(HOA) REPRESENTATIVE Carla Pantalone and Mark Montgomery SURVEYOR Rocky Mountain Surveying LEGAL DESCRIPTION Section: 17 Township: 7 Range: 87 Subdivision: PANORAMA RANCHES HOMESTEAD 35, and Section: 16 Township: 7 Range: 87 Subdivision: PANORAMA RANCHES PH 2 AMENDED Lot: 2 OPEN SPACE, County of Garfield, State of Colorado PRACTICAL DESCRIPTION Said properties are located at 0056 ELK RANGE RD, and Not Addressed Open Space Parcel 2 Elk Range Road, Carbondale, Carbondale, CO ZONING Rural RECOMMENDATION Approval with Conditions I. DESCRIPTION OF PROPOSAL - REQUEST The Applicants, Carla Pantalone and Mark Montgomery, and the Panorama Ranches Homeowners Association, Inc. (HOA), are requesting an Amended Final Plat to swap 0.26 acres between Open Space Parcel 2 and Lot 35, effectively relocating an access to the Open Space parcel from the north portion of the parcel to the south portion. The lots are located within the Rural zone district. No changes to motorized access or the existing utilities are proposed as a result of the amended plat. Non -motorized access to the Open Space parcel is proposed to be relocated. In addition, no non -conforming conditions have been noted to result from the lot line modification. II. AUTHORITY — APPLICABLE REGULATIONS The Amended Final Plat Application is being processed in accordance with Section 5- 305, Amended Final Plat Review and Tables 5-103 Common Review procedures. Section 4-103 and 4-101 address details of the review procedures. The Application has been determined to be complete including the waiver requests addressing the fact that an Improvements Agreement is not warranted for the Plat Amendment Request and no new CCRs are proposed. Public notice was required for the Director's Decision in accordance with Sections 4-103 and 4-101. The Applicant has provided evidence of completion of the required notice for the Directors Decision. III. STAFF ANALYSIS 1. The Applicant's proposal was reviewed against the Amended Final Plat Criteria contained in Section 5-305 (C), as follows: 1. Does not increase the number of lots; and - The proposed Amended Plat will not increase the number of lots. 2. Does not result in a major relocation of a road or add any new roads; or - The proposed Amended Plat will not result in a major relocation of a road or add new roads. 3. Will correct technical errors such as surveying or drafting errors. - The Amended Plat has not been proposed to correct technical errors. 2. No conflicts with the existing underlying zoning have been noted including lots size and setbacks. 3. No changes to existing utility locations or motorized access are proposed as part of the amended plat process. 4. The proposal will relocate non -motorized access to the open space parcel from north side of Lot 35 to the south side of Lot 35. 5. The relocation of the non -motorized access would result in no gain or Toss of overall acreage to either of the subject parcels. The overall acreage to be relocated is 0.26 acres. 6. The Application was referred to Colorado Parks and Wildlife who indicated that they have no comments on the request. (Exhibit 13) 7. The Application was referred to the County Surveyor who indicated that he has no comments on the request. (Exhibit 12) 8. The Application was referred to the County designated engineer, Mountain Cross Engineering, who indicated that "The Applicant should adjust the 15' utility easement around the property to the proposed property lines". (Exhibit 10) 9. The Applicant completed the County Public Notice Information form indicating that public notice was sent on May 9, 2017. Certified mail receipts were also provided. One 2 letter of public comment from an adjacent property owner in support of the request was received by the Community Development Department in response to the public notice (See Exhibit 11). Staff has reviewed the Applicants representations and evidence regarding public notice and it appears the requirements have been adequately satisfied. 10. Several changes are recommended for the plat, including: - The plat should show the full extent of both Lot 35 and Open Space Parcel 2. - The utility easement around the perimeter of Lot 35 should be relocated to be 15 feet from all Lot 35 property lines. - The Certificate of Dedication and Ownership needs to be corrected to match standard form. - The County Commissioners Certificate needs to be corrected to match standard form. - Plat Note 6 should be amended to remove "or easements". - The Title Commitment should be referenced on the plat to state that all encumbrances are shown. - The surface and mineral ownership names and addresses should be identified on the plat. IV. SUGGESTED FINDINGS AND RECOMMENDATION Staff supports a finding that the Panorama Ranches Lot 35 and Open Space Parcel 2 Amended Final Plat Application meets the requirements and standards of the Garfield County Land Use and Development Code as amended and is recommended for Administrative Approval by the Director of the Community Development Department subject to the following conditions of approval. 