SPECIAL USE PERMIT

In accordance with and pursuant to the provisions of the G~rfield
County Zoning Resolution of 1979, as amended, and Resolution No. 84-112 of
the Board of County Commissioners of Garfield County, Colorado, State of
Colorado, hereby authorizes, by Special Use Permit, the following
activity:
A mobile home as a permanent residence.
on the following described tract of land in Garfield County, Colorado:

The within Special Use Permit is issued subject to the conditions set
forth in the above-mentioned resolution, and shall be valid only during
compliance with such conditions and other applicable provisions of the
Garfield County Zoning Resolution, Subdivision Regulations, Building Code,
and other regulations of the Board of County Commissioners of Garfield
County.
NOTE: This Permit shall expire 120 days after issuance unless
construction or use has commenced within that time period or unless the
Garfield County Board of County Commissioners has issued an extension of
this permit prior to it's expiration date.

School Impact Fee

On June 11, 1984 the Board of County Commissioners determined
that the Willisons should not have to pay the $200.00 School
Impact Fee. The lot was created in 1979 by Resolution 79-143
prior to Resolution 81-111 requiring that school impact fees
be paid on new lots created. See attached resolution.

RESOLUTION NO. 81-111
RESOLUTION CONCERNED WITH THE ESTABLISHMENT OF A FEE UPON
SUBDIVISION EXEMPTIONS FOR THE PURPOSE OF MITIGATING IMPACT
UPON EDUCATIONAL FACILITIES.
WHEREAS, the Board of County Commissioners of Garfield
County is authorized by the provisions of C.R.S. 1973,
30-28-133(4) (a), to provide for the dedication of land for
school sites, or, alternatively, the payment of a fee in lieu
of dedication of land, as a condition of the approval of sub-
divisions within Garfield County; and
WHEREAS, the Board has observed that significant, if not
more, residential land development occurs through the consid-
eration and allowance of subdivision exemptions by this Board
than through the subdivision process; and
WHEREAS, the Board has determined that such residential
development has created and will continue to create the type
of impact on schools which C.R.S. 1973, 30-28-133(4) (a), was
intended to mitigate; and
WHEREAS, this Board is authorized, by the provisions of
C.R.S. 1973, 29-20-104(1) (e), to regulate the location of
activities and developments which may result in significant
changes in population density and by the provisions of C.R.S.
1973, 29-20-104(1) (g), to regulate the use of land on the
basis of the impact thereof on the community and surrounding
areas; and
WHEREAS, this Board has determined that the creation of
separate tracts of land through the subdivision exemption
process has and will continue to cummulatively result in
significant changes in population density and to have signi-
ficant impact on the community, in the specific respect that
additional pressures are applied to existing educational
facilities which are not mitigated through the requirements
of the subdivision process; and
WHEREAS, this Board had determined, as a matter of public
policy, that land development resulting from the division
of larger tracts of land for residential purposes whether
through the subdivision process or through the subdivision
exemption process, or through divisions not otherwise prohi-
bited by tne-provisTO'ns of c:R.S. 1973, Title 30, Article
28, Part 1, should bear an equal portion of the burden of
mitigating the impact of residential development; and
WHEREAS, the Board of County Commissioners of ~arf~eld
County has been advised by the respective school d7s~r1cts
in Garfield County .that their impact would be s~f fic~ently
mitigated by the requirement of $200.00 per residential unit
authorized by this Board,
NOW, THEREFORE, BE IT RESOLVED, BY THE BOARD OF COUNTY
COMMISSIONERS OF GARFIELD COUNTY, COLORADO:

Section 1: That no resolution approving any exemption
from the application of the definition of "subdivision" or
"subdivided land" contained in C.R.S. 1973, 30-28-101(10),
or from the Subdivision Regulations of Garfield County shall
be adopted until the payment has been made to this Board of
a fee in lieu of dedication of land, in the amount of $200.00
per new residential site created by proposed exemption.
Section 2: That for the purposes of this resolution,
the term "site" in Section 1 shall include any division of
air space for residential purposes as well as any division
of land.
section 3: That all funds collected pursuant to this
resolution shall be credited to the account created and main-
tained pursuant to C.R.S. 1973, 30-28-133 (4) (a) and Section
5.11 of the Garfield County Subdivision Regulations, for the
use and benefit of the school district in which any development
occurs, to be withdrawn and paid to such school district upon
application and documentation of the purposes to which the
funds are to be applied within the purposes permitted by
C.R.S. 30-28-133(4) (a).
Section 4: That this resolution shall be effective on
the date of adoption and as to all actions taken by this
Board upon subdivision exemption requests on and subsequent
to this date.
