This letter is to confirm the results of the meeting between you and the following on March 18,
1993:

With reference to the items listed in the letter to you on March 15, 1993, the agreement is as
follows:
1. No change.
2. & 3.The occupant load will be determined based on your indicated use of the spaces
and a one-hour "separation" of the "Private Dining" area from the other interior
spaces. The "Private Dining" will be an A-3 occupancy with an occupant load
of 54. The remaining area will also be an A-3 with an occupant load of 296.
These two occupant loads (room capacities) shall be posted in the rooms with
an approved sign at a conspicuous location near the main exit from the room.
4. No change.
5. No change.
6. New and reconstructed portions of the building shall be Type V -One-hour fire
resistive construction.
7. Exit locations are adequate as shown on the attached copy of the revised floor
plan.
8. The exit doors at the main entrance are now adequate. The two interior doors

Memo to the file regarding Buffalo Valley Inn.
The following will summarize and outline construction requirements
for this project determined at a meeting between the Garfieid
County Building Official and the GSDES this date at 1400 hrs •.
1. Construction type and occupancy.
The building in question is a single story V-NR structure of '
approximately 5400 square feet. The proposal is to enlarge the
building to· about 8000 square feet. In .doing so,, two large.:
unseparated assembly areas will be created; · one will be used)
primarily for dining and one for dancing. The total occupant load :
for these areas will be over 300 which will mean that the building
will be classified as an A-2 .1. There is also a separated dining··
area with an occupant load around 60. V-lhr is the minimum con-· :'
struction type for this occupancy so all new construction will have:(
to conform to that type. The existing structure will not have to,'
be brought up to the new standard.
2. Exiting requirements.
A minimum of two additional exits will be needed. One from the
north side of· the private dining room and orie adjacent to the·
fireplace in the large dining room. Jim McMurray has· indicated:·
that an additional exit might be required from the dance floor. ·
It is conceivable that the total occupant load of the building:
could be over 5QO people so the main exit should b.e .,.sized per Sec; . ·
3317 or a minimum of width of five feet. This would include both
the main exit door and the airlock. This might present a problem:
for the floor opening from the private dining room. All exit doors•
including the main exit will require panic hardware to be
installed.
Exit illumination will be required per Sec. 3313 and exit signs per
sec. 3314.
3. Fire extinguishing systems.
An automatic fire sprinkler system will have to be installed per
Sec. 3802. This system will need to conform to NFPA 13 and its
related documents. The sprinkler system shall be designed for a
light hazard occupancy with a duration of flow of 30 minutes. An
outside hose allowance of 100 GPM for 30 minutes should be added to
the sprinkler demand. Total combined storage should be around 8000
gallons. Pressure tank, fire pump or gravity tank wiil be needed
to provide needed pressure, An outside yard hydrant and P.I.V.
valve will .also have to be installed.
An automatic fire extinguishing system will be required for kitchen
exhaust and hood areas per the fire code. The kitchen hood will
need to meet Type 1 requirements per the mechanical code.
4. Fire extinguishers.
A total of four fire extinguishers will be required. A 40BC will
be required in the kitchen and a 2A20BC will be required in each
dining room and the dance floor.
s. Specific GSDEB requirements.
The GSDES will require that all automatic fire extinguishing
systems be superirised by UL listed digital communicator and that
the communicator be monitored by a UL listed central station.
The GSDES will also be responsible for all review, approval, and
inspections of fire extinguishing systems.

I have completed an initial review of the plans submitted for the work planned at the Bu!Talo
Valley Restaurant. The following are the majoritems relating to Uniform Building Codes and .
Garfield County requirements for your project.
1. The existing building area is calculated to be +-5500 sq. ft. and the addition to be
+-2400 sq. ft. for a total of 7900 sq. ft.
2. The occupant load total of the building is 425-UBC Sec. 3302 and Table No. 33-A.
3. The occupancy classification is A-2.l -UBC Table No. 5-A and UBC Chapter 6.
4. An auto sprinkler system is required -UBC Sec. 3802 (c).
5. Sprinkler System Supervision Alarms are required -UBC Sec: 3803.
6. The building is required to be Type V -one-hour fire-resistive. construction -UBC
Table No. 5-C.
7. Based on the occupant load of 425, additional exits need to be provided at locations
indicated on the attached copy of the floor plan -UBC Sec 3303.
8. The main exit doors must be a minimum of 4.2' in width -UBC Sec. 33 l 7(a). All
other exterior exit doors must be a minimum of.36" in width UBC Sec. 3304(1) -and
all must be provided with panic hardware -UBC Sec. 3317 and UBC Sec. 3318.
9. Exit illumination -UBC Sec. 3313 -and exit signs -UBC Sec. 3314 -must be
installed.
10. The men's and women's restrooms require an additional toilet and an additional
lavatory in each-UPC Appendix C "Minimum Plumbing Facilities".
11. Handicap accessibility requirements apply -UBC Sec. 511 and UBC Chapter 33.

