Dear Mr. Whittington: Thank you for speaking with me last week regarding construction in progress at the above address. At this time I would like to provide you with information regarding codes for building construction within Garfield County. Garfield County Resolution No. 90-085 requires the application for and issuance of a building permit prior to commencement of construction. The Resolution also requires the application, submission of plans, requests for inspections during construction intervals and a final inspection and approval of the project prior to occupan.cy, in accordance with the 1988 U.B.C. (Uniform Building Code). This letter will serve to inform you that as provided for under U.B.C. Section 202 (d) Stop Orders. a Stop order will be issued for this project. There is hereby established in this jurisdiction a code enforcement agency which shall be under the administrative and operational control of the building official. Powers and Duties of Building Official Sec. 202. (a) General. The building official is hereby authorized and directed tO enforce all the proviSions of this code. For such puiposes, he shall have the powe.ts''of a law enfotcement officer. Th,e building official shall have the power to render interpretations of this code arid tO adOpt and enforce rules and tegul;:itions sui)plemental to this code as he may deem necessary in' order to clarify the application of the provisions of this code. Attachment. Dear Mr. Whittington: I appreciate your cooperation on this matter and also appreciate the time and effort of your father, Mr. Del Whittington in providing a video tape of the construction project process. There are some things that cannot be observed from the video and will require an on site visit by an inspector to determine compliance with the code. (please see the attached memorandum to file) I would like you to understand that I do not have the authority to waive or disregard provisions of the code adopted by Garfield County so I cannot waive the fees associated with beginning work without a permit. However, if you feel that I have interpreted the code incorrectly you do have the right to appeal my decision to the Board of Review. Sincerely, Art Hougland Chief Building Official Whitti04.94 To: From: Date: Subject: MEMORANDUM Whittington file Art Hougland September 12, 1994 Review of video tape provided by Mr. Del Whittington of construction of a garage and family room addition to manufacttired home. The home is located at 0449 County Road 223, Garfield County, Colorado. Don Owens and I reviewed the video tape referenced above and noted the following: 1. The construction techniques observed appeared to be workmanship like in application. 2. Concrete footing and masonry unit construction appeared to comply with minimum requirements of the U.B.C. (Uniform Building Code). 3. It appears that only the slab was poured adjacent to and outside of the skirting arom1d the manufactured home. Later on in the video it appears that a plate has been attached to the top of the manufactured home over the exterior wall. The plate or sill supports a short stud wall which appears to support the dead load of the cripple wall a portion of the roof dead and live load. It is unclear how this load has been transferred to the foundation and what the load is. 4. The framing appears to be workmanship like but it is difficult to verify mininlum code compliance in all applications from the video tape. 5. The roof joists do not appear to have been provided with a means of ventilation and it appears that the ceiling in the room is vaulted. Views of the eaves and overhangs do not indicate the presence of vents and the ridge was not visible. Some of the items noted above will be required to be field inspected to verify code compliance. Under U.B.C. Section 301, a permit is required. This Section also states that no building regulated by the U.B:C. shall be constructed, enlarged or altered unless a separate permit for each building has been obtained from the building official. U.B.C. Section 304 (e) Investigation Fees: Work without a Permit. 1. Investigation. States,"Whenever any work for which a permit is required by this code has been commenced without first obtaining said permit, a special investigation shall be made before a permit may be issued for such work." And, 2.Fee. States, "An investigation fee, in addition to the permit fee, shall be collected whether or not a permit is then subsequently issued. The investigation fee shall be equal to the amount of the permit fee required by this code. The minimum investigation fee shall be the same as the minimum fee set forth in Table No. 3-A. The payment of such investigation fee shall not exempt any person from compliance with all other provisions of this code nor from any penalty prescribed by law. 11 I interpret this code section to be indicative that this investigation fee is not arbitrary or subject to waiver by the building official. Under U.B.C. Section 204 Board of Appe~Js. (Board of Review as adopted by Garfield County) The owner has the right to'appeal my decision and interpretation of the above referenced Code Section to the Board of Review. The Board may issue a statement relative to their opinion on the correctness of WY interpretation of this section. The Board does not have the authority to chan~ ~er or waiv~ code requirements. Adequate and complete information '' will prevent delays in the plan review process. Reviewing a plan and the discovery that required information has not been provided by the applicant· may result in the delay of the permit issuance and in proceeding with building construction. The owner or contractor may be required to provide this information before the plan review may proceed. This causes delays because other plans that are in line for review may be given attention before the new information may be reviewed after it has been provided to the Building Department. Please review this document to determine if.you have enough information to design your project and provide adequate information to facilitate a plan review. If you do not, it may be helpful to obtain a book titled 'Dwelling construction under the Uniform Building Code. This book is available to you through this department at our cost. Some of the observations were as follows: 1. Addition is 28' x 32' with garage entry on first floor and family room on second floor. 2. Construction is 8"x 8" x 16" masonry units for first story and foundation on a poured concrete foundation.. Second floor and roof ore of wood frame construction. The floor ceiling assembly is of hemp fir 2"x 10" joists, 16" o.c., spanning 18' 9" for the longest span. (see attached beam calc.) Wall framing is of2" x 6"@ 16" o.c. 3. There is a second floor deck on the South side. Mr. Dell Whittington pointed out some of the items that he was aware of that needed to be to be done to meet U.B.C. requirements. These and others observed by Don Owens are as follows: 4. The electrical panel is penetrating the garage side of the area separation wall between the garage and the rest of the residence. 5. The entry way has crawl space under the floor that requires some additional ventilation. 6. There is some attic space above the cathedral ceiling that will require ventilation. 7. Fire rated occupancy separation is required as follows: (a) A solid wood core self closing door with a minimum thickness of 1 3/8" thick needs to be installed between the garage and the entry. (b) To separate the stairs from the garage the stair walls and the underside of the stairs are to be covered with 5/8" type X gypsum wallboard. A copy of this memo will be sent to Mr Whittington for review and comment.
