in general
conformance with the Comprehensive Plan 2030, as amended.
5. That the Location and Extent request is in conformance with the Review Criteria
contained in Section 4-111, Location and Extent of the Garfield County Land Use
and Development Code, as amended.
6. The determination of General Conformance is based on the Applicant's
representations in their Application submittal and at the public hearing before the
Planning Commission.
VH. PLANNING COMINIIISS

ACTION
Staff supports Planning Commission approval of the Roaring Fork Water and Sanitation
District Wastewater Treatment Facility and Expansion based upon the above findings.
Staff recommends the following conditions of approval:
1. That all representations made by the Applicant in the Application shall be
conditions of approval unless specifically altered by the conditions of approval
contained herein.
2. That the District shall obtain all required federal, state and local permits required
for installation of the infrastructure.
3. The Applicant shall map the property for county listed noxious weeds and manage
any weeds that they may find. County Vegetation Management requests that the

Applicant provide its office with treatment records by September 30, 2017 if any
noxious weeds are located.
4. To address the location of the project within the great blue heron nesting buffer,
no construction activities shall occur between February 15 and June 15.
5. Construction workers for the proposed expansion shall keep all food and
associated trash within locked vehicles and haul that trash off-site at the end of
each workday, to help avoid any bear attractants on site.
A resolution has been prepared consistent with the recommended findings and conditions
of approval. The Commission's motion should include authorization for the Chairman and
Secretary to sign the resolution.

Recitals
A. Garfield County is a legal and political subdivision of the State of Colorado for which the
Board of County Commissioners is authorized to act.
B. Pursuant to law, the Board of County Commissioners of Garfield County has appointed
the Garfield County Planning Commission (the Commission) to act on its behalf.
C. The Roaring Fork Water and Sanitation District (the Applicant) applied to the Commission
pursuant to File No. LAEA-06-17-8557 for a Location and Extent Review for a wastewater
treatment facility.

D. The proposed facility will be located on the property as depicted on the Final Plat of Aspen
Glen Filing No. 1, recorded in the records of the Garfield county Clerk and Recorder on April 6,
1995, as Reception No. 476330.
E. Pursuant to Section 4-111 (C) of the Garfield County Land Use and Development Code,
as amended, and C.R.S. § 30-28-110(1)(a), the District is required to submit an application to the
planning commission that has jurisdiction over the territory in which the improvements are
proposed to be located for review and comment. Comments shall be provided regarding whcthcr
the proposed improvements are in general conformance with the County's Comprehensive Plan of
2030, as amended (the Comprehensive Plan). Pursuant to C.R.S. § 30-28-110, whenever any
county planning commission has adopted a master plan of the county, no public utilities, whether
publicly or privately owned, shall be constructed or authorized in the unincorporated territory of
the county until and unless the proposed location and extent thereof has been submitted to and
approved by such county.
F. In accordance with state law, the Commission has adopted a Master Plan. The Master Plan
applicable to this review is the Comprehensive Plan.
G. The Commission opened a public hearing on August 9, 2017, upon the question of whether
the proposal is in general conformance with the Comprehensive Plan.
H. The Commission closed the public hearing on August 9, 2017, to make a decision on the
request.
1. The Commission, on the basis of substantial competent evidence produced at the
aforementioned hearing, has made the following determinations of fact:
1. That proper public notice was provided as required for the hearing before the Planning
Commission.
2. That the hearing before the Planning Commission was extensive and complete, that all
pertinent facts, matters and issues were submitted or could be submitted and that all
interested parties were heard at that hearing.
3. That for the above stated and other reasons, approval of the Location & Extent request by
the Roaring Fork Water and Sanitation District for a wastewater treatment facility and the
proposed expansion is in the best interest of the health, safety, and welfare of the citizens
of Garfield County.
4. That the Location and Extent request has been determined to be in general conformance
with the Comprehensive Plan.
5. That the Location and Extent request is in conformance with the Review Criteria contained
in Section 4-111, Location and Extent of the Garfield County Land Use and Development
Code, as amended.