12. Compliance with the applicable requirements of the UBC, UPC, and UMC of the
kitchen and kitchen equipment.
13. Draft stops are required to limit attic spaces to max. 3000 sq. ll. and not exceeding
60 ft. in horizontal dimension -UBC Sec. 2516.
14. Designate the number of planned parking spaces on the plans.
The following items will need to be provided and/or resolved before Garfield County can
approve your plans and issue the Building Permit for your project: ,
A. Completed and Architect and/or Engineer stamped plans (two sets) with :
evidence of compliance with items 1 through 14 above.
B. Approval of your plans by the Glenwood Springs Rural Fire Protection District.
C. AgreemenU Approval by the Colorado Department of Health as related to the Food
Services Regulations.
D. Agreement/Approval by the Colorado Department of Health as related to the
Sewage Disposal Regulations.
These items are not all·inclusive but are provided so you may immediately include them in your
project planning.

I am writing to summarize the discussions that were held on April 21, 1993. Present at
the meeting on behalf of Kurt Wigger were myself, Louis Meyer and Walt Brown. The purpose
of the meeting was to discuss with you the potential for the issuance of a temporary certificate
of occupancy (or whatever the current nomenclature for that type of procedure is) to allow for
the opening of the Buffalo Valley Restaurant, as remodeled, prior to the implementation of the
final water and sewer solutions for the expanded facility. These discussions were, of course,
premised upon the assumption that all other work necessary to allow for an opening would be
completed and approved by the County, and the only outstanding issues would be water and
sewer.
As we explained, the current water solution will be the extension of the City's water
service from the existing City lines (located in the area of the cemetery) out to the Buffalo
Valley Restaurant and extending further to Holy Cross's property line. We anticipate approval
by the City Council on May 6, 1993, with a construction start shortly thereafter. We believe
we would be 2-3 weeks from final completion of the water line by the Memorial Day weekend,
the anticipated opening date of the remodeled Buffalo Valley Restaurant.
We are presently pursuing two alternative sewer solutions. Our preferred alternative is
the extension of City sewer service, so long as we can utilize the same trench as the City water
line extension. The sewer line extension would be cost prohibitive if an additional trench is
required. Because there are still unresolved design criteria with the City (although we are close
to resolution), we are also pursuing an alternative sewer solution with Fred Ingelhart.
Specifically, Mr. Ingelhart has acquired a small package plan which he is proposing to connect

to his existing facility, located just south of the Buffalo Valley Restaurant. This will sufficient
capacity to allow for the connection of the Buffalo Valley Restaurant. Of course, site approval
from the Colorado Department of Health would be required and is anticipate to take from 3-6
months. The installation of the facility should be completed prior to or consistent with site
approval by the State.
Our discussions with you contemplate opening on the Memorial Day weekend with
certain conditions contained within the temporary certificate of occupancy that will protect the
County and the public. You indicated that the criteria under Section 104(b) of the Uniform
Building Code is that no substantial haz;ard must exist as a result of the opening. We believe
that with the conditions we discussed that requirement will be met.
In terms of water and fire issues, those conditions would include the following:
1. Occupancy limit to the same level that existed prior to the current remodeling, or
approximately 190 people.
2. A hold harmless agreement for the County and fire district (and City, if
necessary).
3. A "drop dead" date by which the water line extension must be connected to the
Buffalo Valley and the fire flow provided or the temporary certificate of occupancy will expire.
As we get closer to the opening date, we will be able to identify for you a proposed completion
date of the project and, with some additional leeway provided, believe we can agree upon a
mutually acceptable "drop dead" date.
4. We understand you would want a standby fire watch person on the premises
during business hours per the Uniform Fire Code. That person and all employees would be
instructed on a fire watch routine and fire procedures.
5. A temporary water storage tanker truck or other storage tank with approximately
10,000 gallons of water would be located on the premises and available to the fire department.
6. There will be no fires in the fire place.
7. We are looking at the possibility of the installation of a fire alarm system,
although Jim Manson did not indicate this was a requirement.
8. We will also look at connecting the existing installed sprinkler system to the two
inch water line, if appropriate.