1. That all representations of the Applicant contained in the Application submittals shall be conditions of approval unless specifically amended or modified by the conditions contained herein. 2. The Plat shall be subject to review and approval by the County prior to submittal of the plat for final execution. All standard plat certificates and signature blocks shall be included on the final plat. 3. The Applicant has 90 days within which to satisfy conditions of approval and provide the following documentation for BOCC signature and recordation: a. A plat mylar with signed Certificates that include Dedication and Ownership, Title, Taxes, Applicant's Surveyor, and any mortgagees; b. Recording Fees. c. We bought our home in this beautiful Homeowners Association with abundant Open Space and many nearby trails never expecting to have someone, without Board or Association approval, cut down the trees and brush just feet from our home and taking away the privacy we had when we purchased our home in 2010. This is our retirement home. We did our due diligence and made extensive inquiries about the Homeowners Association, Covenants, the Open Space and its use, prior to purchasing our home. The narrow 19 foot wide strip of Open Space adjacent to our property that runs between Lot 34 and our Lot 35 has been an issue for years. Historically this Open Space was totally inaccessible due to the thick section of scrub oak and heavy brush. The only way to pass through was to go around the vegetation and walk on to private property (Lots 34 & 35). The homes on both Tots are located close to the property boundaries. Our home is 33.8 feet from the property boundary. The original builder most likely chose this location because it provides the best view from our property without obstructing the properties behind us. Years ago, Davis Farrar, a Panorama Ranches homeowner, proposed to construct trails in the Open Space. Some were approved but the trails that he proposed that were too close to the homes adjacent to the open space were not approved, including the trail adjacent to our property (about 34 feet from our home). As far back as 2006 our Homeowners Association Meeting Minutes document discussions of proposed trails in the Open Space. The previous owners of our Lot 35 and the neighboring Lot 34 were adamantly opposed to cutting down the trees between the properties and constructing a trail open to all homeowners and their guests to use. Other homeowners adjacent to the Open Space were also opposed to the development of trails and the use of the Open Space so close to homes. In 2009, several homeowners and the Board of Directors discussed at lengths the issue of the trails and at the May 2009 Board Meeting Davis Farrar proposed to extend a trail between Lots 34 & 35. This proposal was unanimously voted down. We have included the minutes from this meeting documenting the discussion and vote. We have also included copies of emails that were sent in 2009 by Board members, Davis Farrar and the previous owners of our home discussing the trail and Open Space. The previous owner of our home wanted documentation to disclose to us that the trail would not be allowed. In one of the emails Davis Farrar proposed to allow for a Plat Amendment relocating the open space. This is exactly what we are currently requesting! This had already been done by the Derrington's, another homeowner who amended the Plat to allow for an alternate Open Space access away from their home. In 2009, prior to purchasing our home we spoke to the Panorama Ranches President Ed Brown and he disclosed that the trail was proposed and voted down and would not be allowed. After review of the Homeowners Association Minutes including the May 2009 Minutes, we felt confident there would be no trail constructed. In addition, with the dense vegetation making the area of Open Space physically inaccessible, we were assured there would be no use of the subject Open Space and purchased our home in January 2010. At the first Homeowners Association Meeting we attended in January of 2010, the issue of the Open Space came up again and the homeowners voted almost unanimously not to allow a trail to be constructed. The map with the proposed trail was to be removed from the Panorama Ranches website. The homeowners decided we had enough trails in the Open Space and to respect the privacy of the homeowners living adjacent to the Open Space. After that 2010 meeting the issue of trails didn't come up again until 2015. Then in November of 2015 after being in California working, we came home and on Thanksgiving Day we found Davis Farrar walking in the Open