PROJECT INFORMATION AND STAFF COMMENTS
REQUEST: Exemption from the Definition of
Subdivision
APPLICANT: Sandra Smith
LOCATION: A parcel of land situated in the SW
1/4 and the N 1/2 of Section 13,
T7S, R88W; approximately 4 miles
north of Carbondale off County Rd.
103.
SITE DATA: The site consists of 120.70 acres.
WATER: Existing individual wells.
SEWER: Existing individual sewage disposal
systems.
ACCESS:
Private access drive off County Rd.

ADJACENT ZONING: A/R/RD
I. RELATIONSHIP TO THE COMPREHENSIVE PLAN
The site is located in District F, Rural Areas with Severe
Environmental Constraints and District C, Rural Areas with Minor
Environmental Constraints, as indicated on the Comprehensive Plan
Management District's Map.
II. DESCRIPTION OF THE PROPOSAL
A. Site Description: The site has moderate to steep slopes with a
variety of native vegetation. A small stream, tributary to
Cattle Creek, crosses the site. Improvements on the site include
an access road, two existing water wells, an indoor riding arena
and a house.
B. Project Description: The applicant proposes to divide the 120.70
acre tract into two parcels, 18.14 acres and 102.56 acres in
size. The proposed lots are consistent with legally described
parcels originally deeded to Ms. Smith but which were determined
to have merged into one tract. The 102.56 acre tract received
Sketch Plan approval for 7 lots in 1982.
III.MAJOR ISSUES AND CONCERNS
1. Soils information provided for the site is in the form of a
report by Lincoln DeVore and Soil Conservation Service maps and
descriptions. The reports note conditions on the site that may
require special construction techniques for any additional
houses.
2. Access will be provided to the smaller 18.14 acre tract has not
been established by the applicant and needs to be graphically
described on the Exemption plat.
3. Copies of well permits from the Division of Water Resources
should be provided.

4. The applicant has represented that the 120.70 acre tract was in
existence on January 1, 1973 and therefore qualifies for the
creation up to three (3) new lots by subdivision exemption, in
accordance with Section 8.52 A of the Garfield County Subdivision
Regulations. Some evidence of this fact, in the form of previous
deeds or other documentation, should be submitted.
IV. SUGGESTED FINDINGS
1. That proper posting and public notice was provided as required
for the meeting before the Board of County Commissioners.
2. That the meeting before the Board of County Commissioners was
extensive and complete, that all pertinent facts, matters and
issues were submitted and that all interested parties were heard
at that meeting.
3. That for the above stated and other reasons, the proposed
exemption is in the best interest of the health, safety, morals,
convenience, order, prosperity and welfare of the citizens of
Garfield County.
V. RECOMMENDATION
APPROVAL, with the following conditions:
1. That the following plat notes, or graphic descriptions, be
included on the recorded Exemption plat:

b) That a legally described easement, providing for access to
the 18.14 acre tract, shall be shown on the Exemption plat.
That the applicant submit a letter from the Carbondale Fire
District indicating that they serve the site.

4. That all representations of the applicant, either within the
application or stated at the meeting before the Board of County
Commissioners, shall be considered conditions of approval.