Concerning sewer service, the following conditions would be contained in a temporary
certificate of occupancy:
l. Use of the building would be limited to the same level that existed prior to the
remodeling (i.e., approximately 190 people).
2. The status and integrity of the existing septic tank leach field system would be
checked periodically by a competent · professional and recommendations from that person
concerning pumping or other remedial actions would be pursued.
3. A similar "drop dead" date provision would be included concerning sewer,
although that date might be different than the water system date, depending upon the sewer
alternative ultimately selected.
4. Don also indicated he would like the County named as a loss payee on the
insurance policy. Walt Brown is looking into that.
It is very important to Mr. Wigger that the Buffalo Valley Restaurant be able to open for
the Memorial Day weekend. We appreciate the time you took in meeting with us and your
efforts in helping us explore constructive solutions to the water and sewer issues as they relate
to the County permitting process. If for any reason my recollection of our discussions is
incorrect, please let me know.

Subject: Building Permit# 4704. Attachment to Temporary Certificate of Occupancy.
Dear Mr; Wigger:
The Garfield County Building Department has issued a Temporary Certificate of Occupancy
(TCO) for the Buffalo Valley Restaurant. This TCO will expire on June 25, 1993.
A violation of the provisions or conditions of this TCO may cause the TCO to be terminated
and occupancy of the building permitted.
These provisions or conditions include the following:
1. Conformance with the conditions agreed to and included in the letter from Mr.
Wigger's attorney Mr. Loyal E. Leavenworth, dated April 23, 1993.
2. Successful completion of a final electrical inspection by Mr. Leonard Rowe, Colorado

requirements of the 1988 Uniform Plumbing Code. Shutoff valve is required
within three feet of the appliance. The appliance is to be a listed appliance.

Mr. Kurt Wigger owner of the Buffalo Valley Restaurant is
requesting a TCO (Temporary Certificate of Occupancy) effective the
evening of June 3, 1993.
Before the Garfield County Building, Sanitation and Planning

Dear Mr. Wigger:
The Garfield County Building Department has issued a Temporary Certificate of Occupancy
(fCO) for the Buffalo Valley Restaurant. This TCO will expire on June 25, 1993.

The following will summarize and outline construction requirements! i·
for this project determined at a meeting between the 9arfieid : · i
County Building Official and the GSDES this date at i4oo hrs. ·
1. construction type and occupancy.
The building in question is a single story V-NR structure of 1
approximately 5400 square feet. The proposal is to enlarge the ,
building to· about 8000 square feet. In · .. doing so, . two large.:
unseparated assembly areas will be created; · one wiil be tised i ·.;
primarily for dining and one for dancing. The total occupant load,
for these areas will be over 300 which will mean that the building ,
will be classified, as an A-2 .1. There is also• a separated dinihg ;.
area with an occupant load around 60. V-lhr is the minimum con-;:
struction type for this occupancy so all new construction will have::',.
to conform to that type. The existing structure will not have to!
be brought up to the new standard.
2. Exiting requirements.

A minimum of two .additional e~its will be needed. One from the
north side of 'the private dining room and orie ad)acent to the••
fireplace in the large dining room. Jim McMurray has· indicated'
that an additional exit might be required from the dance floor.· , :
It is conceivci.:!Jle that the total occupant load. of the. building!
could be over 500 people so the main exit should be .,sized per Seel·.·
3317 or a minimum of width of five feet. This would include both
the main exit door and the airlock. This might present a problem·!
for the floor opening from the private dining room .. All exit doorii '.,
including the main exit will require panic hardware ·to be'
installed.

Fire extinguishing systems.
An automatic fire sprinkler system will have to be installed per
Sec. 3802. This system will need to conform to NFPA 13 and its.'
related documents. The sprinkler system shall be design~d for a•
light hazard occupancy with a duration of flow of 30 minutes. Ail
outside hose allowance of 100 GPM for 30 minutes should be added to.
the sprinkler demand. Total combined storage should be around 8000
gallons. Pressure tank, fire pump or gravity tank wiil.be needed,
to provide needed pressure, An outside yard hydrant and i>.I.V. ·
valve will also have to be installed.
An automatic fire extinguishing. system will be required for kitchen,
exhaust and hood areas per the fire code. The kitchen hood wiii
need to meet Type 1 requirements per the mechanical code.
4. Fire extinguishers.
A total of four fire extinguishers will be required. A 40BC wiii
be required in the kitchen and a 2A20BC will be required in each
dining room and the dance floor.
5. Specific GBDEB requirements.
The GSDES will require that all automatic . fire extinguishing
systems be supenrised by UL listed digital communicator and that
the communicator be monitored by a UL listed cen1lral station. '
The GSDES will also be responsible for all review, approval, ahd
inspections of fire extinguishing systems.

