HomeMy WebLinkAbout3.0 Director's Determination 06.08.20174!:: Garfield County June 8, 2017 Carla Pantalone Mark Montgomery 0056 Elk Range Road Carbondale, CO 81623 DIRECTOR DETERMINATION — Amended Final Plat — Panorama Ranches Lot 35 and Open Space Lot 2 (File No. FPAA-04-17-8528) Dear Ms. Pantalone and Mr. Montgomery: This letter is provided to you, as the authorized representative for Garfield County File FPAA-04-17-8528, pertaining to Panorama Ranches Lot 35 and Open Space Lot 2. This letter is notification that your request to amend the final plat as outlined below has been reviewed by the Community Development Department and the Director hereby issues a determination conditionally approving the request to swap 0.26 acres between Open Space Parcel 2 and Lot 35 of Panorama Ranches Subdivision, effectively relocating an access to the Open Space parcel from the north portion of the parcel to the south portion of Parcel 35. The conditions of approval are as follows: 1. That all representations of the Applicant contained in the Application submittals shall be conditions of approval unless specifically amended or modified by the conditions contained herein. 2. The Plat shall be subject to review and approval by the County prior to submittal of the plat for final execution. All standard plat certificates and signature blocks shall be included on the final plat. 3. The Applicant has 90 days within which to satisfy conditions of approval and provide the following documentation for BOCC signature and recordation: a. A plat mylar with signed Certificates that include Dedication and Ownership, Title, Taxes, Applicant's Surveyor, and any mortgagees; 1 b. Recording Fees. c. The following corrections shall be made to the Plat prior to submittal to Community Development Staff for final review prior to obtaining signatures: i. The plat shall show the full extent of both Lot 35 and Open Space Parcel 2. ii. The utility easement around the perimeter of Lot 35 shall be relocated to be 15 feet from all Lot 35 property lines. iii. The Certificate of Dedication and Ownership shall be corrected to match standard form. iv. The County Commissioners Certificate shall be corrected to match standard form. v. Plat Note 6 shall be amended to remove "or easements". vi. The Title Commitment shall be referenced on the plat to state that all encumbrances are shown. vii. The surface and mineral ownership names and addresses shall be identified on the plat. Notice of this decision will be provided to the Board of County Commissioners who has the ability to `call-up' the application for review at a public hearing. You will be notified of the Board decision once it is received or upon expiration of the 10 day notice 'period.