6. The determination of General Conformance is based on the Applicant's representations in
their Application submittal and at the public hearing before the Planning Commission.
RESOLUTION
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of Garfield County, as
follows:
A. The foregoing Recitals are incorporated by this reference as part of the resolution.
B. Exhibit A describes the location of the proposed infrastructure improvements.
C. The Location and Extent request for expansion of Roaring Fork Water and
Sanitation's Wastewater Treatment Facility is hereby approved subject to the following conditions
of approval:
1. That all representations made by the Applicant in the Application shall be
conditions of approval unless specifically altered by the conditions of approval contained
herein.
2. That the District shall obtain all required federal, state and local permits required
for installation of the infrastructure.
3. The Applicant shall map the property for county listed noxious weeds and manage

Staff requests that the applicant map the property for county listed noxious weeds and manage any weeds that they may

Dear Patrick,
Colorado Parks and Wildlife (CPW) has reviewed the application materials for the
expansion of the Roaring Fork Water and Sanitation District's Wastewater Treatment
Facility located on Garfield County Parcel #2395-131-02-065. The applicant is
requesting to implement phase two of a three-part expansion plan. Phase two will
consist of an additional aeration basin, a new anoxic basin, an additional secondary
clarifier, and design of the necessary footprint and piping for future improvements.
The existing WWT facility is approximately 300 feet from a known osprey nest site and
within the great blue heron nesting buffer (500 meters) of the largest heronry along
the Roaring Fork River. Additionally, this area experiences heavy use by elk during
winter months and is classified by CPW as general winter range habitat for elk and
mule deer.
Given the project's close proximity to the osprey nest and heronry, CPW recommends
that construction activities not occur between the dates of February 15 to June 15.
Great blue herons begin arriving at their nest sites in mid February to early March,
with nesting activity (egg laying) initiated during March and April. During this time
herons are very susceptible to disturbance and flush easily. Repeated disturbance may
cause discontinued use of the nest site or abandonment of young herons before they
fledge.
Additionally, CPW recommends that construction workers keep all food and trash
within locked vehicles and haul their trash off-site at the end of each workday.
Eliminating bear attractants will greatly reduce the chance of human -bear conflicts
occurring at the worksite.

Sanitation District, has applied to the Community
Development Department Director, Garfield County
State of Colorado, to request a Location and Extent
Review, to construct a Wastewater Treatment Plar
Expansion in the County of Garfield, State of
Colorado; to -wit:
Practical Description: The parcel is located approxi-
mately 3.5 miles southeast of the City of Glenwood
Springs and 3.35 miles northwest of the Town o1
Carbondale. The parcel is located in Sections 12
and 13 of T7S, 89W and Section 18 of T7S anc
88W and is known by Assessor Parcel Number
2395-131-02-065.
Description of Request: The Applicant has request-
ed a Location and Extent Review for a Wastewate
Plant Expansion Project. The project will be complet-
ed within the current facility boundary on an approxi-
mately 6.06 acre parcel that is zoned as Planned
Unit Development.
The public hearing has been scheduled for
Wednesday August 9, 2017, at 6:00 p.m. and will
be held in the County Commissioners Meeting

Revised Comments
Dear Patrick,
Colorado Parks and Wildlife (CPW) staff has been in contact with the applicant to discuss
measures to help avoid and minimize disturbances to the adjacent heronry. The applicant
has agreed to postpone initial construction (i.e. ground breaking) until May 1St, 2018. To
the extent possible, traffic associated with the delivery of supplies and equipment should
be minimized and conducted during the last two weeks of April.
CPW is aware that the duration of the project will last approximately one full year.
However, work to be conducted during the heron nesting season of 2019 will consist of
interior construction work and will have minimal impacts on the heronry. District Wildlife
Manager, John Groves is available to meet onsite and discuss the best options for
equipment storage and staging areas, if needed.
Colorado Parks and Wildlife appreciates the applicant's forthright communication, and
flexibility in scheduling to help avoid and minimize wildlife impacts to the extent