I have completed an initial review of the plans submitted for the work planned al the Bulfalo
Valley Restaurant. The following are the major items relating to Uniform Building Codes and .
Garfield County requirements for your project.
1. The existing building area is calculated to be +-5500 sq. ft. and the addition to be
+-2400 sq. ft. for a total of 7900 sq. ft.
2. The occupant load total of the building is 425-UBC Sec. 3302 and Table No. 33-A.
3. The occupancy classification is A-2.1 -UBC Table No. 5-A and UBC Chapter 6.
4. An auto sprinkler system is required -UBC Sec. 3802 (c).
5. Sprinkler System Supervision Alarms are required -UBC Sec: 3803.
6. The building is required to be Type V -one-hour fire-resistive construction -UBC
Table No. 5-C.
7. Based on the occupant load of 425, additional exits need to be provided at locations
indicated on the attached copy of the floor plan -UBC Sec 3303.
8. The main exit doors must be a minimum of 4.2' in width -UBC Sec. 3317(a). All
other exterior exit doors must be a minimum of36" in width UBC Sec. 3304(1) -and
all must be provided with panic hardware -UBC Sec. 3317 and UBC Sec. 3318.
9. Exit illumination -UBC Sec. 3313 -and exit signs -UBC Sec. 3314 -must be
installed.
10. The men's and women's restrooms require an additional toilet and an additional
lavatory in each -UPC Appendix C "Minimum Plumbing Facilities".
11. Handicap accessibility requirements apply -UBC Sec. 511 and UBC Chapter 33.

12. Compliance with the applicable requirements of the UBC, UPC, and UMC of the
kitchen and kitchen equipment.
13. Draft stops are required to limit attic spaces to max. 3000 sq. ft. and not exceeding
60 ft. in horizontal dimension -UBC Sec. 2516.
14. Designate the number of planned parking spaces on the plans.
The following items will need to be provided and/or resolved before Garfield County can
approve your plans and issue the Building Permit for your project: ,
A. Completed and Architect and/or Engineer stamped plans (two, sets) with:

I am writing to summarize the discussions that were held on April 21, 1993. Present at
the meeting on behalf of Kurt Wigger were myself, Louis Meyer and Walt Brown. The purpose
of the meeting was to discuss with you the potential for the issuance of a temporary certificate
of occupancy (or whatever the current nomenclature for that type of procedure is) to allow for
the opening of the Buffalo Valley Restaurant, as remodeled, prior to the implementation of the
final water and sewer solutions for the expanded facility. These discussions were, of course,
premised upon the assumption that all other work necessary to allow for an opening would be
completed and approved by the County, and the only outstanding issues would be water and
sewer.
As we explained, the current water solution will be the extension of the City's water
service from the existing City lines (located in the area of the cemetery) out to the Buffalo
Valley Restaurant and extending further to Holy Cross's property line. We anticipate approval
by the City Council on May 6, 1993, with a construction start shortly thereafter. We believe
we would be 2-3 weeks from final completion of the water line by the Memorial Day weekend,
the anticipated opening date of the remodeled Buffalo Valley Restaurant.
We are presently pursuing two alternative sewer solutions. Our preferred alternative is
the extension of City sewer service, so long as we can utilize the same trench as the City water
line extension. The sewer line extension would be cost prohibitive if an additional trench is
required. Because there are still unresolved design criteria with the City (although we are close
to resolution), we are also pursuing an alternative sewer solution with Fred Ingelhart.
Specifically, Mr. Ingelhart has acquired a small package plan which he is proposing to connect