Space just outside our window. We discovered a trail had been cut. Trees were cut down and piled up, brush was cleared and piled up in the Open Space. It is a violation of our Covenants/Declarations to alter the vegetation without approval. We contacted the HOA President and were told no one was given authorization to cut the trail. The President advised us to write a letter to the Board of Directors and suggested we attend the January 2016 Board Meeting where the unauthorized trail would be discussed. Our letter is included. At the January 2016 Board Meeting it was suggested by a Board member to close the Open Space for revegetation of trees and brush. When this was proposed Davis Farrar threatened to sue the Board of Directors if they closed the Open Space. The Board decided to discuss the closure with the Homeowners Association Attorney. Since this meeting in January 2016, the trail, Open Space and our Plat Amendment has been discussed at every Board Meeting as well as the 2017 Homeowners Association Meeting. Davis Farrar has been the only homeowner to attend these meetings that has opposed the Plat Amendment. Davis Farrar has continued to use and maintain the trail and it is now wide enough for mountain bikes and two people to walk side by side. Brush and Togs have been cut and thrown on our property. Davis Farrar and Leilani Damke, another Panorama owner have been the only people we have seen using and maintaining the trail. We have included photographs of Davis Farrar cutting and throwing wood along the trail. We included photos of Lellani Damke "bush whacking" as she refers to it, throwing logs onto our property. A Board member and several neighbors witnessed Davis Farrar cutting the wood from the Open Space and loading into his trailer and hauling it home. This is an abuse of our Open Space and a blatant violation of our Covenants. This all takes place right outside our home about 34 feet away and only several feet from our patio. This situation could be easily and permanently resolved by relocating the Open Space to the south end of our property away from any homes. In 2016 the Board of Directors approved our proposal for a Plat Amendment. The Plat Amendment would not only allow easy access to the Open Space for all homeowners that is not in close proximity to any homes, but it also allows our house to be in compliance with the Panorama Ranches set back guidelines stated in our Covenants. The Plat Amendment would put our house farther than 50 feet from the property line. We have included a letter from the owners of Lot 39 adjacent to the proposed relocated Open Space stating they are in favor of the Plat Amendment. We have also included a letter from a Board member David Thiel and the previous owners of our home. We have received overwhelming support from our neighbors and the Association for the Plat Amendment. The neighbors suggested we circulate a petition so we did that and received 32 signatures from the majority of the Association. We then obtained 35 Plat Amendment Agreements that were prepared by the Homeowners Association Attorney and signed by the majority of the Panorama Ranches homeowners stating they agree to the Plat Amendment. We have included these agreements. Davis Farrar may be a contract planner but he is not a planner for Panorama Ranches. He has sent several letters to the Homeowners Association with his reasons why the Plat Amendment should not be allowed. Most of his statements are false and erroneous. One of his claims is that the Open Space should remain where it for access to the Missouri Heights Mountain Meadows Irrigation Ditch. This is false. There is a ditch running through Panorama Ranches and the ditch company has a prescriptive easement for the ditch. The location of the ditch near our home and the Open Space between Lots 34 & 35 is entirely on the private property of Lot 34. The ditch does not run in the current Open Space that will be relocated or on our property that will become the new Open Space. There are many access points to the ditch that are in Open Space. The ditch company's easement or access to the ditch will not be affected by the Plat Amendment. The Plat Amendment will be a permanent solution to this long ongoing issue and provide an access to the Open Space the homeowners never had before while allowing for our privacy and a 50 foot set back. We hope the signatures executed by the majority of the homeowners in the Association and our desire for the privacy we thought we had when buying five acres in a rural community will outweigh any attempts to challenge our Plat Amendment. This discussion was spirited and protracted, and revolved around privacy issues and the ability and right of owners to access common spaces. There was prolonged disagreement about what had previously been decided in regard to establishing trails over common