to his existing facility, located just south of the Buffalo Valley Restaurant. This will sufficient
capacity to allow for the connection of the Buffalo Valley Restaurant. Of course, site approval
from the Colorado Department of Health would be required and is anticipate to take from 3-6
months. The installation of the facility should be completed prior to or consistent with site
approval by the State.
Our discussions with you contemplate opening on the Memorial Day weekend with
certain conditions contained within the temporary certificate of occupancy that will protect the
County and the public. You indicated that the criteria under Section l04(b) of the Uniform
Building Code is that no substantial hazard must exist as a result of the opening. We believe
that with the conditions we discussed that requirement will be met.
In terms of water and fire issues, those conditions would include the following:
l. Occupancy limit to the same level that existed prior to the current remodeling, or
approximately 190 people.
2. A hold harmless agreement for the County and fire district (and City, if
necessary).
3. A "drop dead" date by which the water line extension must be connected to the
Buffalo Valley and the fire flow provided or the temporary certificate of occupancy will expire.
As we get closer to the opening date, we will be able to identify for you a proposed completion
date of the project and, with some additional leeway provided, believe we can agree upon a
mutually acceptable "drop dead" date.
4. We understand you would want a standby fire watch person on the premises
during business hours per the Uniform Fire Code. That person and all employees would be
instructed on a fire watch routine and fire procedures.
5. A temporary water storage tanker truck or other storage tank with approximately
10,000 gallons of water would be located on the premises and available to the fire department.
6. There will be no fires in the fire place.
7. We are looking at the possibility of the installation of a fire alarm system,
although Jim Manson did not indicate this was a requirement.
8. We will also look at connecting the existing installed sprinkler system to the two
inch water line, if appropriate.

Concerning sewer service, the following conditions would be contained in a temporary

2. The status and integrity of the existing septic tank leach field system would be
checked periodically by a competent professional and recommendations from that person
concerning pumping or other remedial actions would be pursued.
3. A similar "drop dead" date provision would be included concerning sewer,
although that date might be different than the water system date, depending upon the sewer
alternative ultimately selected.
4. Don also indicated he would like the County named as a loss payee on the
insurance policy. Walt Brown is looking into that.
It is very important to Mr. Wigger that the Buffalo Valley Restaurant be able to open for
the Memorial Day weekend. We appreciate the time you took in meeting with us and your
efforts in helping us explore constructive solutions to the water and sewer issues as they relate
to the County permitting process. If for any reason my recollection of our discussions is
incorrect, please Jet me know. ·

In our opinion, the Buffalo Valley restaurant meets our
requirements at.this time and we have no problem with you issuing
a certificate of occupancy. I will be on. vacation the 25th so I
will be unable to meet with you when the T.C.O. expires. If you
have any questions or find any additional fire code related

Subject: Building Pennit # 4704. Attachment to Temporary Certificate of Occupancy.
Dear Mr. Wigger:
The Garfield County Building Department has issued a Temporary Certificate of Occupancy
(TCO) for the Buffalo Valley Restaurant. This TCO will expire on June 25, 1993.
A violation of the provisions or conditions of this TCO may cause the TCO to be terminated
and occupancy of the building pennitted.
These provisions or conditions include the following:
1. Conformance with the conditions agreed to and included in the letter from Mr.
Wigger's attorney Mr. Loyal E. Leavenworth, dated April 23, 1993.
2. Successful completion of a final electrical inspection by Mr. Leonard Rowe, Colorado
State Electrical Inspector. On June 3, 1993, Mr. Rowe signed an inspection report
stating that from the electrical standpoint the building can be occupied.
3. The Colorado State Health Department representative Jeff Lawrence has received a
letter from the owners representative stating that all concerns previously expressed by
the Health Department have been addressed. The Health Department will conduct a
final inspection by June 14, 1993 to verify that their regulations have been complied
with.
4. Successful completion of an inspection by the Glenwood Springs and Rural Fire
Protection District and agreement by them that the premises present no fire and life
safety risk unacceptable to them.
5. Successful Completion of an inspection by the Garfield County Building Department

verifying compliance with the following:
a. All required exits have been provided with a path of travel to a public way
(parking lot in this case) acceptable to the inspectors. Some presently require a
dirt or wood path be constructed.
b. All required exit doors in this building are required to have panic hardware.
Some doors are now equipped with key locking dead bolts. However if the dead
bolts are removed during the entire time the building is occupied by the public
on June 3, 1993 this will be acceptable for the opening. Appropriate panic
hardware will be required to be installed.
c. The building plumbing system shall have no condition of cross connection
between waste pipe or soil pipe systems and the potable water system or dish
washing system.
d. The installation of the gas appliance in the fireplace is in compliance with the
requirements of the 1988 Uniform Plumbing Code. Shutoff valve is required
within three feet of the appliance. The appliance is to be a listed appliance.
A Certificate of Occupancy will not be issued until the Garfield Building, Sanitation and
Planning Department have conducted a final inspection and all requirements of codes adopted
by Garfield county have been complied with and appropriate authorization to operate has been
provided by the Fire District, Colorado State Health Department.