spaces. Owner Farrar was certain the trails had been approved at a previous annual meeting, at which a map of proposed routes had been shown, and now only needed to be placed over some final common spaces. Owners adjacent to those common spaces, specifically a corridor between Ahrens and Gilliam/Githens, and another between Zemansky's and Lassiter, were upset that trails would be created so near their homes. Mr. Farrar had two maps which he brought to this meeting. One was the Panorama plat map, the other a trail map showing established and proposed trails over the open spaces. Davis said the map of the trails had been at all of the recent annual meetings, and there was general agreement that this was so. Specifically, the discussion centered on the May 15, 2006 annual meeting, at which Mr. Farrar contends the trail system was approved by the owners. Mr. Moore and Mr. Brown recall rather that the vote was a simple straw poll indicating support of creation of a trail system, which was to be laid out and subject to approval of the Board. Mr. Brown also pointed out that the Association Covenants specifically task the Board with controlling any development on the Common Lands (See Article 17) .President Brown noted that other owners spent a lot of time working with Mr. Farrar and flagging the routes. Ms. Heydenberk and Mr. Ahrens commented on what they called a straw vote at the 2006 meeting and their recollection was that the approval was `conceptual' and that in the interval Davis Farrar and the Board have worked to flag and create trails. Mr. Farrar made the distinction between common spaces and trails, saying common spaces and their use exist by right for all owners in Panorama, whether a maintained or improved trail exists upon them or not. He said he has the right to use the open space and does not want that right impinged upon. He asked the Board to provide a specific basis on which to exclude trails on common spaces. Mr. Edquist asked what constitutes maintenance/improvement of a trail. Maintenance seems to be by weed eater, while improvement can be accomplished by this or other mechanical means, or by use by hikers, wildlife, bicycles or horses. Director Cox then suggested not "maintaining" the trail which was recently "improved' by Mr. Farrar between Lassiter and Zemansky's. Director Heydenberk agreed with this sentiment, stating that she did not want to be part of a Board or neighborhood that forced trails over open space against an owner's objections and right to privacy. President Brown then made a motion to maintain the existing trail system and add to it a trail from Derrington's to the existing upper trail, not to extend a trail between Ahrens and Gilliam/Githens, and not to maintain the trail between Zemanksky's and Lassiter's. Heydenberk seconded this motion. Discussion followed in which Mr. Farrar made note that 3 of the 5 Board members about to vote on this motion own property adjacent to open space. Mr. Holzman asked if the vote should not go back to the ownership, as had been suggested earlier by Valerie Gilliams. The trial addition from Derrington's was to take a route as far as possible from Mr. Moore's home, given the terrain. Manager Edquist was asked to see if the materials he's received from Aspen Resort Accommodations includes the trail map in portable document file (pdf) format. Water Issues Mr. Farrar reported on two owners who still do not have remote readout meters for their water use, Edmonds and O'Neill. He said normal usage for an occupied single family home per quarter should be in the area of 8,000 gallons or above. Some meters reading 3 to 4000 gallons on occupied homes are therefore suspect. Davis went on to list 9 owners who still do not have backflow prevention devices installed. He said he had made calls to these owners, and would follow up with them again in a few weeks to see if they have complied with the requirement. Owners named were Gazely, Forbes, Borkowski, Lyon, Plunkett, Quint, Ferrara, Allee and Calderon, with all of whom Davis reported varying degrees of success in ascertaining if they have the device, do not have the device, need a plumber etc. Repeated notice of the need for backflow prevention devices has been given for "the last ten years". After Mr. Farrar follows up with these owners, the Board will act on ensuring compliance at their next meeting. Mr. Farrar said Zancanella and Associates would do a pump test on the wells, but he is trying to find someone less expensive. The Zancanella quote is $1500.00. President Brown was to discuss this work with the Zancanella firm. Last, Davis said the south and west sides of the pump house need stain. He will send a bid to Mr. Brown to do the work. Financial Report Manager Edquist introduced his business associate Kim Poukish, Rocky Mountain Accounting Services, to present the financial reports. The Board was provided financial statements consisting of a balance sheet through April 30, profit and loss previous year comparison for January through April, profit and loss budget versus actual for January through April and an aging report dated 5/7/09. Kim said she had only taken these reports from the recently received Quickbooks file from ARA, and could not vouch for their accuracy. Keith and Kim wished to know if the format and reports presented were sufficient and really what the Directors wish to see. The answer was affirmative. In any case, you will recall that subsequent to that meeting several of us went for a tour of the proposed routes. There were a number of subsequent meetings with the Panorama board on the trail alignments and after all of that hoopla there was a decision to move forward with the trails. 1 do not know what is or is documented in the minutes, but it seems rather silly to keep revisiting these issues. The bottom line is that the Board does not have the authority to restrict use of the open space by residents of Panorama beyond enforcing the prohibition on non - motorized use. You may also recall that we met at Tony's house with Zamanskis on their complaint and the Board again reaffirmed the trails. There were maps of the trails at that meeting and that was yet another affirmation on the trail system. The open space is open and accessible by all residents/guests. According to the Improvements Location Certificate prepared by Lines In Space on January 1983 and resurveyed and certified on October 24, 2012 our improvements are 33.8' from the lot line. We propose to exchange the strip of open space between our lot 35 and lot 34 belonging to Mark Holms for an equal strip of our land adjacent to lot 39 belonging to Wayne Hall and Karen Cox. This exchange would not only put our house into compliance with the Panorama Ranches Building Criteria but would also provide Panorama owners with an appealing easy access to the open space from Elk Range Road. Both Wayne Hall and Karen Cox are in favor. Mark Holms said he is also in favor of the exchange and doesn't like the idea of a trail being cleared between our properties. With HOA member approval, a new trail could easily be cut through the access and a simple bridge across the ditch added to provide a relatively easy grade far access to the open space and connection to existing trails. We have been asked by the current owners of Homestead 35 (Carla Pantelone and Mark Montgomery) to provide some historical perspective to the ongoing issue of trail construction on Panorama Ranches Homeowners Association open -space with particular regard to the narrow sliver of open -space between Homestead 34 and Homestead 35. Prior to our purchase of Homestead 35 in 1993, we became aware that the existing residence was bulit closer to the eastem lot line than allowed by the Covenants of Panorama Ranches. Consequently, we obtained approval in writing from Jack O'Neill, President of the Panorama HOA, that the non -conforming setback of the house was acceptable to the Panorama HOA. A copy of the approval is attached. Also, we were aware of the HOA open -space located on the east side of the property between Homestead 34 and 35. At the time we purchased Homestead 35 there was no existing trail on that particular section of open -space. In addition, no trail was ever constructed, cleared, maintained, etc. on that particular section of open -space during our 17 year ownership of the property. Use of the particular section of open -space by members of the Panorama Ranches HOA was non-existent and never noticed by us. The subject of constructing and maintaining a trail system through the open -space parcels carne up as early as 2004 according to the records we kept. The issue was brought up again at the 2006 Annual Meeting with mixed reactions from homeowners. The subject was also brought up in 2007 and 2008 according to the Annual HOA minutes of those meetings. Trails were not brought up at the last Annual Meeting that we attended in January 2009. On May 7, 2009, we attended a Board Meeting in which a proposed trail map was presented to the Board by Davis Farrar. We were adamantly opposed to a proposed trail that would run between Homestead 34 and 35 due to its proximity to our home. After much discussion, and as stated in the minutes of the May 7, 2009 Board Meeting, the Board unanimously agreed to a motion "to maintain the existing trail system and add to it a trail from Dorrington's to the existing upper trail, not to extend a trail between Ahrens and GIIIiam/Githens, and not to maintain the trail between Zamansky's and Lassiter's." We are surprised, disappointed and saddened that this persistent issue has come up again — as we clearly thought that it had been put to bed and finally settled at the May 7, 2009 Board meeting.
